The founding fathers carefully constructed the American system of government to prevent tyranny from once again ruling the colonies. The separation of powers was the most important idea in this aspect as it gave power at the top to many different areas. Within this separation, each branch has the ability to check the other branches so none can become more powerful than another. The American system of government fights against tyranny with representation by refining and enlarging the public interest. If legislation becomes too powerful and there is a significant majority within Congress, legislative tyranny can be just as dangerous as any other version of tyranny. This is the reason why when the framers formed our government. They inserted additional checks to control legislative excess. These checks were given to the executive branch and were unconstrained power by a council, an election separate of Congress, a four-year term, insulating its salary and most importantly the ability to veto legislative acts. Double security, otherwise known as federalism, gives the state power to check on higher forms of government. While the legislative, executive and judicial branches are horizontally equal on top, the local, state, and federal governments are a vertical separation of power. The reason for so many different separations of powers is because the more power that is spread around to people with different opinions and ideas at various levels of government, the less likely any of them are to become an overwhelming majority. “The power surrendered by the people is first divided between two distinct governments, and the portion allotted to each subdivided among distinct and separate departments. Hence a double security arises to the rights of the people.” This idea comes full circle with the idea of expanding the sphere to refine and enlarge government. The more people that have their voice heard in government the less likely any of the are to become a majority faction. The best way to control faction is by keeping it a minority.
