This case, which Cynthia Holderfield filed on behalf of her sister and legal ward, Elise Ann Wasson, a disabled adult, alleges that as a result of the insured’s neglect, Elise sustained significant and permanent injuries following a fall on January 17, 2016, while she was a resident at one of our insured’s Community Integrated Living Arrangement homes. The plaintiff further alleges that the insured neglected Elise when its staff failed to obtain prompt medical attention for her injuries and properly report the fall. II. DETAILED CASE SUMMARY A. Summary of Facts The insured, Support Systems and Services, was established in 1993 and began with a few CILA’s. It now serves over sixty individuals and currently provides services in St. Clair, Madison, Clinton and Randolph Counties. Support Systems is licensed by the Illinois Department of Human Services and two of its owners, Polly Hartman and Beth Sahuri, serve as its Executive Director and Director of Nursing, respectively. Assisted Living Facilities abuse is a frequently occurring problem in our society (Hamilton). There are diverse categories of abuse that transpire in Assisted Living Facilities which are physical abuse, sexual abuse, emotional abuse, neglect, abandonment, and financial abuse. Samples of physical abuse would be hitting or beating the elders with an object or their hand, force feeding them or pulling their hands. Sexual abuse is the Assisted Living Facility employees having sexual acts with non-consenting patients. Emotional abuse is the employees saying things verbally to torment the patient. Neglect would be the employee does not take care of the patients such as providing hygiene. Abandonment occurs when leaving patients to fend for themselves. Financial abuse is when the patient’s family pays for the services that were not taken care of. “Elder abuse is fast becoming one of the uppermost law enforcement tasks of the next century, “said Paul Hodge who investigates crime against the elderly (Gonzalez). Since abuse occurs throughout assisted living facilities, state and federal governments should establish a type of punishment such as sending for employees to prison, ways to prevent abusing elderly’s is by inspecting employees ' criminal records, qualified staff, reporting injuries, having surveillance of the areas that do not affect patients privacy, promoting continuous family visits, and shortage of staffing.

Membership Services (MSD) at Kaiser Permanente used to be a modest department of sixty staff. However, over the past few years the department has doubled in size, creating minor departmental reorganization. In addition the increase of departmental staffing, several challenges became apparent. The changes included primary job function, as well as the introduction of new network system software which slowed down the processes of other departments. These departments included Claims (who pay the bills for service providers outside of the Kaiser Permanente network), and Patient Business Services (who send invoices to members for services received within Kaiser Permanente). Due to the unforeseen challenges created by the system upgrade, it was decided that MSD would process the calls for both of the affected departments. Unfortunately, this created a catastrophic event of MSD receiving numerous phone calls from upset members—who had received bills a year after the service had been provided. The average Monday call volume had risen from 1,800 to 2,600 calls per day. The average handling time for each phone call had risen as well—from an acceptable standard of 5.6 minutes to an unfavorable 7.2 minutes. The department continued to be kept inundated with these types of calls for the two years that these changes have been effect.
Montague and her Husband sued Drummond and Nursefinders. Montague alleged causes of action for negligence, battery and negligence per se and intentional affliction of emotional distress under a theory of respondent superior. She also alleged that Nursefinders negligently hired, supervised and trained Drummond. Montague’s husband claimed for loss of consortium.

Since all entities within the organization are responsible and affected by any expenses endured on any entity being unfavorable or favorable, the foundation serves as a primary motivator to reduce costs at all levels. There have been problems within Long-Term Care and many of these abuses were turned over to the patients, there was hardly any direction on how to handle Long-Term Care. “Poor houses and Almshouses and developed in response to an impoverished, aging, and mentally and physically disabled population who lacked informal caregivers.” (Sarah Thompson, 2008 ) When Long-Term Care was in the infancy stage of developing there were many problems, issues that were created because there was not much direction. In developing in taking care of the elderly there were poorly trained nurses, medical workers and many of them were not qualified to work within the medical field. There were problems, many issues and multiple levels of abuse because of poorly trained medical workers where there was no direction.
Leading up to the collapse of the Caregroup, a researcher on the CareGroup network started an experiment with a knowledge management system application. The software was designed to locate and automatically copy information across the network. The researcher left the software up and running in its initial configuration. The software hadn’t been tested for the environment and began copying data in large volumes from other computers. By the afternoon of November 13, 2002 (the day of the collapse) the software was moving large terabytes of data across the network.

One of the fraud cases that is becoming very common in nursing homes is that the patients are charged wrong amounts for the services that they acquire from the nursing home. The patient generally comes with some disease to seek medical attention. The nursing home raises fraud cases by advising unnecessary tests and procedures to be done on the patients. These tests or procedures may not be required for the patient. As the patient is limited in knowledge, the tests and procedures are done on the patient while charging the patient with a heavy amount of bill. As the EAI team was discussing Molly’s case, one of the ED Residents made a few telephone calls. Molly’s PCP reported that during her last visit about 2 weeks ago, Mollie was alert and able to respond to questions appropriately. He confirmed that Mollie’s daughter and son in law have experienced psychiatric problems, adding that the son in law has expressed anger regarding Mollie’s living arrangements. The home health care agency was contacted. The RN and aide both report they have never met the son in law and have had very limited contact with Mollie’s daughter. When contacted by telephone, the daughter provided no explanation for Mollie’s extensive bruises noted on admission to the hospital. The daughter stated that Mollie did not fall, but in fact lowered herself to the floor in an effort to draw

In medicine, beneficence is the foundation of every encounter a clinician has with their patient, they are there to help alleviate symptoms and diseases in order to do good for them. In the case of Ms. R, respecting her decision to live alone will violate this premise of beneficence and go against all the medical advice she has been given. However, like with all decisions in medicine, a patient is presented with options and if the patient is mentally capable of making their own healthcare decisions, their decision should be respected no matter what it is. Nonetheless, just because Ms. R made a decision to live alone and accepts her potential risks, doesn’t mean that her daughter along with the medical team should let her put herself in harm 's way. There are other means of beneficence and nonmaleficence in this case that can be achieved while still respecting Ms. R’s autonomy. Firstly, Ms. R’s daughter can move in with her and be by her side everyday, or if she cannot move in, she can come visit her mom on the days the home health aid is not scheduled, that way someone will be always there to monitor her. The case involved the death of 91 year-old Maria “Concha” Lopez of Madera, California who was being cared for by her 26 year-old grandniece, Stephanie Hernandez. Ms. Hernandez called 911 when her Aunt stopped breathing and told the dispatcher that her aunt’s bones were too fragile for CPR, so the dispatcher gave instructions for basic mouth-to-mouth resuscitation. Arriving firefighters and paramedics were inundated with the odor of urine, feces, and rotting flesh emanating from piles of soiled diapers, used bandages and the patient. Ms. Lopez’s had dementia and would not go near doctors. She weighed about 35 pounds and had bedsores so deep that you could touch her bones and the metal rod in her hip. Ms. Hernandez was arrested and charged with murder for failure to give adequate care to her aunt. The trial took five weeks with the defense attorneys showing Ms. Hernandez as a loving niece whose efforts kept an old woman alive and the prosecutor showing autopsy photos and describing the woman’s condition as the result of severe criminal negligence. Ms. Hernandez’s mother worked in the fields and left her in the care of four great-aunts. Ms. Lopez watched her three sisters die in hospitals and made her family promise that she would not be taken to a hospital. The family expected Ms. Hernandez, who also had a small child, to take care of Ms. Lopez after she broke her hip. Federal and State laws require that nursing homes develop a plan of care and employ sufficient staffing to provide all the care listed on the care plan. Most corporate owned nursing homes today are not sufficiently staffed, and they can not provide all the care listed on the care plan. Consequently, residents are not taken to the toilet when necessary; they’re often left lying in urine and feces. They also develop painful and life-threatening decubitus ulcers, and are not fed properly, they’re not given sufficient fluids. They are also over-medicated or under-medicated, and dropped causing painful bruises and fractures, are ignored and not included in activities, are left in bed all day, call lights not answered. These are all forms of negligence, performed daily in nursing homes.
