Do you have the right to “Stand your Ground” or the “Duty to Retreat”?
In 2005, Florida passed a new law called “stand your ground” or SYG. By 2006, other states started to adopt Florida’s SYG laws and currently over 20 states have them. SYG states a person has the right to use lethal force if they are in fear of great bodily harm or death and are in a place in which they can legally be (“Self”). SYG also states that a person has no “duty to retreat”. Prior to SYG laws every person had a legal obligations to “retreat” if possible. If you did not “retreat” and the perpetrator died, the victim could be held accountable. Critics of this law are calling it the “shoot first” law (Lott).
