Since the 1973 Roe v. Wade supreme court case, Abortion has become a frequently discussed topic amongst people. Abortion is the intentional termination of pregnancy, typically it is done early in the pregnancy, but it has occasionally been done late term, though in those cases they are more for the safety of the mother. There are many different views on Abortion and the question of its morality, though there are three philosophers who able to eloquently express some of those views. Those philosophers being Don Marquis, who believes that abortions are immoral and should be illegal, Judith Jarvis Thomson who agrees with Marquis that the fetus has some rights, but also says that the rights of the mother outweigh the fetus’s and as a result she Marquis acknowledges that fetuses don’t have the capacity for self-conscious awareness, but believes that despite their lack of awareness they still should be given a right to life. He goes on to make the argument that abortion can be on the same level as the murder of an adult human. And, Marquis explains that people have reservations against murder because it denies them the right to their future experiences, projects, activities, and enjoyments. While he still believes abortion to be immoral, he does condone abortion under certain circumstances, those circumstances being when the loss would be equal, such as when the mother’s life is at risk because then the mother wouldn’t be allowed the same right to future experiences as the fetus otherwise. An easy objection to make to Marquis statement is that the value of one’s future is reliant on someone’s ability to be cognizant of their future, and as fetuses aren’t it would make abortion morally permissible. To that point Marquis responds that a fetus has the potential to become self-conscious. And according to him, because fetuses have the potential to personhood makes abortion morally However, she differs in opinion with Thomson in a major way, as Warren makes the claim that fetuses don’t have a significant right to life, which directly opposes Thomson’s belief that fetuses have a right to life. Warren rejects the traditional anti-abortion arguments, as she believes they contain faulty equivocations and lack clear distinction. The distinction that she is attempting to raise is that of biological life and personhood, biological life is a scientific concept, whereas personhood is a much more personal, philosophical concept, and because of that she doesn’t consider fetuses to be people. For her, in order to be considered a person one needs to have the five Cognitive Criterion of Personhood traits. Those traits being Consciousness, reasoning, self-motivated activity, the capacity to communicate, and lastly the presence of self-concepts and self-awareness. Marquis FLO argument isn’t valid enough to conduce to his entire theory. Marquis cannot see into the future and determine if a fetus will have a great future. If the pregnancy goes well and the fetus is born, then yes they are entitled to a future, but whether it will be like “ours” is unpredictable making Marquis point of FLO an invalid argument. Abortion is depriving a fetus of a future life in general. If Marquis would have said this instead I would be more willing to agree with his theory. Abortion is morally impermissible because at the end of the day, it is murder. A fetus will grow to be a human with organs and a brain and have some type of future whether good or bad.
In this paper I will discuss Don Marquis’s essay “Why Abortion is Immoral” and Judith Jarvis Thomson’s objections to Marquis’ argument against abortion.
Warren’s primary argument for abortion’s permissibility is structured around her stance that fetuses are not persons. This argument relies heavily upon her six criteria for personhood: A being’s sentience, emotionality, reason, capacity for communication, self-awareness, and having moral agencies (Warren 171-172). While this list seems sound in considering an average, healthy adult’s personhood, it neither accounts for nor addresses the personhood of infants, mentally ill individuals, or the developmentally challenged. Sentience is one’s ability to consciously feel and perceive things around them. While it is true that all animals and humans born can feel and perceive things within their environment, consider a coma patient, an individual suspended in unconsciousness and unable to move their own body for indeterminate amounts of time.
Marquis is arguing that fetuses, children, and adults are all human beings and have the right to life. Also, Marquis expresses that losing one’s life is one of the worst things that can happen to a human being. So he technically declares that it is horrible to die but not the worst thing to happen to someone. He starts out with the first premise about how the killing of a fetus deprives it of its potential future experiences. Which is a factual statement in that it states that if someone is dead they obviously cannot participate in future events. In Marquis’ second premise, he states that by not allowing a human being to have those future experiences your action is prima facie (accepted as correct until proven otherwise) morally wrong. Marquis argues about how it is wrong to kill someone but it is even worse than other crimes because you are taking away that person’s future and values. Marquis argues how not allowing a child to live is morally wrong to our society because they also have a future and experiences they would miss out on just like all human beings. For the sake of the argument, Thomson adopts the conservative view that the foetus is a person from the moment of conception. The conservative argument asserts that every person has a right to life. Don Marquis is a philosopher arguing that any form of abortion is immoral. His original thesis states: In the overwhelming majority of cases, deliberate abortions are seriously immoral. Marquis’s argument that it is immoral to kill, and abortion is wrong because it deprives one of a valuable future has a lot of problems in my eyes that does not make his view on anti-abortion solid. The lack of arguments that do not raise questions that seem to go unanswered make it hard to be persuaded to change a pro-abortionist mind or even be open to understanding where Marquis’s arguments lead. His “what if” argument leaves room for anyone opposing to “what if” in any direction which is not grounds for an effective argument and hurts Marquis’s because a lot of the questions go unanswered in his essay.
Abortion is a considered a sensitive topic in society; as a result it is not frequently mentioned or discussed. However; Marquis has decided to voice his opinion on the matter.
In our society, there are many ethical dilemmas that we are faced with that are virtually impossible to solve. One of the most difficult and controversial issues that we are faced with is abortion. There are many strong arguments both for and against the right to have an abortion which are so complicated that it becomes impossible to resolve. The complexity of this issue lies in the different aspects of the argument. The essence of a person, rights, and who is entitled to these rights, are a few of the many aspects which are very difficult to define. There are also issues of what circumstances would justify abortion. Because the issue of abortion is virtually impossible to solve, all one can hope to do is understand the different aspects of the argument so that if he or she is faced with that issue in their own lives, they would be able to make educated and thoughtful decisions in dealing with it.
