Consumer rights and consumer law are designed to hold sellers of goods and services accountable when they seek to profit by taking advantage of a consumer’s lack of information or bargaining power (The Law, n.d.). Consumer rights laws exist at both the federal and state level, and they are enforced by government agencies, offices of attorneys general and through individual and class action lawsuits filed by victims, who are the diamond consumers in this case (The Law, n.d). Consumer Protection Act in the State of Texas is called Texas Deceptive Trade Practices Act (DTPA), which is located in Chapter 17 of the Texas Business and Commerce Code (The DTPA, n.d.). The DTPA protects the consumers who purchase a new product in Texas by giving …show more content…
The practice of intentionally selling a low graded diamond for a higher grade, and hence a higher price and profits, would not have good supports from any of the five ethical theories for many good reasons. First, the free market theory, which states that the goal of any business is to bring as much profit to its shareholders as long as the actions do not infringe on anyone’s rights, violates the buyers right to the information that justifies the value and transaction. Second, in any given society, there are more diamond buyers as there are diamond sellers, whose support fails from the utilitarian theory, which states that in any given situation, the actions must produce the greatest goods for the greatest number of people. Third, Kantian deontology theory states that an act must be performed because it is appropriate for everyone, meaning that the seller owes a duty to the buyer in selling a new product for what it is, and not for what the product is not. Fourth, Virtue ethics theory stresses the character trait of good sellers, who are expected to sell goods in an honest and principal way, which are desirable for a given society. Finally, ethics of care analysis has no support for the seller in this case as well because deceitful selling practices harm relationships between a buyer and seller as well as other stakeholders. Violation of the consumer protection law and RICO causes EGL and major retailers to violate all the five ethical theories for obvious
Carr believes that in business, it is expected that while operating within the legal framework that a business will attempt to leverage its position. In our situation, the business owner made it known that the company was not in a good financial position even before the Rolex representative had attempted his pitch. So, the Rolex representative, knowing that the business was not in great financial shape, attempted to enter into an agreement with the company. Therefore, his potential choice to enter the agreement would be entirely ethical. The business owner did not break any laws or attempt to intentionally misguide the representative concerning the position of his

Review of “Situationism and Virtue Ethics on the Content of Our Character” by Rachana Kamtekatar
Critical Response: Given the three possible responses from the book, I feel like #2 is the most ethical of the three. However, I feel like all three aren’t satisfactory ways to treat this situation. I will analyze them one by one, then give my opinion of what the salesperson should do.
Ethics is the study of how people should live. people have different views and beliefs of how they're supposed to live their life. people from all over the world have different ethical beliefs and different ways to determine which beliefs are right and which are wrong. when you visit a different country, you notice things they are doing and those things might seem wrong to you and you would never consider doing what they have just done but in their society its normal and everyone does it. inside the margins of this paper I am going to analyze the top three models used to determine a morally significant being based on the criteria in your book. I will first define a moral agent and a morally significant being then take you through the steps to deciding what a significant being is and which criteria you would use for each.
In this case, the right thing would be to tell the customer to go to a competitor and buy the product for cheaper. Personally, I would never do such a thing. Instead, I would try to gather more information from this customer and make a decision that would keep me on the right side of the law and public sentiment. However, there are no clear rules or policies to guide leaders and determine what is right or wrong (McNamara, n.d). It is not enough to be good, or not lie. Therefore, in order to make my decision more effective, I have proceeded to provide a score on the ethical
Consumers rely on good faith that whatever is being advertised is true. This is why they even go an extra mile to read reviews to ascertain this fact and find out more of what was probably erroneously forgotten. Unethical advertisers know this fact as well and they capitalize on it and manipulate consumers. They know claims are only verified when a person buys and uses the commodity. Thus, by the time the client goes through this process of verifying, the sale person will have made sales for that particular moment. Unfortunately, these kinds of marketers are short sighted and this behavior only works in the short run. Once the consumers find out the truth, they stop using that product and feel exploited. The advertiser and the consumer benefit nothing and this a...
Ethical standards, especially for fields that involve human service provision, are necessary to safeguard the rights and safety of both service providers and consumers. Past injustice and maltreatment have pushed different professions to develop codes of ethics that are unique to their respective fields. The chemical dependency field is no exception, and the National Association for Alcoholism and Drug Abuse Counselors (NAADAC) has produced its own code of ethics. By beginning a therapeutic relationship with clients, many doors are opened; healing and harm are both possible, depending on how the counselor handles whatever arises. As a professional, I have a duty to understand the codes, laws, best practices, and agency policies that govern my work with clients. Here I will detail the different forces that guide my own practice, how I decide if something is ethical or unethical, and produce a brief list of actions I deem unethical for chemical dependency professionals.
In an ideal world, consumers and companies would equally share the burdens of product liability and consumer responsibility. However, in the real world, we must make tradeoffs between these two. How we do this will not only affect our legal environment, but our economic and social environments as well.
...increase. Now a day they done anything to earn more money. For some time they are taking advantage on some people especially for those people that lack of knowledge. Usually this type of people always take an advantage and try to manipulate and use it for a legal use. The action from the legal use may give lot of benefit to them. But for the victim of the product may facing with lost. This is because the amount of money that been spend are not equivalent to the quality or the function of the product. People now days are very smart where they will find the best even thought it was expensive. They thought that why must spend for twice to have a best product. As usual human weakness is they are easily trust to people that just tell the product without checking the record of the product. So bluffing ethical may be happen.
The Australian Consumer Law (ACL) was established to protect consumers in any legal trading activities in Australia. A set of guarantees has also been introduced for those consumers who are acquiring goods and services from Australian suppliers, importers or manufacturers. The guarantees are intended to ensure that consumers will receive the goods or services they have paid for. If they have problems with the products and services they bought, they are entitled for remedies, such as repair, replacement, and refund.

Every day we are confronted with questions of right and wrong. These questions can appear to be very simple (Is it always wrong to lie?), as well as very complicated (Is it ever right to go to war?). Ethics is the study of those questions and suggests various ways we might solve them. Here we will look at three traditional theories that have a long history and that provide a great deal of guidance in struggling with moral problems; we will also see that each theory has its own difficulties. Ethics can offer a great deal of insight into the issues of right and wrong; however, we will also discover that ethics generally won’t provide a simple solution on which everyone can agree (Mosser, 2013).
The word ethics is derived from the Greek word “ethos” which means an ethical person is one who has a character. Ethics is a norm that translates ideals and values into everyday practice. Ethics is not a manual with answers on how to act. It is only a search for the right kind of morality. It is also the standards that define what right conduct is and what is wrong conduct. Ethics is concerned with distinguishing between good and evil in the world, between right and wrong human actions and between virtuous and non-virtuous characteristics of people. Ethics is also a branch of philosophy that involves questions about morality. Thus, ethics is about making choices which signifies how people act in order to make the right choice and predict good
