Police officer in all states are granted authority to use force to accomplish lawful objectives, such as makes an arrest, serve warrants, and detain a person. Force may be investigated by an internal review board, supervisor, the chief of police, the district attorney, and perhaps even a judge and jury if a civil lawsuit for excessive force is filed. Ask a dozen civilians when “necessary force was reasonable” to an arrest or detention that has become “police brutality” and you will probably get different answers, none which in particular helped determining the proper amount of force. Several civilians may argue about an officer’s use of force and each one may have a different idea of how to determine whether the force was excessive. All police officers are often forced to make split-second decisions in circumstances that are tense, unsure, and rapidly evolving. Also the use of force should be measured by what the officer knew at the …show more content…
An officer may use force which is reasonable and necessary to effect an arrest or detention. Anything more is excessive force.in addition to the questions asked by the Graham v. Connor test, courts consider the need for the application of force between the need and amount of force used, and the injuries caused by the officer’s force. As well as the method of force used by the officer, a tool, or weapon used. In the lawsuit case of United States v. Dykes (D.C. Cir. 2005). A judge stated that the use of a Taser and baton strikes against Rodney King, were, not reasonable, and not criminally excessive force. The officers involved in the Rodney King incident inflicted more than fifty strikes and blows after king resisted the officers, King obeyed the commands the officer’s gave King. After King went on a prone position, one of the officers kicked him and another struck him with a baton. Deadly force is measures and is limited by several constitutional considerations. In a Supreme Court decision a rule that allowed officers to use deadly force against a fleeing felon has been abolished. There are a series of steps when an officer can use deadly force: first, when the officer is threatened with a deadly weapon; second, when the officer has probable cause to believe that the suspect poses a threat of serious physical harm or death to the officer or to another; and third, when the officer has probable cause to believe that the
Over the years, our nation has witnessed countless cases of police brutality. It has developed into a controversial topic between communities. For instance, deindustrialization is the removal or reduction of manufacturing capability or activity can lead to more crimes when people are laid off. Police officers are faced with many threatening situations day-to-day gripping them to make split second decisions; either to expect the worst or hope for the best. The police are given the authority to take any citizen away for their action that can ruin their lives. With that kind of power comes great responsibility, which is one main concern with the amount of discretion officers have is when to use lethal force. The use of excessive force might or
When hearing the phrase “police brutality,” many people imagine batons cracking skulls, tasers electrocuting bodies and bullets penetrating innocent teens. While police officers have been known to use violence, police brutality does not occur as often as many believe. In many situations, officers have to act on impulse and curiosity, despite the backlash the media may create.
Police brutality is a civil rights violation that occurs when a police officer acts with excessive force by using an amount of force with regards to a civilian that is more than necessary. Excessive force by law enforcement officers is a violation of a person's rights. Excessive force is not subject to a precise definition, but it is generally beyond the force a reasonable and prudent law enforcement officer would use under the circumstances (“Police Brutality Law & Legal Definition”,2013).
Connor, the Supreme Court held that the test used for whether force was excessive should be “objective reasonableness” and not based on how much pain an officer inflicted upon a suspect. They remanded the case to a lower court based on their described standard. Under this standard (or test), officers have the right to used “reasonable” force in any interaction with the public. They are not obligated to use the least possible force as long as the force is objectively reasonable. The test indicates that the use of force should be from the perspective of the officer on the scene at the time and not in
In most if not all the cases the victim of the excessive force is charged with resisting arrest and or assaulting a police officer, When in fact they are the ones who have been assaulted and victimized themselves. They are now fighting two uphill battles that are very difficult to win in any situation. A lot of the time the victim is from a poor or low income area and may have already been perceived to be a criminal by the police. The police have a great deal of power and they sometimes manipulate situation to make it look like or to hide what may have happen in an arrest situation. My father would tell me stories about the police and the things some officer would do to get away with abusing their power. The police need to be monitored and public needs to be more educated about what Law enforcements job is and how to best help them do it.
Was the intrusion based on a lawful objective, such as a valid arrest, detention, search, frisk, community warden guardian of mentally ill, defense of an officer or a citizen, or to prevent escape? If these answer yes then an officer may have legal ability to use the levels of force listed below to apprehend the suspect. Another list of things to consider when determining if it was a lawful use of force is; was the use of force relative to the person’s confrontation? Was there a crucial need to terminate the condition? Even though there is no duty to retreat, could the officer have used lesser force and still safely accomplish the lawful objective? These are the questions that the jury need to answer to determine if they should side with or against the officer in any court case brought to them that deals with such a controversial topic as this.
Most law enforcement agencies have policies that determine the use of force needed. The policies describe the escalating series of actions an officer can take to resolve a situation, first level is officer presence which means no force is used, and just the mere presence can reduce
Early in the 17th century was when the first modern day policing was expected to have begun. Ever since the 18th century begun, incidences of police using excess force by abusing their power have been quite common. As time progressed, these wrongful actions by police have been entitled as police brutality. Police brutality is defined as" the use of excessive force used by police dealing with public... excessive force can be either physical, verbal, and/or psychological". According to this definition, whether it be arresting someone with too much force or even uttering certain statements, can all be classified as police brutality. No individual should be victimized by police officers who use excess force that in no way deters crimes. It does nothing but bring a dire unjust society in which innocent people can feel afraid; and give those officers who are correctly doing their duties a bad reputation. Due to the dispensable, unscrupulous nature of police brutality; several measures including disciplining police officers, stricter laws(and stringent penalties), integration, as well as educating the general public about their rights, must be applied in order to extirpate the misconduct citizens should not have to face.
Over the years, this country has witnessed many cases of police brutality. It has become a controversial topic among communities that have seen police brutality take place in front of their homes. Officers are faced with many threatening situations everyday forcing them to make split second decisions and to expect the worst and hope for the best. Police officers are given the power to take any citizens rights away and even their lives. With that kind of power comes responsibility, that’s one major concern with the amount of discretion officers have is when to use force or when to use lethal force. The use of excessive force may or not be a large predicament but should be viewed by both the police and the community.
Many do not know what Deadly Force is and when is the appropriate time for the Police Officer to use it. According to CFR 1047.7 “Deadly Force means that force which is reasonable person would consider likely to cause death or serious body harm”. This means that deadly force is supposed to be used as a last resort when Police Officer cannot get the situation under. To be able to use Deadly Force it has to be justified only if when all of the lesser means have failed to work or they cannot be employed reasonably. A Police Officer that is protective is authorized to use deadly force only when one of the five circumstances exist. The first circumstance is “Self-Defense, Serious Offenses against persons, Nuclear Weapon...
Recruiting officers is a vital job for any city, state, federal department. The people that are recruited could be the next leaders of the department. Most departments try to pull in the most diverse and qualified applicants that are looking to make law enforcement a career. They also look for applicants that have a commitment in severing their community. The recruiters have a bigger pull of people with the unemployment rate going up. There are more people going back to school to study criminal law and are looking for a career in law enforcement. The recruiters look for people that hold knowledge in law, communication skills, self- discipline, and attention to detail. The new recruit should want to stay learning new things by furthering their education in law enforcement. The recruiters must hold a high standard for hiring police officers because of what the community expects from their law enforcement. Most recruiters have to go by the department’s code of ethics that each department has set for their officers. This has made recruiters come up with new ways of trying to recruit officers. Some recruiters have started going after top students out of universities and other schools. Many Departments have come up with hiring incentives for new r...
The first step is to weed out the ones who just are not right to be a officer. The next step is to find the ones who fit the needs of the department. Medical and psychiatric testing, personal interview, and background information is used when identifying if a person is a good fit. There is research that has identified five personality characteristics that allows a police officer to excel in his or her job: extrovert, emotional stability, agreeable, conscientious, and open to experience. People also need to be aware of working in a high crime area. Even if the person has all five traits, but can’t handle the stress they may need to find another profession. There may be times new hires come from another department, but before hiring they need to talk to the previous employer. There may be certain reasons that the officer for hire is wanting to move to a different department. They could have been disciplined or terminated if they had not agreed to resign. This is not okay for the officers are not taking the consequences for their behavior.
What is considered force in law enforcement? Force is the amount of physical interaction between individuals or objects. Law enforcement officers use force when it is necessary, in order to protect individuals from each other. Police officers have the discretion to use force in situations that they see as necessary. What is the limit that law enforcement officers are able to use physical force? The amount used is dependent on the law enforcement officer in the situation. The use of force can be categorized into soft hands, presence, hard hands, baton, and deadly force. We have seen from current events that law enforcement has used the wrong judgment in the force they apply to a situation. Society has have made the image of law enforcement look
According to the National Police Academy, in the past year, there have been over 7,000 reports of police misconduct; fatalities have been linked to more than 400 of these cases (Gul). Police brutality is often triggered by disrespect towards the police officer. The most noticeable form of brutality is physical, where Chemical gas, batons, tasers, and guns, can be used for physical intimidation or to actually hurt people. Police brutality can also take the form of verbal abuse or psychological intimidation. It seems reasonable to understand that sometimes the police are put into situations where excessive force may be needed. But, because some officers use these extreme actions in situations when it is not, police brutality should be addressed and looked into by both the police and the public. For instance, a police officer who beats a nonviolent protester with a baton would probably be accused of excessive use of force, under the argument that the police officer probably could have dealt with the situation less violently.
