The nature of the problem The systems of child welfare should change its emphasis back to its original goal of improving the well-being of children. The duty of investigating abuse complaints should be handed over to the police who can carry out proper investigations and the courts who can adequately charge those who cause physical and mental damage to children. Child welfare should be troubled with raising the level of poverty and the well-being of all children.

When children are hurt physically, emotionally, or sexually it is known to be child abuse. Children are known to be neglected when they are not getting the proper attention needed for children. When children are neglected or abused in any way it is the responsibility of others to report such acts to the authorities as to what they have witnessed first-hand or signs of abuse or neglect seen after the fact, these people who reports such acts are known as third parties. The proper authorities to report child abuse or neglect is called Child Protected Services also known as Child Welfare. After the abuse or neglect is reported the proper authorities will then investigate to see if the abuse or neglect is legit or fraudulent (Sedlak, 2001).
CAPTA focuses on the issue of child abuse and neglect within the U.S. CAPTA was one of the first major federal policies put into effect to address the issue of child abuse and neglect in the U.S. Prior to the development of this act, information is very limited on how child abuse really affected the children in the U.S. Within the first year of CAPTA 60,000 reports of child abuse and neglect were made and within a few years, these numbers had made a large jump to over a million reports in 1980. In 1990, 2 million reports were made, and in 2000, reports were somewhere around 3 million (CAPTA Reauthorization, 2016). In 2005 alone out of every 1000 children 12 children from birth to 18 had experienced some abuse and neglect. The 2005 report stated that 62.8 percent were cases of neglect, 16.6 percent were cases of physical abuse, 9.3 percent were cases of sexual abuse, 7.1 percent were cases of emotional, 2 percent were cases of medical neglect or abuse, and 14.3 percent were other situations of neglect or abuse. Overall that year 1,460 deaths were reported from child abuse and neglect (Goldman & Salus, 2003). Most services provided to families by the child welfare system have complicated requirements that make it nearly impossible for them to receive all the necessary resources. For example, the child welfare system currently provides the family with a packet of resources, in which the family on their own must contact agency after agency for services, just to be notified that there are fees to receive services or there are long waiting lists. For the most part, families are then discouraged from asking for further assistance. The child welfare system needs to be able to address the underlying issues that disadvantaged families are dealing with, which may be playing a role in the child maltreatment occurring in the home, whether it is general neglect or child abuse.
In 1974, the United States Congress passed an act that would provide the necessary laws and regulations that would protect those who have become victims of child abuse and neglect. According to this policy was meant to: “provide financial assistance for a demonstration program for the prevention, identification, and treatment of child abuse and neglect” (CAPTA of 1974 P.L. 93-247). This law became known as Child Abuse Prevention and Treatment Act. The Child Abuse Prevention and Treatment Act was first amended in 1974 and became known as CAPTA. However, over the years CAPTA has been amended several times. When CAPTA was amended on June 25, 2003 it became part of the Keeping Children and Families Safe Act of 2003. Finally, Children Protective Services has let down many children and families. Children who are in the homes of loving, nurturing parents are take away from their secure environments, and are placed into degrading situations. The children who are in desperate need of help do not receive it. Many of the real cases of abuse go unnoticed and unfounded. The system need to distinguish the difference between real child abuse and parenting because there is a child out there who does need help but the workers are too busy focusing their time on cases that are not necessary. If CPS would create a new sstructure and set new standards, many more lives could be saved.
To date in HN370: Child Welfare and Family, we have discussed family dynamics and culture. We have dug deeper into the social problem of poverty by defining it and discussing characteristics of poor children, why children live in poverty, the consequences of growing up in poverty and the correlation between homelessness and being poor. We have delved into substance abuse, paying special attention to both addicted parents and children. We have examined the affects of violence in the home, by peers and in schools, as well as the epidemic of bullying.
To many outsiders, the foster care system may appear to be a safe haven for those children that are abused or abandoned by their birth family. This is correct, but the system with which it is based, has many flaws. A background check is mandatory for all foster parents, but a test to see if a child 's temperament matches that caregiver 's parenting style, is not. Now, this is seen as a minor issue, but there is not enough evidence to support this. Plus, there are many other, much worse reasons, why the system is not perfect. Altogether, the foster care system and a multitude of its rules are flawed and may actually be negatively affecting foster children.
Since the case of Mary Ellen Wilson in 1874, child abuse has seen it’s share of light in published news. It is disheartening to read countless stories of future generations being harmed to the extent of psychological damage or even death. Child abuse as a whole has been addressed multiple times in various news blogs, however, nothing has been done to work towards abolishing it at a larger level. The future of America is in jeopardy based on the level of abuse that children endure. Childhelp states that approximately 5 children die every day at the hands of child abuse. America struggles to find equality, and by bystanding the stripping of its youth, continual prolonging is inevitable. Raising this nation’s children in means of nurturing and care is the first step to uplifting America as a whole. In 2012 alone, 1593 of America’s children died at the hands of child abuse, 70.3% of which were younger than the age of three (Safe Horizon). In order to prevent further child abuse, the American government should address stricter child protection laws, psychological stability, and an increase the recognition of those that have released their stories.
All the benefits provided by CAPTA are important, but one highly important benefit CAPTA provides for infants and children is that all allegations of child abuse and neglect must be investigated to ensure the well-being and safety of every infant and child. After allegations of child abuse and neglect are reported an investigation is the next step in protecting every child. Another benefit of CAPTA for infants and children is that if the heart wrenching experience of child abuse or neglect occur the state CPS systems and private organizations are trained and prepared to provide treatment for the child. In a like manner, CAPTA provides benefits for women and families by providing support and services that address domestic violence. CAPTA also promotes family involvement in all aspects of a CPS case involving child abuse and neglect. The states benefit by the foundation that CAPTA sets regarding the functioning of CPS systems and in a financial aspect. CAPTA provides funding to “Support child abuse and prevention activities by funding discretionary grants to states and/or public or private agencies or organizations” (California Department of Child Services, 2011). Everyone benefits when CPS systems according to CAPTA policies, “The act’s sponsors meant to feature three important themes of CPS reform in these amendments, including encouraging the involvement of family members in a child welfare agency’s decisions process; promoting and enhancing COS collaboration with domestic violence services and substance abuse treatment programs, and increasing the use of differential response by states through the use of noninvestigative/nonaccusatory approach to responding to reports of child maltreatment” (American Bar Association,

Munro (2003) states child abuse is treating a child in a way that is harmful or morally wrong however, goes on to explain it is hard to find a universal agreement of the definition of child abuse. NSPCC (2010) further explains child abuse as maltreatment of a child. This can be done directly by inflicting harm or indirectly by failing to prevent harm from happening. Abuse can be perpetrated by an adult or another child. Working Together to Safeguard Children (2013) states that it’s the responsibility of everyone who works with children to make sure that a child is safeguarded and their welfare promoted. The Purpose of this essay is firstly to discuss risk factors posed to Simone and Sasha through the scenario provided and highlight ways a professional should assess whether a child is suffering from an abusive or neglectful situation. Secondly the appropriate action that needs to be taken, and the support that needs to be given, and what services will be involved with the family in order to prevent a family brake down while safeguarding and protecting the children’s welfare, will also be discussed. Child abuse is a social problem in America that has many contributed factors. Factors that contribute to child abuse and neglect includes poverty, divorce, substance use, lack of education, stress due to unemployment, mental health issues, teenage parent, and a history of child abuse in the family. It took decades for physicians to conclude that parents have been violently assaulting their children. Child abuse, child labor, juvenile delinquency, and similar social questions historically were ethical and moral problems, not strictly medical ones. (Helfer, Kempe, & Krugman, 1997). In 1962, the Journal of American Medical Association published “The Battered-Child Syndrome.” The article transformed society’s views and dates the rediscovery of child abuse as a social problem. Following this article, the U.S. Children’s Bureau adopted the first laws mandating physicians to report any suspicions of abuse and neglect to the police or child welfare. By 1974, some 60,000 cases were reported. In 1980, the number exceeded one million (Myers J. E., 2004).
