When the Writs of Assistance were issued by Parliament in 1660, they became a part of the unique English constitution, an unwritten document composed of the Acts of Parliament. In essence, their passage made them fundamentally constitutional. This system inspired the colonial movement for guaranteed rights under a constitution that serves not only to govern the people, but to protect them from their government.
The differing perspectives on the nature of these conceptions was certainly apparent with the implementation of the Writs of Assistance. The framers looked at documents from the English government, such as the Magna Carta and the English Bill of Rights, to sculpt their government. The Magna Carta limited the king’s power and stated that citizens had certain rights. This meant that the king had to recognise the citizen’s rights, and couldn’t imprisoned or arrest citizens unless convicted of a crime, and they had legal rights, and could have a trial by jury. The Magna Carta is significant because it was one of the most important democratic documents in history. It was important because it said that everybody was subject to the law, unlike a dictatorship, oligarchy, or monarchy. It set up a parliamentary democracy in England, and strongly influenced the American Bill of Rights. Likewise, the English Bill of Rights further restricted the powers of the king. The English Bill of Rights gave everybody certain rights; of these where were the right to trial by jury, no unusual, cruel, or unjust punishments, the right to own a gun, and citizens had to be charged with a crime before they could be sent to prison. The English Bill of Rights was influential to the American Constitution, because in the Constitution, the framers included a Bill of Rights outlining the rights of all citizens. The United States of America who wrote the Declaration of Independence. It stated, ”For imposing taxes on [the colonies] without [the colonists] consent…” (Document A). In Article 4 Section 4 Clause 1 of the United States Constitution mentions the use of a republican form of government in which people elect a representative that composes government. they elected representatives to make their decisions for them. The Administration of Justice Acts were composed of certain powers that were allowed to the government.
The colonists were in every right, aspect and mind, not only justified but also it was about time that they stood of and actually take action against the British. The choice of going to war with them, was the only choice that they had. All diplimatical options that they had ceased to stand a chance against the tyrant Britain. From the very beginning when the colonists felt upset against their mother country and the way that they went about the law making, up until the beginning of the war, they tried all diplimatical options that they had, by sending letters, you name it. When they didn’t work then they had no other means but to declare war.
One such thing that American colonists united themselves upon was the misrepresentation across the Atlantic. British Parliament consisted of many members from many areas, but not one of those members was able to convey the message from the colonies because there were no such representatives. Many members of Parliament, such as Edmund Burke, led the rest of Britain and Parliament to believe that the colonists were simply tenants in their land and were to abide by the laws of the British constitution. [Doc B] This mere thought unified the colonists and presented a situation that they could not take their eyes off of.
Edmund Burke delivered his speech on conciliation with the Colonies to Parliament on March 22, 1775. The purpose of the speech was to persuade the British Parliament to consider their relationship with the American Colonists in regards to them being forced to pay taxes and whether or not their relationship would evolve. The evolvement would see the Colonists as more of an equal nation instead of the “loyal” British subjects that they were. This speech came almost 10 years after Parliament passed the Stamp Act (Mamet, 2015). This meant that the Colonists had been living with the oppression of the Crown as well as being taxed without proper representation or consent.
The British rule that was established in the colonies was oppressive and unfair. The British rule was immoral because Parliament contained a totality of British politicians who only cared about Britain’s wants and needs. The Colonists, “wanted the right to vote about their own taxes, like the people living in Britain. But no colonists were permitted to serve in the British Parliament.” (Ember) This unfairness led to many unwanted laws such as the Intolerable Acts and the Stamp Act. These laws did not benefit the colonists in any way, but the acts significantly helped the British. Laws and acts were forced
The Magna Carta was the first document in which English subjects to force English king into power; granting and protecting the subjects’ rights. This was important since the king at the time could do anything that he so desired. However, in practice, this English legal charter did not limit the king’s power. The Magna Carta is the beginnings of American freedom. It is also the foundation of the American Constitution, reflecting English freedom and the power of the English government.
These Parliamentary Acts eventually lead to the American Revolution because the colonists were sick of being treated unfairly and they were fed up with being deprived of their rights. The Continental Congress wrote The Declaration of Independent, which was a document that declared the colonists independence from Britain. The colonists resented the Parliament for taxing them internally and directly. The passing of the acts all started out as money issues, but eventually became an issue of having an imperial government.2 If the legislation never happened to the colonists, there may not be a United States today.
The American colonists’ disagreements with British policymakers lead to the colonist’s belief that the policies imposed on them violated of their constitutional rights and their colonial charters. These policies that were imposed on the colonist came with outcome like established new boundaries, new internal and external taxes, unnecessary and cruel punishment, and taxation without representation. British policymakers enforcing Acts of Parliament, or policies, that ultimately lead in the colonist civil unrest, outbreak of hostilities, and the colonist prepared to declare their independence.
As more immigrants immigrated to the colonies and established lives in colonial America, the colonist began to incorporate their ideas of freedoms, rights and tolerance in legal documents. As you will see in this paper, I will point out many ways that these documents are still in effect today. In the end, you will understand how the United States of America came about. There are many things that I can compare to the Declaration of Independence and Common Sense pamphlet. Paine states “That government's sole purpose is to protect life, liberty and property, and that a government should be judged solely on the basis of the extent to which it accomplishes this goal.”
Overall, the imperial policy of the British Empire urged the colonists into a state of total rebellion. The colonial economy, geography, and politics had all been subjected to unfair consequences. The acts that were passed served as a way for England to push the responsibility its debt and issues on the colonists. If the colonists’ grievances were appealed to, the colonists may have never rebelled against their mother country.

The document I chose to write about is the United States Constitution. When the thirteen British colonies in North America declared their independence in 1776, they laid down that “governments are instituted among Men, deriving their just powers from the consent of the governed.” The “colonies” had to establish a government, which would be the framework for the United States. The purpose of a written constitution is to define and therefore more specifically limit government powers. After the Articles of Confederation failed to work in the 13 colonies, the U.S. Constitution was created in 1787.
It was Paine’s hope that in writing the pamphlet known as “The Crisis”, with all its rhetoric that it would persuade the colonists and those who still considered themselves loyal to their King and country, to seek their independence from England by whatever the means or cost.
