Counterintelligence is defined by the “Executive Order 12333 as information gathered and activities conducted to identify, deceive, disrupt or protect against espionage and other activities carried out by foreign states or non state actors” (Lowenthal, 2011, pg. 163). Legally counter intelligence actions are to be documented support for using deceptive actions (Moravej &Diaz, 2007). Counterintelligence to fight terrorism has been in strong effect post the 9/11 attacks. In fact, the agencies that deal with such issues have increased in size, resources and funding. Many of the foreign counterintelligence methods are now adapted to national puposes. First, Fighting terrorism today is not like fighting the soviets during cold war in regards to intelligence Soviets used political movement and terrorist, today, use religion to lead their cause (Lowenthal, 2011, pg. 278). Religion complicates counteraction because it is not simple to classify one religious group as a terrorist threat, doing so would be a violation of civil liberties (Lowenthal, 2011, pg. 278). Second, sending in HUMNIT into a terrorist cell is difficult because agents are likely obligated to perfrom a terrorist attack to prove their loyalty (Lowenthal, 2011, pg. 280). Clearly we can see the ethical dilemma in allowing this. Fnally, since 2001 terrorism activity has gone from a centralized organization to a randomly structured organization one that now operates from remote areas and some even independently until needed (Lowenthal, 2011, pg. 283). Our opinion is that the system, though well intentioned is flawed, but has potential through proper training and guidelines to operating new methods of counterintelligence. It is not enough to implement the best technologies and increase agent presence. In addition, it is not enough to have agencies police themselves, that is clear due to recorded abuse of power. Counterintelligence to combat counterterrorism is necessary but as stated needs improvement. For example, domestically there are terrorist operations being conducted and counterintelligence can identify these potential threats. Counterintelligence methods are always going to be controversial but when the efforts remain focused and the purpose is to protect the process of protecting our nation, then we can see that it is an effective method. If we did nothing then there would be no nation to protect. It is important to understand how the target will operate. In the process it is important that we improve counterintelligence in the United States or else we face violating civil liberties. As the system needs updating so does our view on how terrorist organizations
