Prisoners With Special Needs Among the federal and state prison systems are groups of individuals who exhibit unique problems that distinguish them from other offenders. These groups are known as special populations and consist of issues related to substance abuse, mental illness and special needs. To accommodate and address matters related to these groups, it is important for prison staff to understand how these populations affect prison systems on a state and federal level. It is also important for prison staff to understand the gravity of what could occur if special populations are not cared for properly.

The 2011-2012 Bureau of Statistics reported that approximately 40% of state and federal offenders reported having a chronic medical condition such as diabetes, cirrhosis of the liver, cancer, and hypertension (Maruschak, Berzofsky, & Unangst, 2016). They also reported inmates as having chronic and contagious infectious diseases such as tuberculosis, hepatitis B and C, Human Immunodeficiency Virus (HIV), as well as other sexually transmitted diseases (Maruschak, et al., 2016). These health conditions affect the state and federal prison systems because, like mentally ill inmates, offenders who suffer from physical ailments also require prescription medications and other types of treatment. However, the growth in the prison population coupled with budget cuts makes it challenging for prison staff to meet treatment demands. Consequently, the harsh demands of correctional staff only add to their stressful work duties. Also, limited health resources leave prisons vulnerable to lawsuits from offenders who allege that their eighth amendment rights prohibiting cruel and unusual punishment are being violated (Siegel, Schmalleger, & Worrall, 2011). In the case of Sandin v. Conner, DeMont Conner, an inmate at a maximum security correctional facility in Hawaii, was subjected to a strip search in 1987. During the search he directed angry and foul language at the officer. Conner was charged with high misconduct and sentenced to 30 days of segregation by the adjustment committee. Conner was not allowed to present witnesses in his defense. Conner completed the 30-day segregation sentence, after which he requested a review of his case. Upon review, prison administration found no evidence to support the misconduct claim. The State District Court backed the decision, but the Ninth Circuit Court of Appeals found that Sandin had a liberty interest in remaining free from disciplinary segregation. This case is significant because it confronts the question of which constitutional rights individuals retain when they are incarcerated. In Sandin v. Conner, the Supreme Court ultimately ruled that prisoners have a right to due process only when “atypical and significant deprivation” has occurred. Prisons must now be vigilant in protecting the rights of inmates. It is a delicate matter in the sense that, when an individual enters prison, their rights to liberty are by and large being forfeited. The rights in question are important to prisoners because prisons are closed environments where by nature their freedoms are already very limited. They need a well-defined set of rights so that prisons do not unduly infringe on their liberty. Without court intervention, prison administrators would likely not have allowed this particular right, as it adds another layer of bureaucracy that can be seen as interfering with the efficiency of their job. Also, it could lead to a glut of prisoners claiming violations of their rights under the court ruling.
Unfortunately, this rush to develop and implement preventive measures has resulted in a degree of polarization which has hindered progress towards implementation of effective prevention measures. Prisons and jails offer uniquely important opportunities for improving disease control in the community by providing health care to disease prevention program to a large and concentrated population of individuals at high risk for disease. Inmates often have little interaction with the health care system before and after being incarcerated. The AIDS rate in US prisons was five times the rate of general population. (Society. 2003)

According to the United States Federal Bureau of Prisons (2013), there are currently 217,862 people incarcerated. Of that total population, 93.3% are men with the remaining 6.7% being women. The current prison populations range from 39-51% over their allotted capacities (James, 2013). Results of overcrowded prisons are seen through increased taxes, lowered staff to inmate ratio and an inability to maintain the structures housing these inmates (James, 2013). Researchers have also determined a correlation between inmate misconduct and overcrowding, adding to the list of negative effects (James, 2013). Thousands of people statewide are in prisons, all for different reasons. However, the amount of mental illness within prisons seems to go unaddressed and ignored throughout the country. This is a serious problem, and the therapy/rehabilitation that prison systems have do not always help those who are mentally ill. Prison involvement itself can contribute to increased suicide (Hills, Holly). One ‘therapy’ that has increased throughout the years has been the use of solitary confinement, which has many negative effects on the inmates. When an inmate has a current mental illness, prior to entering into the prison, and it goes undiagnosed and untreated, the illness can just be worsened and aggravated.
Prison Guards, also acknowledged as correctional officers, are employees of the government and are responsible for the monitoring the inmates of a jail or prison. People see jails and prisons reenacted on the television, but the way they portray the facilities does not compare to how they are in real life. In television shows, it seems as if the building runs itself. The inmates stay inside the walls, and do whatever they feel like doing. This, however, is not how jails/prisons work. Having correctional officers is crucial for the upkeep of prisons and jails. One of a correctional officer’s main jobs is to validate that all of the inmates are safe and accounted for, and that the prison facilities are hygienic and under control.
Solitary confinement is a penal tactic used on inmates who pose a threat to themselves or other inmates. Solitary confinement is type of segregated prison in which prisoners are held in their cell for 22-24 hours every day. If they are allowed to leave their cell, they will silently walk shackled and in between two guards. They can only leave for showers or exercise. Their exercise and shower are always done alone and inside. They can exercise in fenced in yards surrounded by concrete. Solitary confinement is either used as a punishment for prison behaviors, a protection method for targeted inmates, or a place to keep prisoners who are a threat to the general prison population. Many prisoners are put in Administrative Segregation for their protection. Many prisoners in this type of segregation are teenagers, homosexuals, and mentally ill prisoners. Many mentally ill prisoners are sent to solitary confinement because there are not rehabilitation services available, and prison officials have run out of options (Shalev, 2008, p [1-2]). Solitary confinement is a convenient method for prison systems, but the detrimental effects on inmates make it an unsuitable option for inmate control.

Many of the inmates infected with HIV are at risk for hepatitis C due to injection of substances. These prisoners are nine to ten times more likely than non-incarcerated people to get hepatitis C virus (HCV). Many prisoners that are infected with both HIV and HCV are more likely to also have other diseases than people infected solely with HIV. Early syphilis was found to be about 1000 times more prevalent in incarcerated women than women in the general public. Women’s predominance in prostitution also increases their risk for infectious disease transmission. This is due to the fact that many prostitutes are involved in prostitution to support an addiction. In the 1970s and 1980s, a massive amount of inmates began fillin up the United States prison systems. This huge rate of growth in this short amount of time, has greatly contributed to the prison overcrowding that the United States faces today. In fact, the prisons are still filled to the seams. This enormous flood of inmates has made it practically impossible for prison officials to keep up with their facilities and supervise their inmates. One of the main reasons why many prisons have become overcrowded is because of states’ harsh criminal laws and parole practices (Cohen). “One in every 100 American adults is behind bars, the highest incarceration rate in the world” (Cohen). The amount of inmates in corrections systems, throughout the nation, sky-rocketed to 708 percent between 1972 and 2008. Today, there are about 145,000 inmates occupying areas only designed for 80,000 (Posner). Peter Mosko, “an assistant professor of Law, Police Science and Criminal Justice at New York’s John Jay College of Criminal Justice” (Frazier) stated, “America, with 2.3 million people behind bars, has more prisoners than soldiers” (Frazier). There have been studies that have shown “there are more men and women in prison than ever before. The number of inmates grew by an average of 1,600 a week. The U. S. has the highest rate of crime in the world” (Clark). Because of this influx in inmates, many prisoners’ rights groups have filed lawsuits charging that “overcrowded prisons violate the Constitution’s 8th Amendment ban on cruel and unusual punishment” (Clark). Living in a prison for a long time becomes difficult for all inmates especially those who are mentally ill face stress when their environment suddenly becomes bars, harsh lights, and super maximum strict schedules. The inmates are forced to face the strict policies and conditions of custody in order to survive in the prison. Why should we care about education in prison? In today’s world people become more egocentric, so that no one’s longer care or even attempt to think about others problems and how to fix them. As a society, we have to begin to focus on the bigger picture, why so many people get behind bars in United States. All human beings should have an opportunity of better life even after committing mistakes before. Education is the key to success. By providing prisoners with opportunity to get education, our society will benefit everyone. Prison education should be provided to inmates for three significant reasons: reduces crime recidivism, gives job perspectives and helps prisoners to rehabilitate and commit themselves to a law-abiding life outside the prison.
