Casey Martin has won many awards, championships, and tournaments as a golfer, but he has never let his disease destroy is talent. Casey Martin was born with Klippel-Trenaunay-Weber Syndrome, which is a degenerative circulatory disorder. When Martin walks, there is an obstruction between the flow of blood from his leg to his heart. When Martin turned pro and entered a tournament called Q-school, he paid his $3000 entrance fee and submitted two letters of reference; he also filed an action to use a cart during the final stage of the tournament. However, since 1997 golf carts have not been allowed in the third stage of the golf tournament. The purpose of this rule was to create fatigue into the golfers shot-making. In 1994, Kuketz joined the Brockton Athletic Club, which also sponsored a racquetball league. In January, when joining the club, Kuketz paid the league fee and then asked to be placed on the most competitive team, the men’s “A” league. According to official racquetball rules, the point of the game is the win each rally by returning the ball before it touches the ground twice. Kuketz asked to be in the competitive league and allow himself two bounces before returning the ball. Later in February, Roslyn Petronelli told Kuketz that he would not be allowed to play in the men’s “A” league because of safety concerns. Instead he was given the option to play in a lower-level league or he could play in a wheelchair league. Kuketz declined the offers and then proceeded to argue that this was discrimination due to his physical disability. Kuketz filed a complaint against the club saying that it violated Title III of the Americans with Disabilities Act by refusing to let him play on the men’s “A” league.
