Flag burning has always been an issue. Unfortunately, it has become a bigger issue ever since Trump went on Twitter and tweeted, “Nobody should be allowed to burn the American flag -- if they do, there must be consequences -- perhaps loss of citizenship or year in jail" (CNN). The act of flag burning is considered offensive by many, but flag burning is legal in the U.S. under Supreme Court rulings that it is constitutionally protected speech under the First Amendment. At the 1984 Republican National Convention in Dallas, Texas, Johnson decided to burn an American flag in protest of some policies made by the Reagan administration and some Dallas corporations that he did not agree with. Noone sustained physical injury or was even threatened with physical injury, but many were offended by the jesture made by Johnson. The Texas penal code forbids the desecration of a venerated object.
Free speech and the First Amendment rights do not give people lisence to desecrate a symbol of pride and freedom. It is not all right to protect those who let it burn, lighting up the sky with their hatred. It definitely is not acceptable to insult the men and women who fight every day to protect this nation by burning the symbol of their labors. Therefore, it is crucial that the Supreme Court pass the amendment to the Constitution to protect the flag of the US.
The above statement is somewhat mind-boggling. It is something that a revolutionist might have coined over 200 years ago and it leaves much to the imagination. It is about as close to being treasonous as one could get without actually committing the crime. The former Vice-President Albert Gore once stated that "the constitution was a living breathing document, open to change". The U.S Constitution is recognized as a document that secures basic rights for citizens and structures the American national government. Before the Constitution, the states had all the power and the national government was very weak. Therefore, the creation of the Constitution was necessary to grant the national government power. Even though, the Constitution was signed in 1787, there was still debate in that the Constitution gave the national government too much power. Some of the individuals whom opposed the Constitution where Patrick Henry and George Mason. Patrick Henry became the leader of the opponents, because of his strong legal and rhetoric skills. On the other hand, George Mason was a patriot during the American Revolution, whom believed in the inalienable rights of the people. These two man were important figures that argued the dangers ratifying the Constitution would bring and that the Constitution would give too much power to the national government.
To the Majority Opinion it’s a flag of our nation but to the Dissenting opinion its means more than just a flag. It means “White signifies purity and innocence, Red, hardiness & velour, and Blue, the color of the Chief (the broad band above the stripes) signifies vigilance, perseverance & justice." Freedom of speech and expression is a right given to all Americans under the First Amendment of the Constitution. It is a difficult concept to embrace when individuals are faced with ideas they oppose. In this kind of situation, the protection guaranteed to American citizens becomes even more important. The First Amendment was designed not only to protect the freedom to express ideas and sentiments with which one agrees, but also the ideas and sentiments with which one disagrees. It is for precisely this reason that the government should maintain the right of individuals to express their dissatisfaction with the policies of the government through the act of flag burning and not amend the Constitution to make such an act illegal.

The founding fathers had a vision of freedom and equality. Modern day America does not live up to the vision because there’s racial inequality and poverty.
The Confederate flag was used symbolically during the Civil War. To southerner’s, the flag represented a source of southern pride as well as a way of remembering the fallen Confederates. As the Civil War proceeded, the meaning of the flag began to change. Currently, the flag is being used as a symbol for racism. Years later in 1989, Johnson got the decision overturned by the United States Supreme Court. In the same year, the state of Texas passed the Flag Protection Act, which prohibited any form of desecration against the American flag. This act provoked many people to protest and burn flags anyway. Two protestors, Shawn Eichman and Mark Haggerty were charged with violating the law and arrested. Both Eichman and Haggerty appealed the decision because the law was inconsistent with the first amendment to the Constitution. The right to petition the government for a redress of grievances is protected by the first amendment of the Constitution. Burning American flags and other such actions are not treasonous and should no be treated as so, as long as these actions are done to petition the government for a redress of grievances.
Your First Amendment rights are extremely close to being violated by none other than the United States Congress. I refer to the Flag Desecration Bill that, if passed, would do irreparable damage to our right to free speech and undermine the very priniciples for which the American flag stands. Fortunately, West Virginians have an ally in Sen. Robert C. Byrd. Sen. Byrd, who previously favored the bill, now fights to protect our rights by stopping the passage of this bill. I applaud his stand and want to reinforce his position. I also encourage you to join Sen. Byrd's campaign to ensure the legacy and supremacy of the greatest law in the land: the United States Constitution.
The argument I would make that flag burning threatens to cause violence and should be illegal is that there are radical patriotic Americas that would become offended because of the troops fighting for our country and that the flag symbolizes our nation and therefore disrespecting the nation.The argument that I would make and that I personally agree with is that we should protect flag burning because it is our freedom of expression and speech to disagree with the government or show dislike of it.
