We have changed the way we police and prosecute having learned from overpopulating the prisons to the point that it is unsafe and does not serve the purpose of rehabilitation and our exploding probation departments. Recidivism rates for prisons largely suggest that less than half of all inmates are rehabilitated making alternatives to incarceration a necessity as we search to tailor solutions to each offender. Cost effective solutions, true long-term rehabilitation and restoring the community are proving to be better suited to many kinds of offenders than becoming institutionalized. For some offenders going to jail or prison is too harsh of a punishment and for others probation may be too lenient, what is in the middle is ample opportunity to get one “back on track” with intermediate sanctions that are cost effective also more kind and compassionate than the usual criminal justice system. Residential Intermediate Sanctions provide services and housing as an alternative to jail and prison sentences. As the most frequently used type of residential community correctional facility a halfway house helps one achieve success in rehabilitation through goals and rules. Public safety is paramount when discussing jail diversion programs. Whatever has caused the offender to commit crime, be it substance abuse or a mental illness, does not negate the fact that the crime was committed and the public must be protected from the offender is some form or fashion. Jail diversion programs have various tracking methods of offenders but they do provide enough freedom and opportunity for recidivism. Also, treatment services and incarceration do often work at cross purposes and unless integrated successfully can cause barriers to coordination and solutions (SAMHSA, 1993). One organization emphasizes treatment and the other emphasizes public safety and punishment.
When envisioning a prison, one often conceptualizes a grisly scene of hardened rapists and murderers wandering aimlessly down the darkened halls of Alcatraz, as opposed to a pleasant facility catering to the needs of troubled souls. Prisons have long been a source of punishment for inmates in America and the debate continues as to whether or not an overhaul of the US prison system should occur. Such an overhaul would readjust the focuses of prison to rehabilitation and incarceration of inmates instead of the current focuses of punishment and incarceration. Altering the goal of the entire state and federal prison system for the purpose of rehabilitation is an unrealistic objective, however. Rehabilitation should not be the main purpose of prison because there are outlying factors that negatively affect the success of rehabilitation programs and such programs would be too costly for prisons currently struggling to accommodate additional inmate needs.
The purpose of a halfway house or also called a recovery house is generally to allow people to begin the process of reintegration with society, where monitoring and support will be provided. This is to reduce the risk of recidivism or relapse where in most cases ex-convicts would be released directly back into society. The halfway houses that is being purposed is meant solely for the reintegration of persons who have been recently released from prison or jail, others are meant for people with chronic mental health disorders, and others are for ex-convicts with substance abuse issues.
Corrections are a necessary tool to protect society from those who do harm to others or to others property. Depending on the type of crime that was committed, and if the crime is considered a state or federal charge, also depends on where the person sentenced will do his time. There are four main sentencing options available; prison, probation, probation and confinement, and prison and community split. When a person is sentenced to do their time in prison most likely they will go to a state or federal prison. If a person is ordered probation, it prevents them from going to jail but they have stipulations on their probation. This is called intermediate sanctions, which are the various new correctional options used as adjuncts to and part of probation. Some intermediate sanctions include restitution, fines, day fines, community service, intensive supervised probation, house arrest, electronic monitoring, and shock incarceration.
As the need for increasingly punitive community-based sanctions grew, the demand for a greater variety of programs and services became apparent, as did the importance of a more seamless transition from total incapacitation to total freedom of prisoners re-entering society. Intermediate sanctions are a new punishment option developed to fill the gap between traditional probation and traditional jail or prison sentences and to better match the severity of punishment to the seriousness of the crime. Intermediate sanctions served in the community now account for 15 percent of adjudicated juvenile cases (Puzzanchera, Adams, and Sickmund, 2011). All intermediate sanctions are enforced by the United States Criminal Justice System. The main purposes of intermediate sanctions: (1) better match the severity of punishment to the seriousness of the crime, (2) reduce institutional crowding, (3) control correctional costs. Primarily, this is a needed method of punishment to make offenders accountable for the extent of crime and if so let offenders live in their communities to fulfil punishment if not too extensive.
Punishment has evolved from the days of waiting to be hung to the sophisticated prison systems of today. However prisons in the United States are crowded and costly and they are not always appropriate for all offenders, especially those that have committed minor offenses. In the last couple of decades new methods of punishment has been developed for the minor offender. These fall under the category of intermediate community sanction and consist of electronic monitoring and home confinement. These punishments have proven very useful in dealing with minor offenders, pretrial confinement and others in need of supervision. They seem to be effective and help to transfer some of the cost of prison back to the offender.
The goal of a halfway house is to assist offenders with a smooth transition from a penal facility back into the community (Latessa & Smith, 2011). This transitional period is vital for the offenders to be successful upon release allowing them to have an opportunity to obtain employment, treatment, as well as providing them a place to call home until they are able to find suitable housing. There are two types of halfway houses noted in the text, the first is supportive and the second is interventive.

The issue with the current structure of the prison sentencing process is it does not deal with the “why” the individual is an social deviant but only looks at the punishment process to remove the deviant from society. With the substantial increase in prison population and various changes that plague correctional institutions, government agencies are finding that what was once considered a difficult task to provide educational programs, inmate security and rehabilitation programs are now impossible to accomplish. From state to state, each correctional organization is coupled with financial problems that have depleted the resources to assist in providing the quality of care in which the judicial system demands from these state and federal prisons. Judges, victims, and prosecuting attorneys entrust that once an offender is turned over to the correctional system, that the offender will receive the punishment imposed by the court, be given services that aid in the rehabilitation of those offenders that one day will be released back into society, and to act as a deterrent to other criminals contemplating criminal acts that could result in their incarceration. Has our nation’s correctional system finally reached it’s critical collapse, and as a result placed American citizens in harm’s way to what could result in a plethora of early releases of inmates to reduce the large prison populations in which independent facilities are no longer able to manage? Could these problems ultimately result in a drastic increase in person and property crimes in which even our own law enforcement is ineffective in controlling these colossal increases in crime against society?

Studies have shown the decline in recidivism with rehabilitation. Offenders are less likely to renter jail when they have somewhere to live, job, and a positive relationships. I agree with Chief Justice Warren E. Burger, “To put people behind walls and bars and do little or nothing to change them is to win a war but lose a battle. It is wrong. It is expensive. It is stupid” (Schmalleger, 2009). I believe rehabilitation can serve as a new beginning to what the offenders and even society considered an ending.

Even though this system is evidently “more freedom” based, it still allow for offenders to rehabilitate and function within society. Furthermore, the ISP has reduced prison crowding, recidivism, and has saved money on incarceration expenses. Although, intensive supervision probation is more effective towards the treatment of low-risk offenders such as drug and alcoholic abusers, it avoids spending costs on the construction and operation of more prison space on offenders who do not pose a high threat to society. Ultimately, intensive supervision probation is an effective alternative to incarceration and establishing more ISP programs will undoubtedly encourage improving treatment of offenders and deteriorating criminal behaviour.
