There are many legal issues a radiologist or radiologic technologist could possibly encounter. The consequences of not following the law in the imaging profession could range from being fined to losing licensure and being unable to practice. It is important for radiologists and radiologic technologists to understand the legal issues they could face since not abiding by the laws that regulate their profession could result in a loss of their livelihood. Radiologists often face legal issues concerning medical malpractice and for radiologic technologists, violations of the rules of ethics can lead to serious legal consequences. One of the important legal standards in radiologic technology is the rules of ethics. These rules are enforceable by law and are governed by the American Registry of Radiologic Technologists or ARRT. The rules of ethics “are intended to promote the protection, safety, and comfort of patients” (ARRT, 1998, p. 1) These rules are so important for the profession because “the public relies on certificates and registrations issued by ARRT” (ARRT, 1998, p. 1), meaning they are the safeguard for the public and the public needs to know that radiologic technologists are ethical and abide by the law that governs them. The rules of ethics are extremely in depth and they govern and prohibit many different things including fraud and deceptive practices, subversion, unprofessional conduct, scope of practice, fitness to practice, improper management of patient records, violation of state or federal law or regulatory rule, and duty to report. (ARRT, 2016, p. 2-4) Each of these topics have subcategories and every single one of the laws regarding these categories is something that radiologic technologists must abide by in order to avoid legal issues.
