Service of process is the procedure by which a party to a lawsuit gives an appropriate notice of initial legal action to another party, such as a defendant, court, or administrative body in an effort to exercise jurisdiction over that person as to enable that person to respond to the proceeding before the court, body, or other tribunal. Service of process is a privilege set forth by the constitution, which means that all citizens of the united Stated hold the right to be informed of being summoned as specified in the fifth and sixth amendments of the constitution. If the summons is properly completed, the clerk must sign, seal, and issue it to the plaintiff for service on the defendant. A summons or a copy of a summons that is addressed to multiple defendants must be issued for each defendant to be served. Serving a documents must be files with the legal requirements such as the court and parties’ names, the directed defendant parties must reflect the defendant and plaintiff name, address and the represented attorney. State the time within which the defendant must appear and defend, always be sure to include the steps if the defendant fail to appear and defend will result in a default of the served document against the defendant for the relief demanded in the complaint, the document must be signed by the clerk and bear the court’s seal. If any requirements was not properly entered or signed the judge can grant access to amend the document. All summons must be served with a copy of the complaint.
