Emile Durkheim puts forth the sociological theory that individuals are overwhelmingly a product of their environment. Thus, societies directly influence their members' perspectives and qualities of life. The same theory can apply to the American correctional system. Segregation in prison, whether according to race, gang affiliation, or religion, allows for the reinforcement of the group mentality within the individual through cultural transmission. Rather than rehabilitating, then, the correctional system only further socializes a criminal mentality among its inmates that directly contributes to the high rates of rearrests within a three-year period follow release. The reentry in to society is unjust for individuals (offenders) and society! First with let’s go back to the theories of punishment, these theories, which are, utilize by the justice system not only here, but based of the common laws they have been formed. This excerpt will be focusing on is rehabilitation and a little of retribution. The processes of these individuals are to pay back for the social harm that they have caused to society. Social Harm by definition is the recognition of what society has deemed and classified as social harm. In other words, what the people has felt violates the norms the living standards. Every civilization in history has had rules, and citizens who break them. To this day governments struggle to figure out the best way to deal with their criminals in ways that help both society and those that commit the crimes. Imprisonment has historically been the popular solution. However, there are many instances in which people are sent to prison that would be better served for community service, rehab, or some other form of punishment. Prison affects more than just the prisoner; the families, friends, employers, and communities of the incarcerated also pay a price. Prison as a punishment has its pros and cons; although it may be necessary for some, it can be harmful for those who would be better suited for alternative means of punishment.
Throughout his novel, Texas Tough: The Rise of America’s Prison Empire, author and professor Robert Perkinson outlines the three current dominant purposes of prison. The first, punishment, is the act of disciplining offenders in an effort to prevent them from recommitting a particular crime. Harsh punishment encourages prisoners to behave because many will not want to face the consequences of further incarceration. Criminals are not only punished once for their crimes, they are punished twice, and these invisible punishments follow them throughout their lifetime. Travis explains that these punishments are a form of “social exclusion”, not purposely designed but merely due to the operation of law. Travis further explains that offenders are denied the right to vote, and even denied student loans. For example, even though a drug addict has served his sentence and rehabilitates himself, the opportunity to receive higher education to advance himself is denied. He demonstrates how the idea of denying offenders certain rights is not a new concept.
The book titled Beyond Bars: Rejoining Society After Prison offers invaluable lessons of how both men and women may successfully depart prison and return to society. The book was written by Jeffrey Ross and Stephen Richards, both of whom are college professors and criminal justice experts. The population of prisons across the United States has increased dramatically in recent decades despite overall crime rates decreasing during the same time period. Approximately seven million American people are in some form of correctional custody. Between the years1980 and 2000, America’s prison population increased by 500 percent. During the same time period, the number of prisons grew by 300 percent (Ross and Richards, xii). Close to 50 percent of people admitted to confinement have previously served time, exemplifying that the criminal justice system “recycles” inmates through the system again and again (Ross and Richards, xi). Unfortunately, many convicts simply do not remember how to or are ill-equipped to return to society once their sentence ends. Ross and Richards, through their valuable lessons within their book, seek to lessen the problems that ex-prisoners may face when released from prison.
The United States has a larger percent of its population incarcerated than any other country. America is responsible for a quarter of the world’s inmates, and its incarceration rate is growing exponentially. The expense generated by these overcrowded prisons cost the country a substantial amount of money every year. While people are incarcerated for a number of reasons, the country’s prisons are focused on punishment rather than reform, and the result is a misguided system that fails to rehabilitate criminals or discourage crime. The ineffectiveness of the United States’ criminal justice system is caused by mass incarceration of non-violent offenders, racial profiling, and a high rate of recidivism.
The current criminal justice system is expensive to maintain. In North America the cost to house one prisoner is upwards of eighty to two hundred dollars a day (Morris, 2000). The bulk of this is devoted to paying guards and security (Morris, 2000). In contrast with this, community oriented programming as halfway houses cost less than the prison alternative. Community programming costs five to twenty five dollars a day, and halfway houses although more expensive than community programs still remain cheaper than prison (Morris, 2000). Tabibi (2015c) states that approximately ninety percent of those housed in prison are non-violent offenders. The treatment of offenders in the current system is understood to be unjust. By this, Morris (2000) explains that we consistently see an overrepresentation of indigenous and black people in the penal system. Corporate crimes are largely omitted, while street crimes are emphasized (Morris, 2000). This disproportionately targets marginalized populations (homeless, drug addicted and the poor) (Tabibi, 2015c). The current system is immoral in that the caging of people is highly depersonalized and troubling (Tabibi, 2015c). This is considered to be a barbaric practice of the past, however it is still frequently used in North America (Morris, 2000). Another moral consideration is with the labelling of youth as offenders in the criminal justice system (Morris, 2000). Morris (2000) argues that we should see youth crimes as a social failure, not as an individual level failure. Next, Morris (2000) classifies prisons as a failure. Recidivism rates are consistently higher for prisons than for other alternatives (Morris, 2000). The reason for this is that prisons breed crime. Prisons and correctional facilities in the United States have changed from rehabilitating people to housing inmates and creating breeding grounds for more violence. Many local, state, and federal prisons and correctional facilities are becoming more and more overcrowded each year. If the Department of Corrections (DOC) wants to stop having repeat offenders and decrease the volume of inmates entering the criminal justice system, current regulations and programs need to undergo alteration. Actions pushed by attorneys and judges, in conjunction current prison life (including solitary confinement), have intertwined to result in mass incarceration. However, prisoner reentry programs haven’t fully impacted positively to help the inmate assimilate back into society. These alterations can help save the Department of Corrections (DOC) money, decrease the inmate population, and most of all, help rehabilitate them. After inmates are charged with a crime, they go through the judicial system (Due Process) and meet with the prosecutor to discuss sentencing.
The Criminal Justice system was established to achieve justice. Incarceration and rehabilitation are two operations our government practices to achieve justice over criminal behavior. Incarceration is the punishment for infraction of the law and in result being confined in prison. It is more popular than rehabilitation because it associates with a desire for retribution. However, retribution is different than punishment. Rehabilitation, on the other hand is the act of restoring the destruction caused by a crime rather than simply punishing offenders. This may be the least popular out of the two and seen as “soft on crime” however it is the only way to heal ruptured communities and obtain justice instead of punishing and dispatching criminals
The goals of juvenile corrections are too deter, rehabilitate and reintegrate, prevent, punish and reattribute, as well as isolate and control youth offenders and offenses. Each different goal comes with its own challenges. The goal of deterrence has its limits; because rules and former sanctions, as well anti-criminal modeling and reinforcement are met with young rebellious minds. Traditional counseling and diversion which are integral aspects of community corrections can sometimes be ineffective, and studies have shown that sometimes a natural self intervention can take place as the youth grows older; resulting in the youth outgrowing delinquency.
As the current prison structures and sentencing process continues to neglect the issues that current offenders have no change will accrue to prevent recidivism. The issue with the current structure of the prison sentencing process is it does not deal with the “why” the individual is an social deviant but only looks at the punishment process to remove the deviant from society. This method does not allow an offender to return back to society without continuing where they left off. “The history of correctional thought and practice has been marked by enthusiasm for new approaches, disillusionment with these approaches, and then substitution of yet other tactics”(Clear 59). During the mid 1900s, many changes came about for the system of corrections in America. Once a new idea goes sour, a new one replaces it. Prisons shifted their focus from the punishment of offenders to the rehabilitation of offenders, then to the reentry into society, and back to incarceration. As times and the needs of the criminal justice system changed, new prison models were organized in hopes of lowering the crime rates in America. The three major models of prisons that were developed were the medical, model, the community model, and the crime control model.

As the purpose of restorative justice is to mend the very relationship between the victim, offender, and society, communities that embrace restorative justice foster an awareness on how the act has harmed others. Braithwaite (1989) notes that by rejecting only the criminal act and not the offender, restorative justice allows for a closer empathetic relationship between the offender, victims, and community. By acknowledging the intrinsic worth of the offender and their ability to contribute back to the community, restorative justice shows how all individuals are capable of being useful despite criminal acts previous. Prison was designed to house and isolate criminals away from the society in order for our society and the people within it to function without the fears of the outlaws. The purpose of prison is to deter and prevent people from committing a crime using the ideas of incarceration by taking away freedom and liberty from those individuals committed of crimes. Prisons in America are run either by the federal, states or even private contractors. There are many challenges and issues that our correctional system is facing today due to the nature of prisons being the place to house various types of criminals. In this paper, I will address and identify three major issues that I believe our correctional system is facing today using my own ideas along with the researches from three reputable outside academic sources.
Incarceration has not always been the main form of “punishment” when it comes to doing an injustice to society. In fact, in the early 1600’s common forms of punishments for doing wrong in society included social rejection, corporal punishment, forced labor etc. (“Prison History.”). It had not been until the 18th century where it had been determined that incarceration could actually be a form of punishment correlating with a set amount of time in which an individual had to serve dependent on the severity of his actions. The logic behind incarceration is to restrict a person of his liberty as retribution for the crime he has committed (Prison History.”) Prisons that were created in the 18th century gained their recognition because of their high goals in perfecting society. But, the truth is as people were focusing on perfecting society prisons soon became overcrowded, dirty, and most of all dangerous. By the late 19th century many more people had become aware of the poor prison conditions which had led to a “reformatory” movement. The reformatory movement was put into place as a means of rehabilitation for inmates (“Prison History.”) Prisons would now offer programs to reform inmates into model citizens by offering counseling, education, and opportunities to gain skills needed for working in a civilian world. However, with the growing amount of inmates each year prisons are still becoming overcrowded. Because prisons are so overcrowded there are not enough resources being spent on achieving the rehabilitation of inmates and reintegrating them into society in order for them to survive in the civilian world once released from prison (“Prison History.”)
