The one type of driver that irritates me more than all others are the drivers in the fast lane that refuse to yield to faster moving traffic and allowing them to pass without impeding their progress. This driver can typically be recognized by their slow rate of speed and a general unwillingness to yield when presented with the opportunity. This driver typically enters the highway and without fail moves all the way to far left lane without regard for the current rate of speed in the lane, or the fact that the far left lane is designed as a passing lane in Arizona. These drivers create a safety hazard for those around them and sometimes to the point of road rage, they start traffic jams, and most importantly, they are breaking the law.
Driving in congested traffic is stressful for the best of drivers, and the slow unyielding driver make a bad situation more hazardous through their actions. In response to a slow driver in the fast lane, a faster car coming from behind is forced to brake which creates a wave or a slowing in response to the misuse of the "passing lane" by the slower driver. This belief is in err based on State laws as discussed above. The prima facie case of yielding is simple in that you must yield to faster traffic, and not the case of, you must yield to faster traffic unless they are exceeding the limit. These drivers would do well to remember that the left lane is the passing lane and not the fast lane. Also, the police are the only persons authorized to interpret what is a reasonable and prudent speed limit for the prevailing conditions and not individual drivers. It is not the slower driver’s job to control the rate of speed for others (Dykstra). We have traffic control devices and the police to monitor and enforce the speed
