CONTRACTS WHAT IS A CONTRACT? A contract is a legally binding agreement between two parties. For Kappa’s purposes, contracts often come up when a chapter officer is attempting to obtain the services of a vendor (e.g., DJs, venues, caterers, etc.). Examples of things that are not called “contracts” but still have the same legally binding effect are: invoice, terms and conditions, agreement, lease, etc. Kappa requires contracts between the chapter and a vendor whenever possible for a few reasons: • To protect the chapter’s legal interests. • To make sure the agreement is fair. • To make sure the services provided are in line with Kappa policies. Any questions regarding a potential co-sponsor’s eligibility should be directed to the Risk Management Specialist. • All co-sponsors must understand and be willing to follow state, local and federal laws, and the Kappa Kappa Gamma Fraternity Policies and Risk Management Procedures. • All co-sponsors must co-sign the Event Planning Form and the Kappa Kappa Gamma Facility, Bartender, Transportation and Security Agreements, if applicable. • In a sense of mutual cooperation, it is expected that for co-sponsored events, each group will respect and follow the guidelines or policies of all groups, including the strictest. If additional cost is involved, a mutual sharing of expenses is requested. A chapter and co-sponsor can split the cost of the hired transportation. • Chapters may co-sponsor events in men’s facilities such as dorms, lodges, or houses if the event will be dry. An email from the fraternity’s president needs to be submitted to the Risk Management Adviser with the hours that the house will be dry. o A request for an exception to co-sponsor an event with alcohol at a fraternity facility shall be directed to the Risk Management Director and will be proposed to Fraternity Council for a …show more content…

All new members, active members, guests and co-sponsors must use the hired transportation to and from the chapter event. This could include the use of public transportation, taxis, etc. Alcohol, drugs and other controlled substances are prohibited from being used or transported by members or their guests while traveling to and from chapter events. PARENT EVENTS: • If a parent event is held away from the chapter facility, active and new members must use the approved, hired transportation or be transported to and from the event by their own parent or guardian. • Members failing to use the hired transportation or riding with another member’s parent will be subject to disciplinary action. RESPONSIBLE DRIVERS: • Allowed for chapter-only events that are 20 miles (32.19 kilometers) or less from campus. O Exceptions to the distance may be granted by the Risk Management Director upon request. • Responsible Drivers cannot be used for any social event or other event involving alcohol. • Only active members can serve as Responsible
