The United States Constitution is a very important document as it keeps America's government stable and the rules firm, but it did not just come from nowhere. It was written at the Constitutional Convention in 1787. There were historical events that led up to and helped the document be written. In the past, colonists have been treated unfairly by the British, the failure of the Articles of Confederation, and the British influences have heavily influenced writers of the Constitution. Overall, the failures of the Articles of Confederation, colonial experiences, and British influences all influenced the writers of the Constitution. One reason why the failures of the articles of confederation influenced the writers of is because the articles of confederation did not give the national government nearly enough power. Congress had very little power compared to what congress has today. It was unable to collect taxes, have a militia, or enforce its own laws. This problem represents checks and balances but in a negative way. There were no checks and balances in the government so it quickly became unstable and corrupt. Also, state governments had a lot more power than the federal government which resulted in the federal government not being able to action on things they needed to. Montesquieu said, “To prevent this abuse, it is necessary, from the very nature of things, that power should be a check to power…. When the legislative and executive powers are united in the same person, or in the same body of magistrates, there can be no liberty. . .” In the Constitution, it mentions that there shall be equal power among the three branches. This applies to checks and balances because they make sure all the branches balance out each other. The third and final reason why the failures of the Articles of Confederation influenced the writers of the constitution is because the articles were written to prevent something yet they caused exactly that. One way the British government influenced the writers of the constitution was by forming the Magna Carta. The Magna Carta is when British Barons demanded their rights be recognized. This meant that the power balanced out more between the king and others. This was the first time something like this had happened. This worked well for the British government. Nowadays, our government also has checks and balances to make sure one branch does not have too much power. The Magna Carta relates to checks and balances as it forced the king to balance out its power with the Parliament. Another reason why the British influenced the writers of our Constitution is because of the English Bill of Rights. The Antifederalist papers stated that Britain's government should be an example to ours, “ [Britain’s] magna charta and bill of rights have long been the boast, as well as the security of that nation….this principle is a fundamental one… [and] such declarations should make a part of [the United States’ frame] of government.” The Founding Fathers found the British's form of government and copied it in making our government. One final way the British had influence was because of the petition of rights. The Petition of Rights was a document against what the king was doing to the colonists.
