You are right about the political ties Robert, in fact it was the issue in Communication Workers of America v. Beck. In 1988, Harry Beck took his case to the Supreme Court. He did not agree with the union officials spending his hard earned money towards the promotion of political their agenda, with which he did not agree (The "Beck" Decision, and How it Affects You, n.d.). Can you believe that the union spent 79 percent of his money for purpose that was not normal union duties (The "Beck" Decision, and How it Affects You, n.d.)? Now fast-forward to the Bush and Clinton administrations, workers have regained very little of their freedom due to the fact that both administrations had very little interest in enforcing the law (Cassandra, 1998).
In 1898, congress passed the Erdman Act, which prohibited employers from firing employees based on if they join a union. An employer for the Louisville and Nashville Railroad Company, William Adair, violated the statute by firing O.B. Coppage for his participation in a labor organization. The court, in a 6 to 2 vote, held that the statute not only violated the due process clause of the Fifth Amendment, it also held that congress’s power over interstate commerce does not extend to memberships in unions. The court uses substantive due process to read into the Fifth Amendment the laborers and employers right to ‘liberty of contract,” which Justice Harlan points out by citing the similar ruling in Lochner. The court reads it as the right of individuals to enter into contracts to either purchase or sell labor, which the law violated by limiting the rights of both the employer and employee. The paper will discuss minicases on ‘The White-Collar Union Organizer’ and ‘The Frustrated Labor Historians’ by Arthur A. Sloane and Fred Witney (2010), to understand the issues unions undergo in the marketplace. There is no predetermined statistical number reported of union memberships in this country. However, “the United Bureau of Labor Statistics (BLS) excludes almost 2 million U.S wages and salary employees, over half of whom are employed in the public sector, who are represented at their workplaces by a union but are not union members. Not being required to join a union as a condition of continued employment, these employees have for a variety of reasons chosen not to do so. Nor do the BLS estimates include union members who are currently unemployed” (Sloane & Witney, 2010, p.5). Given this important information, the examination of these minicases will provide answers to the problems unions face in organizational settings.
Labor’s rights, this issue have been bothering many worker since the 19th century and can still be a problem today. As John L. Lewis has said in his speech “I repeat that labor seeks peace and guarantees its own loyalty, but the voice of labor, insistent upon its rights, should not be annoying to the ears of justice or offensive to the conscience of the American people” (John L. Lewis), which under his words meant that labor is something that can be done right and peacefully but it needs rules and benefits that come with those rules which labor asks for and when labor asks for those rules and benefits it shouldn’t be taken like some annoying kid’s demands but more as something that needs to be done and done with a right mind set. Labor today consists of a man or woman going to work, working their hours, and finally getting paid for those hours at the end of the week, at least a minimum of $7.50 an hour (United States Department of Labor), but before it wasn’t like that before many workers would get paid very poorly even thought they would work for a lot of hours and they wouldn’t get benefits from their work or safety when working such as in the mines like the mine workers, but one man stood up for them and his name was John L. Lewis (John Llewellyn Lewis, Encyclopedia).
The thesis of Williams “The Ruling That Changed America” is that the Brown decision changed America for the better, but it wasn’t exactly accepted like it is today. The working class has served as an integral part of our capitalist society; as the building blocks, and producers of the goods that supply and support our country, the working class and working poor have faced many struggles to gain working rights. The histories of labor movements in the United States are often silenced from the mainstream culture; while we take our current union laws for granted, long forgotten are the bloody battles that took place to secure these rights. The ideological issues facing our modern day working class have shown to stem from the same socially constructed ideals that existed during past labor wars, such as the Colorado Coal Strike. The Coal Strike of 1913-1914 culminated in the Ludlow Massacre; this event showed how media coverage played off of cultural stereotypes of the working class and resulted in the raised consciousness among the strikers. The way the strike was presented to the public was shrouded in cultural symbology of poverty, and through these very symbols the strikers formed an identity of solidarity.

A movement away from the endless and scattered interest groups and more towards organized and larger movements aiming for improving the greater social good could bring about political and economic improvement that many Americans desire.
The Industrial Revolution that took place after the Civil War made for a more economically sound country. American workers, however, were becoming more and more dependent upon their wages; a fear of unemployment also stemmed from this. Workers didn’t share in the benefits that their employers reaped. In a chart representing the hours and wages of industrial workers, from 1875 to 1891, it shows that even though their wages were subtly increasing, their 10-hour work day remained the same (Doc. A). Factories were headed by large corporations; this, in turn, meant that new machines lessened the amount of workers in certain fields. As a result of these unsuitable conditions, labor unions were formed. The challenges that these unions faced weren’t easy. If the workers involved in organized labor got too far out of line, these corporations could get federal authorities involved. Moreover, these companies could enforce “ironclad oaths” upon their employees. In a Western Union Telegraph Company employee contract, in 1883, it states that the employee will not be affiliated with any societies or organizations (Doc. E). Despite such setbacks, by 1872 there were over 32 national unions.

Labor unions have been in America for a very long time. There are many unions in a myriad of different fields. Labor unions were and are used to allow for equal treatment of workers. Employers always want to maximize their profits and they try to give the least to get the most in return. For reasons such as this is why unions were formed. Generally a union boss is appointed or hired to protect the rights and privileges of the employees. The union boss is generally very representative of the demographics of the workers. The leader of the employees needs to know what they want and what is fair for them and this is why he tends to represent one type of work force, such as the teachers union. This type of representation is made easier when most of the workers come from the same background. Background meaning family size, education, race, etc. Labor unions have helped shape the American work force, as have the backgrounds of the men and women who have worked in them. America was founded on diversity and the freedom to choose. Many different backgrounds have found their way into America and labor unions. As stated earlier, labor unions have people of the same background in them. America’s first settlers were generally of the same background and because of that, so were the members of the first labor unions. As the United States expanded so did the work force and the diversity in it. Diversity and understanding the challenges and benefits is what enables America to be great. In the pages of this paper we are going to look at the change in the make-up of labor unions by the entrance of African-Americans and how they have influenced America and the labor unions for the better. Workers seek to negotiate with employers for more control over their labor and its fruits. “A labor union can best be defined as an organization that exists for the purpose of representing its members to their employers regarding wages and terms and conditions of employment” (Hunter).
