Some Days, when getting ready for school, do you just want to wear a comfy band shirt? Well a student at a school wore their favorite band T-shirt. The school has a policy where students aren’t allowed to wear band T-shirts , because it is a distraction in class and also, in the hallways which can cause a to break out. In my opinion with the evidence the student’s shirt was not causing a disruption in class and the shirt did not cause a fight. During one of the class periods two students came in the room arguing about a band. What if you were suspended from school because of something you were wearing? Not only was the clothing or item appropriate, it was something you were fighting for or something you believe is right. Is this fair or okay for this to happen? There is a specific incident that this situation happened to a few teenagers in Des Moines, Iowa in December of 1965. The decision that I would make if I was in the supreme court would be very difficult because it can go both ways I think it was immoral because he was not on campus or in class distracting the education of other students so he should have not got suspended because in my opinion he was not on school property. I would understand if he was holding the sign up while in class or yelling it through the halls. Censorship even extends to school dress codes. A school dress code is a set of rules about what clothing may or may not be worn in schools. As previously mentioned, a set of criteria are used to determine whether or not student expression should be censored in schools. For censorship involving dress codes, there are two: the “Tinker disruption standard” and the “forum issue,” which determine if student expression disrupts the school day and by who it is regulated, respectively (Emert). One case involving censorship of the school dress code was of a boy who violated his school’s dress code (Nguyen). Zachary Guiles, a thirteen year old boy, had to cover up his shirt denigrating former President George W. Bush, which violated his First Amendment rights (Nguyen). The shirt showed President Bush’s head on a chicken with derogatory names. It had images of oil rigs and lines of cocaine (Nguyen). A student, who had opposite views as Guiles, notified the administration of the shirt (Nguyen). Guiles was sent home on May 13, 2004, when he didn’t cover up the shirt after being asked to. The next day, Guiles’ wore the shirt, which was covered with tape and the word ‘censored’ was written on the tape (Nguyen). The school which Guiles attended, Williamstown Middle High School in Vermont, said that the shirt violated the dress code. Guiles’ parents felt that their son’s “rights to engage in political speech” were violated, and they sued the school (Nguyen). Guiles did not win the lawsuit in December 2004, when the US District Court for Vermont ruled in favor of the school, saying the images were “’plainly offensive and inappropriate’” (Nguyen). First of all, if students want to attend class in the clothes that make them feel comfortable, then they should be able to do so. In a bigger picture, students don’t come to school for a fashion show they come to school for an education. Somewhere along the line some students and parents have forgotten that simple fact. In some districts, like Wilson County Schools, the dress code violations got so out of hand that administration had to threaten suspensions, “During the first six days of the policy change 184 high school students were suspended.” (Creech, 1). The Lima Senior High School campus made the same decision as the Wilson County Schools. On Tuesday January 27, 2009, the Lima City Schools suspended about 164 students for dress code violations. They both knew that their students were having problems following the rules, and since the punishments that were set didn’t affect the students they did the one thing that got the students attention.

We as students have many rights at school, a lot of these rights protect us from school rules and punishments. One of these rights is the first amendment right, which is freedom of speech. Freedom of speech includes the right not to speak or respond, maybe to a teacher or administrator, it also gives you the right to use offensive words and phrases if conveying a political message. This amendment also overlaps into dress code giving us the right to express ourselves, especially about a political opinion.
But, school is not the place to show student’s interests and likes, school is strictly for learning. If a student wants to wear a shirt that shows his/her’s religion, political view, or profanity, he or she can wear the clothing outside of school. Also a benefit to dress code in schools allows students to “expressive their individuality through their personality and academic achievements, not through clothing” (School Uniform). Jill Hamilton writes a book on the pros and cons of a dress code policy. She correctly states how school should be a business related environment. She states “Students should feel comfortable enough with themselves to portray their personality through themselves, not through their clothing. Their clothing should represent business attire, as they might have in the real world someday” (Hamilton, page 72). Let’s set the scenario and imagine you are a middle school student. Here it is at the start of yet another school week, the bus pulls up to allow the students off the bus. The first student to exit the bus is an 8th grade girl wearing skin tight skinny jeans, flip flops, and a red tank top. As she steps off the bus several of her fellow male students are watching her as if she is a supermodel, one in particular watches whom is wearing baggy jeans and an oversized shirt. The girl ignores the boys as she walks towards the bathroom to do a last minute makeup check before the first bell. Sparking up a conversation with one of her friends neither girl realizes that the bell has already rung, so the girls quickly exit the restroom towards the hall. One girl runs to the left as the other runs to the right, she is almost to the room when she turns the next corner and there he stands right in her way. “Move out of the way! she insists, but he grabs her arm with one hand and grabs her backside with the other hand stating, “You look good in those jeans”! This behavior could be illuminated with the implementation of a school uniform policy. Misconduct such as this happens far too often in schools across the United States. Many girls dress inappropriately to get attention or just to feel good about themselves (Cribb & Hasse 107). I believe all people have the right to express themselves. However, with rights come responsibility, a concept most people ignore. Having a "right" is to be free to express one's self. Consequentially, having a "responsibility" is doing it constructively, in such a way as to not violate policies, laws, and others' rights. There is a definite difference between a dress code and a school uniform. I support enforcing a school dress code, but is implementing a school uniform necessary? No matter how students dress, they will still pass judgments on their peers, uniforms do not necessarily save money, and children are forced to conform to the same standards. While in school, teachers have a responsibility to teach and students have the responsibility to learn. Both have the right to exist in their environment without harassment and the right to express their individuality. Some people have found some expressions crude, obnoxious, and distracting. To combat the problem, the idea of mandating school uniforms was introduced. This notion of making everyone appear "uniformed" in order to cut down on violence and negativity in school, is absolutely mislaid.
A student’s right to express themselves, as long as it’s not harming someone, should never be denied. Not every student can easily write a poem or paint a portrait about how they feel, but all students can use clothes to show who they are and how they feel. When a student is told that they have to change, it’s almost like saying they have to change who they are too. Clothes are the most important part of a first impression. They allow a student to pride, not only in what they are wearing, but for their school, or their sports team, or the play they got cast in.
