In this guide I will clarify many issues concerning consumer
protection, the first issue I would like to clarify is what consumer
protection is all about.
Consumer protection is about protecting ordinary people who buy goods
and services, from the being sold faulty goods or poor quality
services from dodgy traders.
Any person has some basic legal rights if a product or service is
found to have a false description, is of poor quality or not fit for
its purpose.
There are five main consumer protection laws which serve to protect
these rights, they are:
1. The Sale Of Goods Act 1979 And 1995 (protects the consumer against
faulty or poor quality goods)
2. Supply of Goods and Services Act 1982(Services standard are
protected by this act)
3. The Consumer Protection Act 1987 (Relates to price and safety)
4. The Trade Descriptions Acts of 1968 and 1972 (protects consumers
against misleading information)
5. Consumer Credit Act 1974 (protects the consumer when he buys on
credit)
Now that you have a little knowledge of what consumer protection is I
would like to put you in a situation and show you how a consumer can
react to a situation in the most effective way should a circumstance
concerning consumer protection turn up.

The study of consumer behavior as a separate marketing discipline all started when marketers realized that consumers did not always react as marketing theory suggested they would (Ekström, 2003). Many consumers rebel at using the identical products that everyone else used, instead they prefer differentiated products that they feel reflect their own special needs, personality and lifestyles.
This essay will examine key aspects of the recent implementation of the Australian Consumer Law (ACL) 2011, which is the largest overhaul in Consumer Law in Australia in the past twenty five years. The ACL replaces 20 existing State and Territory laws into one national law , the legislation was enacted in two main parts as Schedule 2 of the renamed Trade Practices Act 1974 (Cth) (TPA) - Competition and Consumer Act 2010 (Cth) (CCA) . Aforementioned this essay it will outline the key benefits of the implementation of the act. Furthermore it will critique the Act, whilst exploring the objectives of the legislation.
The Australian Consumer Law (ACL) was established to protect consumers in any legal trading activities in Australia. A set of guarantees has also been introduced for those consumers who are acquiring goods and services from Australian suppliers, importers or manufacturers. The guarantees are intended to ensure that consumers will receive the goods or services they have paid for. If they have problems with the products and services they bought, they are entitled for remedies, such as repair, replacement, and refund.

In this age of endless lawsuits and litigation from everyone suing everyone else, one must ask the question “where does product liability end and consumer responsibility begin?” This question has been further complicated by occurrences that stretch to the most far-reaching ends of this spectrum, the spectrum ranging from strict product liability of the company to complete consumer responsibility. On the strict product liability of the company side, we have the cigarette industry where the CEOs of the largest cigarette companies denied that their product was liable for the cause of addiction. Almost all consumers know that the ingredient nicotine in cigarettes is addictive, due to extensive scientific testing and reports on this fact. What these CEO’s should have done was admit that they knew nicotine was addictive, and therefore made their product liable so as to give a fair warning to unknowing consumers. On the complete consumer responsibility side, we can examine the lawsuit where a man sued McDonald’s for over a million dollars because he spilled a cup of their coffee on his self and suffered burns. He claimed that McDonald’s was liable because there was not a warning on the lid that stated that the coffee was hot. In my opinion, this lawsuit should have never happened. The consumer is attempting to alleviate all of the responsibility from himself for spilling his coffee and pass it on to the producer of the product. Frivolous lawsuits such as this, as well as companies failing to consider the importance of product liability, have resulted in an increasing annual product liability bill. Last year alone $4 billion was spent on product liability lawsuits and settlements (McAdams, p.636). This staggering number suggests that maybe we need to reform our liability system. Ideally, we as a society would like to reach a happy medium between strict product liability of the company and complete consumer responsibility. If this occurred, lawsuits such as this would no longer drain our legal systems because an understanding would exist that the responsibility rests equally in both parties’ hands. Conclusion Companies are better able to market their products to consumers if they have a good Understanding of the consumers and the basic purchase decision process. By understanding the consumer and the type of purchasing behavior associated with different products, marketers are more likely to create a marketing campaign that positively impacts the consumer’s purchasing decision.
The government has always defined their stance to support and protect the rights of American citizens. However, recent evidence has come to show that the government has abused our terms of rights and protection in the past few years, leading to the decay of the government's purpose: to serve the public. According to Katie Johnson, "this past summer, Americans learned the IRS was requesting personal information on employees, donor information, and other private data" (Johnson 1), which led to an ideal situation that illustrates this very point. As stated by Johnson, the collection of data without the owner's consent immediately infringes our many constitutional principles. Not to mention our constitution is the basis of our society. If a branch of the American government has the capability to act illegally upon the principles that protects our rights, the possibility of the federal government alone remains infinite.
All around the world there are laws made by municipal, provincial, and federal governments that are made to have a positive impact on its people. If you decide to rob a bank, or decide to hijack a vehicle, there are serious consequences due to the law. These laws positively impact our society by giving our society safety, but do laws such as the Consumer Protection Act, or the Employment Standards Act also give us a positive effect? Both of these acts are made up of many different parts, and I will be going through parts of both acts in this essay.
