Is Prostitution a Crime against the Person or a Victimless Crime?
Humans have evolved from primitive beings and at one time had more freedom to do what they want even when their actions did not please other members of our society. these actions have led to the development of laws that govern how people living in our society. The development of law brings about the definition of crime and offenses. An offense or a crime is an action which is harmful to an individual, state, community, or the public. Our laws forbid crimes and punishes offenders and criminals. Prostitution is a situation where individuals engage in sexual actions for compensation. Is prostitution a crime against an individual or it is a victimless crime?

In prostitution, the victims are controversial. It is because a criminal action is a claim raised by an individual who has been affected by the action caused by another to him as a person, a group, or a society. Nevertheless, there is no person who is directly affected by prostitution, hence, resulting to be a victimless crime. In many countries, sex work is termed as a victimless crime since there is no material harm that occurs to an individual when a crime is committed. In addition, it does not cause a damage that is overwhelming. An important part of prostitution, as a crime, is that the parties that participate have the cognitive faculties and possess the necessary information that a person requires to make a decision. Therefore, they engage in the practice knowing that it is an action that is forbidden by law and has its consequences. It is evident that individuals with mental problems engage in prostitution unknowingly. It occurs since they do not have the cognitive ability that can enable them to understand the implication of such actions. In such cases, the law requires a medical diagnosis to determine the mental health status of the victims. The law defines adults as individuals above eighteen years of age. They argue that it is a consensual action of sex amongst adults, therefore a victimless crime. However, they overlook the fact that it is an action that can cause psychological problems to the society by naming the society and the prostitutes themselves as the victims of the crime. In other cases, the victims of prostitution are forced to engage in the business. It is either a force created by someone else or a force created by circumstances which are unfortunate.
