After reading the case the main arguments in favor of the tobacco advertisement ban are the following: Regarding the legal aspect, the government has international precedents that support his decision of banning the tobacco advertisement: courts of Belgium and France have endorsed the decision of banning the advertisements saying that the ban wasn 't unconstitutional and it was looking for the protection of the citizens ' health. Regarding the ethical arguments, the text explains that the World Health Organization estimates that in 2020 there will be up to 8.4 million deaths related to the tobacco consumption and in 2030 this number will increase up to 10 million. …show more content…

According to the text, the Canada Supreme Court says that paternalism in unacceptable in a democratic society. Regarding the responsibility of advertisements in inducing people to begin smoking, the tobacco companies assure that their advertisements are not focused to gain new clients but attract to their brand to the already existing smokers. This statement is supported by a 1998 study made by the Indian Market Research Bureau that revealed that none of the smokers asked said that they began smoking due to advertising. In relation to the increase of unemployment in the tobacco industry, in particular with regard to the farmers and the rollers, the Government should increase the tax on cigarettes sold and then allocate that revenue growth for recycling those unemployed people and help them to have a second chance.
