Teen Curfew Essay

The government should not be able to mandate teen curfews. Parents should be able to decide their own child’s curfew. The curfew laws also violate the first and fourth amendment. Another reason is because some police officers use the curfew laws to discriminate against certain races. These police officers also use it as an excuse ignore real crimes happening and to hassle kids who may not even be doing anything wrong. Ultimately the government is trying to take away parents’ rights to control their children and use it to their advantage.

Parents have a right to set their own children’s curfew. The curfew law states that anyone younger than 17 is supposed to be off the streets and at home past 10:30 (Irvine). The fourth amendment protects us from unreasonable search and seizure (Irvine). It is illegal to break the laws stated in the constitution so this is just proving how wrong and far these curfews are going. The cops ask for their ideas which in the many cases where they are doing nothing wrong this is counted as unreasonable search and seizure. The first amendment is all about freedom. These curfews are forbidding teens from having their freedom because they are not letting them even go to the pubic establishments. Curfews rules are often used by police to stop and interrogate juveniles (Berg). This is showing us that most of the time the police have no reason to search or interrogate them which is making it unreasonable search and seizure. The youths will be brought in by police (Wenger and King). This is showing how much freedom teens will have, even if they just run to the store past 10 p.m. they will be brought in.
