The Patriot Act
After forty-five days had passed since the terrorist attacks on September 11th, 2001 Congress passed the USA PATRIOT Act which stands for “Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism”. “This Act is a 342-page, sprawling piece of legislation that contains more than 150 sections and amends more than 15 federal laws”(USA). The laws that this act clearly “bypasses” goes completely against the U.S. Constitution which was drafted by bright and experienced men who wrote that document for a clear reason. The rights that are encroached on by the Patriot Act are sometimes not directly related. If a newspaper or magazine editor wanted to publish a critical article about the government; which is in almost all cases, completely legal, he would be under constant fear that the Big Brother a.k.a the Federal Bureau of Investigation (FBI) would be watching his every move. One of the most scary aspects of the Patriot Act is that is gives the government the ability to look into and spy into any of its citizens without having to give explicit evidence that the suspects are actually engaged in criminal activity. If citizens knew about how much they were monitored every day they would be a lot more withdrawn when expressing their ideas on the internet even though the First Amendment says that they can express whatever they feel everyone will still be cautious about what things they let people see just due to the fact that they’re intimidated. If Americans think that them giving up their own rights as citizens in order to obtain a more secure lifestyle then they’re wrong. Just by letting the government bully us around like this it is actually degrading our morals and what democracy means to us. The last reason I oppose the Patriot Act is because it takes what our founding fathers laid out for us to do as a country and it stomps on it. It tramples over everything we’ve fought for since the American Revolution and a simple Act should not be the demise of The United States of America. If the government could come up with a solution that would protect us from foreign threats but also still value our unalienable rights that would completely clean up the mess we made when we passed this bill. The Patriot Act violates many of the amendments in the Bill of Rights. The First Amendment, for example, gives American citizens freedom of speech, press, and religion. Less than one week after the devastating terrorist attacks of September 11, 2001, the U.S.A. Patriot Act was introduced to Congress. One month later, the act passed in the Senate with a vote of 98-1. A frightened nation had cried for protection against further attacks, but certainly got more than they had asked for. Russell Feingold, the only Senator to vote down the act, referred to it as, “legislation on the fly, unlike anything [he] had ever seen.” In their haste to protect our great nation, Congress suspended, “normal procedural processes, such as interagency review and committee hearings,” and, “many provisions were not checked for their constitutionality, lack of judicial oversight, and potential for abuse.” Ninety-eight senators were willing to overlook key civil liberty issues contained within the 342 page act. The lone dissenting vote, Wisconsin Senator Russell Feingold, felt that our battle against terrorism would be lost “without firing a shot” if we were to “sacrifice the liberties of the American people.” Feingold duly defended American civil liberties at the risk of his career, truly exemplifying political courage as defined by John F. Kennedy.

We all have heard the quote “Life, Liberty, Land, and the Pursuit to Happiness” and that is the promise of a life here in America. As Americans we pride ourselves on these freedoms that allow us to live everyday. We are one of the only countries that have this promise and it is what draws people from all of over the world to come here. Our founding fathers of the United States of America wrote these words, having no idea the impact that they would have for the rest of this countries history. Those words were the foundation for government, and it wasn’t perfect at first but slowly it matured into what we have today, strong and powerful. To other nations America is seen as the World Power, and a somewhat perfect nation to live in. Unfortunately corruption, scandals and controversies have tainted our once golden glow, and other nations are weary of watching their steps. One of the most controversial elements to our government is the NSA. Hidden in the shadows from American and global knowledge is what the NSA is actually doing and watching out for. Only very recently has the NSA been ripped from the shadows and brought to light what exactly is going on inside those walls. They are “spying” on not only America’s personal data, but foreign leaders as well. The NSA says it’s for the safety for everyone against terrorism and attacks. However, it has gone way to far and violates a constitutional right, privacy. The NSA has overstepped their boundaries, and spying doesn’t seem to make a difference in safety.
While this act made legislative changes that increased surveillance and the investigative powers of law enforcement agencies to protect America from further terrorist acts, the passing of the USA Patriot Act has reduced the privacy rights of Americans and also does not provide for a system of checks and balances that safeguard civil liberties. Terrorism is a serious matter that should not be handled lightly, but the act has gone over the top in trying to stop terrorism. The USA Patriot Act, enacted for protecting America from further attacks, not only does little if anything to protect Americans, but rather undermines their civil rights. Since the terrorist suicide bombed the world trade center and a wing of the pentagon, there has been a change in the relationship between the United States government and the people. The executive branch has taken steps that undermine the principles in the United States constitution. In order to ensure a more democratic society, we have to tell the difference between effective governing and individual freedom. There is one main topic I'm going to talk about how the 1st amendment, 4th amendment, 5th amendment, and 6th amendment are being eroded by the USA PARTRIOT Act which introduced a overabundance of legislative changes which considerably increased the surveillance and investigative powers of law enforcement agencies in the United States.
Edward Snowden is America’s most recent controversial figure. People can’t decide if he is their hero or traitor. Nevertheless, his leaks on the U.S. government surveillance program, PRISM, demand an explanation. Many American citizens have been enraged by the thought of the government tracing their telecommunication systems. According to factbrowser.com 54% of internet users would rather have more online privacy, even at the risk of security (Facts Tagged with Privacy). They say it is an infringement on their privacy rights of the constitution. However, some of them don’t mind; they believe it will help thwart the acts of terrorists. Both sides make a good point, but the inevitable future is one where the government is adapting as technology is changing. In order for us to continue living in the new digital decade, we must accept the government’s ability to surveil us.
“We have to make a balance between security and civil liberties.”(Sensenbrenner 2). The patriot act was passed with very little congressional debate. The public was unaware of its passing. Our security is over protective because rights are being broken. Our rights should matter more to the government because the security is overprotective. Is the patriot act too harsh and invading our privacy?
The Patriot Act has been under scrutiny and opposition since its creation following 9/11. When 9/11 struck it was clear that Americas intelligence was lacking in some specific way, but it was translated that America needed greater allowance for gathering information. The Patriot Act was signed on October 26, 2001, very close to 9/11. It can be concluded that the Patriot Act was signed with such extreme ability’s applied, because of how close it was signed after 9/11. The Act Greatly expands the liberty’s if law enforcement in their efforts to gather information, which in turn imposes on the privacy of the American people. The FBI has the ability to study any citizen suspected of terrorism, and has access to all their information. Wire Taps and other invasive action are allowed and granted by the Patriot Act. Was the Patriot Act signed to quickly? Are its measures to extreme? When is the line drawn on how much power the government can have? Is the Patriot Act effective enough that it is necessary? Should we as Americans willing to trade freedom for safety? Can the Patriot Act effectively stop or hinder terrorist attacks; has its stopped enough attacks to be validated? Another question is does America want a government that has that much power, how much are we as Americans willing to sacrifice, and how much more liberty’s is the government going take. If the government can pass the patriot act, what other legislation can they pass? In reality it all comes down to the American people, we are democracy but do we have the power in are hands? To begin with, American society was founded on the idea that people are innocent until proven guilty. The overall acceptance of NSA programs reveals that Americans are becoming increasingly more comfortable with trading liberty for security. The counterargument to this has always been that if one has done nothing wrong, they have nothing to fear. However, that defies the very idea of liberty. The traditional, Webster definition of liberty is, “the state of being free within society from oppressive restrictions imposed by authority on one's way of life, behavior, or political views.”
Since September 11, 2001 many people can say that America has changed. Many people question if America has changed for the better or has it just gotten worse. Since the day those four planes crashed around the United States people’s lives have been changed. Many may not realize how their lives have changed, but with new laws passed life is different within America. The United States Patriot Act is one of the laws passed after 9/11: singed into order on October 26, 2001 just 45 days after the attack. The United States Patriot Act was put in place in order to protect Americans, yet has been affecting American’s civil liberties and caused controversy all over the United States.
September 11th 2001 was not only the day when the delicate facade of American security was shattered, but it was also the events of this day that led to the violation of the rights of millions of American citizens. After relentless reprehension by the American masses on the approach that was taken after the 9/11 attacks ,the Bush administration enacted the Patriot Act on October 26th, 2001, a mere 56 days after this tragic event.The Patriot Act expanded the authority of U.S. law enforcement agencies so that they could hopefully avert future terrorist attacks. Under the Patriot Act The NSA (National Security Agency) could entrench upon the privacy of the citizens of the U.S. without public knowledge, consent or, probable cause. The particular incident which had the general public up at arms was when the NSA illicit surveillance came to public knowledge.

The Patriot Act does not infringe upon the rights of citizens; it ensures that those who wish to harm this country have limited means to do so. The Patriot Act was passed as a means to allow better protection of citizens given the current state of technology today. The aftermath of the attacks on September 11th demonstrated that this was necessary. The Constitution is not designed to render the nation defenseless against people who have no value for human life, and who will use whatever means necessary to harm others to advance their goals In conclusion the Patriot Act gives the government the tools in which are necessary to keep America and its citizens safe.
Domestic Surveillance Citizens feeling protected in their own nation is a crucial factor for the development and advancement of that nation. The United States’ government has been able to provide this service for a small tax and for the most part it is money well spent. Due to events leading up to the terrifying attacks on September 11, 2001 and following these attacks, the Unites States’ government has begun enacting certain laws and regulations that ensure the safety of its citizens. From the Foreign Intelligence Surveillance Act (FISA) of 1978 to the most recent National Security Agency scandal, the government has attempted and for the most part succeeded in keeping domestic safety under control. Making sure that the balance between obtaining enough intelligence to protect the safety of the nation and the preservation of basic human rights is not extremely skewed, Congress has set forth requisites in FISA which aim to balance the conflicting goals of privacy and security; but the timeline preceding this act has been anything but honorable for the United States government.
After the attacks of Sept. 11 President Bush wanted people to be more safe and had to raise the security around things even if that meant motoring the computer and devise people used. That's when the President, Senate and the House of Representatives decided to pass the Patriot act to help stop terrorist and would use the same technology that would be use in drug, fraud, and organized crime. Many critics forgot to tell the people of the Patriot act and how it is helping them not destroying them making people believe this act is only to spy on the people. On May 5, 2004 the Department of Justice charged 310 defendents and since Sept 11, 2001 179 of those have been convicted and sentence to prison.
