Facts: Brown v. Board of Education of Topeka was originally based on a class action lawsuit against the Board of Education of Topeka, Kansas regarding thirteen parents in lieu of their twenty children, collectively. The lawsuit was an attempt to overturn the Plessy v. Ferguson ruling that declared public schools could be segregated if “separate but equal.” However, decades after the Plessy v. Ferguson decision took effect, Brown, among others in the class action lawsuit argued that the schools are not equal because of the lack of availability of the schools and disparity of overall quality of education between the black and white schools in terms of safety, cleanliness, and access to academic resources (such as teachers).
