After reading and studying the case, I would recommend changing the current sick/vacation policy. The paid time off policy will provide employees with flexible paid time off from work that can be used for vacation, personal, family issues, doctor visits, and other personal activities. Superior goal should be to reduce unscheduled absences for the entire company. Unscheduled absences can lead to a negative impact on the employer's’ behalf. It is important to implement a policy that is fair and provide a sense of relief for employees as they take off work for various reasons. There are 3 nurses in the ER that are pregnant. From day-to-day, there is a shortage of staff that occurs on the unit. The nurses that are pregnant will be on maternity leave at least 2 months apart. The best thing that management and HR should do is to hire at least 3 per-diem nurses to fill in. Without a policy like FMLA in place, many employees often would have had to choose between “the job they need and the family they love” (Hayes). The Family and Medical Leave Act of 1993 is the first national law created to help Americans balance the demands of the workplace with the needs of the family. It successfully helps bridge the gap between family and work and secures the right for both men and women to get unpaid leave and assistance when dealing with family related circumstances.

The Family and Medical Leave Act of 1993 (FMLA) provides certain employees with up to 12 weeks of unpaid leave and job protection for childbirth, adoption or foster care; to care for a seriously ill child, spouse, or parent; or for an employee’s own serious illness (Cañas & Sondak, 2011). It also requires that their group health benefits remain intact during the unpaid leave of absence. The employee must have worked for the employer for at least a year and must have earned 1,250 hours of service during the previous 12 months ((Cañas & Sondak, 2011, pg. 70).

The FMLA was passed to help families in the time of a crisis so that the individuals would not have to choose between work and personal responsibilities. The eligible employees are permitted to take unpaid, job-protected leave for specified family and medical reasons. The leave can last up to twelve workweeks in any twelve-month period. Reasons for leave include: pregnancy, prenatal complications, adoption/ fostering of a child, hospitalization, care of an immediate family member, or a health condition that makes the employee unable to do his or her job (Solis). ... then this is a culture difference between Mr. Higashi and the employee. However, if Kelly had intended on using the vacation for vacation and sick leave for sick leave then that means there is no vacation time allowed for Kelly to use for this vacation. The compromise would be that Mr. Higashi and Kelly would agree to use one day of sick leave and one day of vacation time off. This strategy would allow both parties to win to some degree and at the same time be able to keep an agreeable relationship between the two parties.

You just got over a serious medical condition yourself which you acquired while on vacation and do not have any vacation time or sick time to take off. Do you have to quit your job? Can your employer terminate you for taking time off to be with your child? What options do you have? What can your employer do for you? Well, the answer lies in the Family and Medical Leave Act.
Other benefits aligned with paid time off is sick leave awarded in 4 hour increments per pay period with no limit on accruals. Employees may use this time to attend medical appointments for themselves and dependents. The sick leave bank is also used for bereavement (up to 5 days) and funeral (up to 3 days) time off when unfortunate deaths occur.

To prevent absenteeism human resource have to researched in how important they human capital to they organization. They should separate the different department needed and how it effect productions when they is high absent from delay work. They will need to provide certification for one or multiple health care providers at the employer’s expense for more clarification of why the employee needs the leave of absence. “An employer may use a health care provider, a human resource professional, a leave administrator, or a management official – but not the employee’s direct supervisor – to authenticate or clarify a medical certification of a serious health condition” (SHRM) If the employer feels that the employee is not able to return to work due to major health conditions they may also require a letter from their health care professional approving their return.
