The basic ethical principle of respect for person which is laid out in the Belmont Report was not followed in the case of Henrietta Lacks. At no time was Henrietta given the opportunity of providing informed consent. She was never informed of the procedure, testing, or research thereby making it impossible to evaluate her comprehension of the information or if she would be willing to volunteer her participation. However, the Belmont Report was not enacted until many years after the case of Henrietta Lacks.

While harvesting Henrietta Lack’s cell without her informed consent was unethical and most would say immoral as well it does not appear any of her rights under international covenants such as the ICECSR or ICCPR were violated. This is because
