Rape is variable in its types and definitions. It is defined by Merriam-Webster as the action of forcing someone to have sex with a person by the threat or use of violence. According to Lois Pineau, rape is best defined as nonconsensual sex that involves the male penetration of a woman that is not his marital partner (Pineau 452). There are also several types of rape that include: date rape, gang rape, statutory rape, prison rape, etc. However, Pineau’s focus is on date rape and its problems about if it really occurred or not. Date rape, according to Pineau, is “nonaggravated sexual assault” or nonconsensual sex that does not include physical injury or its threats (Pineau 452). Pineau addresses several issues within her essay. She describes the problems that arise when attempting to classify whether or not date rape has actually occurred. She also argues that communicative sexuality is a successful tool in defining date rape. Ideally, she is stating that women, implicitly of course, want to be raped and that they lead men onto the idea.
There are several problems that Pineau addresses about how to determine if date rape occurred. Her first argument is against the legal system. She states that courts, back then, were less likely to believe a woman’s claim of rape because it was hard to tell on the man’s part whether or not the woman was consenting to sex or not. In other words, conviction of men could only occur if he knew the woman was not consenting, but he had the intention (Pineau 453). Here are a few things to consider after analyzing Pineau’s essay. One major selling point is that nobody enjoys rape. Another factor is that sex, most of the time, is enjoyable when it is mutual between both parties. There are some solutions to consider also. The first is to teach men to have better self-control when it comes to sexual desires. Another solution is to teach women how to be proactive in their decision making. Sexual acts should be non-contractual and communicative sexuality should be a norm.
The following morning is a dreadful, long one that stays with you forever. The memories in your mind keep crawling up every night when you fall asleep. You keep asking yourself, “Why did it happen to me? What did I do wrong?” Yet no answer comes to mind, all that you can think of is being violated, being misled for a simple task-rape. Why does it happen to us? What do the men see when the door is opened and a gorgeous women stands in front of their eyes. The mind collapses trying to find a solution to the problem. It's like having an exam and the only way for you to score is to cheat. So all girls are just scores guys try to push themselves upon? The mind grows blank and the human body works with sexual instinct. Date rape is one of those things that one man can't find a proper answer for. There are so many possibilities that one might think of as the cause of the problem. Which one is the right one? Is there one specific answer that is physiologically correct? No. Everyone has his or her own opinion, whether it is from experience or from common knowledge. Date rape is mainly cased by the in-proper behavior of the rapist. By looking at myths, such as “women ask for it,” and “it would do some women good to get raped,” from a historical perspective, lead us for better understanding how they evolved. Women are still seen as the property of men, are protected as such. Men and women are still taught to occupy very different roles in today’s world. Men are usually more aggressive, and women are seen as passive. (Vogelman) This socialization process is changing, but slowly.
What is date rape? Is date rape different from rape? In a traditional date, a man and a woman meet for dinner and hope that it goes well so they can continue to see each other. In some cases, things go terribly wrong causing law enforcement to get involved. According to Paglia, all women have want men want. Thus, we must be extremely careful when meeting someone for the first time, as we do not know if we can yet trust. We cannot trust that they will not place a drug in our drink when we go to the restroom. Some may argue that men should be taught to never to that to a woman. But shouldn’t a woman be taught to not leave a drink unattended during a date or during a party?
One of the most common misconceptions about rape is that is it committed by strangers most of the time. However, this is not the case. Date rape is an epidemic affecting tens of thousands of people across the world at staggering rates. The rape stereotype in our culture today is a jumping out of the shadows type of rape. Most people think that when someone is raped either their house is broken into and they are attacked, they are kidnapped, or something along those lines. Actually, 84% of women know their attacker (Hammond). This can become problematic for our society because victims are looking out for an attack that most likely will not take place, while ignoring assaults that are far more likely.
Thesis: It is crucial to expose the “poisonous” consequences that are a direct result of a lenient society that allows rape culture to prevail.
This essay will examine Susan Estrich’s and Lois Pineau’s discussion on rape. Both contribute insights on our society’s negligence when it comes to the protection and justice for women. Estrich provides a peak into the legal system on how it determines rape. We will see that the law is shaped in a way that continues to oppress women and leave them unprotected. Pineau furthers the conversation on placing responsibility on the victim to prove the crime. She narrows her focus on date rape and raises an objection to the model of consent that shapes our culture’s attitude and our country’s law. Pineau proposes a communicative model of sex. From this proposal, I will conclude my essay with an objection of her model and will ultimately defend her model against such an objection.
It was once acceptable for men to have full control over women, declaring when they will marry and when they will have children. However, over the past centuries, women have established a place in society, proving themselves much more than someone's property. This is why the word “rape” today is not taken lightly. According to findlaw.com, “Rape generally refers to non-consensual sexual intercourse that is committed by physical force, threat of injury, or other duress.” When one does not give consent to sex, it is considered a felony, possibly putting the rapist in jail. Contrary to sexual assault, “Sex is reified as penile-vaginal intercourse while an extremely diverse group of pleasurable and sexually stimulating activities are dismissively relegated to the category of foreplay...” (Reinholtz, Muehlenhard, Phelps, & Satterfield, 1995.) Although consented sexual intercourse is much more out in the open and accepted in society, the problem of rape is still very relevant behind the scenes.
Susan Griffin’s Rape: The All-American Crime touches on many issues within American society. She begins by recounting how she was taught to be afraid of strange men from such a young age that she had not yet learned what it was she was so afraid of, and then goes into her experience with harassment, an experience shared by every woman at some point in her life. Griffin recounts the belief that all rapists are insane and the proof that they are just normal men and dispels the myth that rape is normal activity that is prohibited by society. However, she goes on to clarify that our culture views rape: “as an illegal, but still understandable, form of behavior” (Griffin 514). It is not a topic that is brought up often, especially at schools or at gatherings, yet it is crucial that everyone be educated, or at least informed on a topic that affects women every day. “Given that sexual violence continues to occur at high rates in the United States, it is vital that we understand attitudes and cultural norms that serve to minimize or foster tolerance of sexual violence” (Aosved, 481).
