Introduction: In today's societies, the government and criminal justice systems very much related to ethics because they both establish and carry out definite rights and duties. They also attempt to prevent and/or hold anyone accountable that deviates from these standards. (Wright 2012)
I. Thesis: While all of humanity should practice principles of equality, solidity, and human rights, it is extremely imperative that the corrections professionals and the criminal justice system come together at large to build a more just society. The Constitution of the United States ensures corrections professionals uphold the law in an ethical manner.
A). According to the legal dictionary, ethics is defined as "moral principles that governs someone behavior". Two main areas the U.S. Constitution implemented the outline of correction professionals behavior is through the Due Process Clause. In the Fifth Amendment which states: "No person shall be deprived of life, liberty, or property, without due process of law", which in this context being applied to the federal government. The Fourteenth Amendment states the same exact thing, this time referring to the states. For this to be mentioned twice it must have high value. Vitek v. Jones is a great example for criminal due process. (Gottlieb, N. R. 1982) The due process clause of the Fourteenth Amendment obligates certain steps and guidelines to be adhered to for state prisoners who may be transferred without choice to a state that can provide a mental hospital for treatment of a mental diseases or defects. Corrections departments need to work as a team to set up housing and society training for inmates. One good program that helps with this is the rehabilitation programs, which are among the first to be cut when budget cuts come around every year. Which means that the correction professions needs more innovated individuals that can come up with different options and varirieties of rehab. Inmates spend so much of their time being institutionalized so now it is up to the corrections society to ensure they are ready to be a citizen again. When envisioning a prison, one often conceptualizes a grisly scene of hardened rapists and murderers wandering aimlessly down the darkened halls of Alcatraz, as opposed to a pleasant facility catering to the needs of troubled souls. Prisons have long been a source of punishment for inmates in America and the debate continues as to whether or not an overhaul of the US prison system should occur. Such an overhaul would readjust the focuses of prison to rehabilitation and incarceration of inmates instead of the current focuses of punishment and incarceration. Altering the goal of the entire state and federal prison system for the purpose of rehabilitation is an unrealistic objective, however. Rehabilitation should not be the main purpose of prison because there are outlying factors that negatively affect the success of rehabilitation programs and such programs would be too costly for prisons currently struggling to accommodate additional inmate needs.
The governance of our present day public and social order co-exist within the present day individual. Attempts to recognize the essentiality of equality in hopes of achieving an imaginable notion of structure and order, has led evidence based practitioners such as Herbert Packer to approach crime and the criminal justice system through due process and crime control. A system where packer believed in which ones rights are not to be infringed defrauded or abused was to be considered to be the ideal for procedural fairness. “I would rather be exposed to the inconveniences attending too much liberty than to those attending too small a degree of it.” Thomas Jefferson pg 9 cjt To convict an individual because proper consideration was not taken will stir up social unrest rather then it’s initial intent, when he or she who has committed the crime is not punished for their doings can cause for a repetition and even collaboration with other’s for a similar or greater crime.
Prisons and correctional facilities in the United States have changed from rehabilitating people to housing inmates and creating breeding grounds for more violence. Many local, state, and federal prisons and correctional facilities are becoming more and more overcrowded each year. If the Department of Corrections (DOC) wants to stop having repeat offenders and decrease the volume of inmates entering the criminal justice system, current regulations and programs need to undergo alteration. Actions pushed by attorneys and judges, in conjunction current prison life (including solitary confinement), have intertwined to result in mass incarceration. However, prisoner reentry programs haven’t fully impacted positively to help the inmate assimilate back into society. These alterations can help save the Department of Corrections (DOC) money, decrease the inmate population, and most of all, help rehabilitate them. After inmates are charged with a crime, they go through the judicial system (Due Process) and meet with the prosecutor to discuss sentencing.

When you release people instead use these alternatives versus confinement it is less of a waste of expensive resources, taxpayer’s money, as well as time. A medium between control and treatment needs to be met in all of the prisons, or jails. Some men or women need more strict conditions and supervision practices while others may just need more of the services that should be offered such as rehabilitation, and alcohol or drug prevention. Any of these options will not be easy nor diminish this overcrowding issue quickly. It will take time, patience, and cooperation with both the inmates or ex-offenders family, friends, courts as well as law enforcement and jails.
The basis of criminal justice in the United States is one founded on both the rights of the individual and the democratic order of the people. Evinced through the myriad forms whereby liberty and equity marry into the mores of society to form the ethos of a people. However, these two systems of justice are rife with conflicts too. With the challenges of determining prevailing worth in public order and individual rights coming down to the best service of justice for society. Bearing a perpetual eye to their manifestations by the truth of how "the trade-off between freedom and security, so often proposed so seductively, very often leads to the loss of both" (Hitchens, 2003, para. 5).
Freedom in any society is a condition that is directly correlated to the compliance of society’s rules, regulations, and laws. This right afforded to citizens under the constitution is surrendered by those who choose to disregard and trample on the set of standards and behavior needed for a society to maintain order and avoid anarchy. When loss of freedom is the tool used to punish this segment of society, prisons become the instrumentality used to carry out the various freedom restrictions under the law for each individual. Citizens who find themselves incarcerated in prison will be exposed to an entirely different environment than those in free society. In addition, there is a psychological impact on those being reintroduced into society after having completed long-term sentences, an impact many believe contribute to the high recidivism rates in the United States. The criminal justice system with all of its connected inner workings may not address all of the concerns inside and out of our current prison system, but just as we have improved on our prisons from the past, we will continue to improve and implement new techniques and design precise programs in our future prisons.
Corrections have been in used throughout the centuries in many lands and countries. It is for the punishment and treatment of individuals who have committed crimes against others. The correctional side of the criminal justice system is just one part of a greater whole. Correctional officers have one of the hardest and most dangerous jobs with having a number of responsibilities. Correctional officers are the peace keepers of the prisons and institutions that hold large numbers of convicted criminals. What is to say that all officials of these institutions adhere to the firm rules and regulations of the prisons? In today's society, we are facing many changes. Our own family, neighbors, and countrymen are afraid of many dangers which influence their lives. Although many people have fear which resonates in their consciousness and unconsciousness, the United States has a comparatively low crime rate. Despite this low crime rate, America incarcerates it's citizens five times the rate of Canada and seven times that of most European democracies.(Slambrouck, Paul. 24) Our society needs to be changed. We cannot blame the individuals involved in wrongdoing but we can blame our society who raised these criminals. Of course someone who kills another human being needs to be put away in some form; but we need to make changes. We need to help as many maladjusted people as we can. There are some steps which really seem to work. There are many prison inmates who come from broken homes and have low self-esteem. What needs to be done to help these insecure people, who are at war with themselves and society, is to rehabilitate them. The problem is the prison officials do not try to teach the prisoners how to learn from their mistakes.(McGovern, Celeste. 42) What actually happens is that criminals tend to be better thefts, and have the ability to out smart the police. Our politicians need to stress how important vocational, educational, drug-treatment, and religious programs are, in order to improve the attitude and demeanor of these convicted felons. The criminal justice system is composed of three parts – Police, Courts and Corrections – and all three work together to protect an individual’s rights and the rights of society to live without fear of being a victim of crime. According to merriam-webster.com, crime is defined as “an act that is forbidden or omission of a duty that is commanded by public law and that makes the offender liable to punishment by that law.” When all the three parts work together, it makes the criminal justice system function like a well tuned machine.
With the substantial increase in prison population and various changes that plague correctional institutions, government agencies are finding that what was once considered a difficult task to provide educational programs, inmate security and rehabilitation programs are now impossible to accomplish. From state to state each correctional organization is coupled with financial problems that have depleted the resources to assist in providing the quality of care in which the judicial system demands from these state and federal prisons. Judges, victims, and prosecuting attorneys entrust that once an offender is turned over to the correctional system, that the offender will receive the punishment in which was imposed by the court, be given services that aid in the rehabilitation to those offenders that one day will be released back into society, and to act as a deterrent to other criminals contemplating criminal acts that could result in their incarceration. Has our nations correctional system finally reached it’s critical collapse, and as a result placed or American citizens in harm’s way to what could result in a plethora of early releases of inmates to reduce the large prison populations in which independent facilities are no longer able to manage? Could these problems ultimately result in a drastic increase in person and property crimes in which even our own law enforcement be ineffective in controlling these colossal increases of crime against society?
The definition of justice and the means by which it must be distributed differ depending on an individual’s background, culture, and own personal morals. As a country of many individualistic citizens, the United States has always tried its best to protect, but not coddle, its people in this area. Therefore, the criminal justice history of the United States is quite extensive and diverse; with each introduction of a new era, more modern technologies and ideals are incorporated into government, all with American citizens’ best interests in mind.
All over America, crime is on the rise. Every day, every minute, and even every second someone will commit a crime. Now, I invite you to consider that a crime is taking place as you read this paper. "The fraction of the population in the State and Federal prison has increased in every single year for the last 34 years and the rate for imprisonment today is now five times higher than in 1972"(Russell, 2009). Considering that rate along crime is a serious act. These crimes range from robbery, rape, kidnapping, identity theft, abuse, trafficking, assault, and murder. Crime is a major social problem in the United States. While the correctional system was designed to protect society from offenders it also serves two specific functions. First it can serve as a tool for punishing the offender. This involves making the offender pay for his/her crime while serving time in a correctional facility. On the other hand it can serve as a place to rehabilitate the offender as preparation to be successful as they renter society. The U.S correctional system is a quite controversial subject that leads to questions such as how does our correctional system punish offenders? How does our correctional system rehabilitate offenders? Which method is more effective in reducing crime punishment or rehabilitation? Our correctional system has several ways to punish and rehabilitate offenders.
Prison was designed to house and isolate criminals away from the society in order for our society and the people within it to function without the fears of the outlaws. The purpose of prison is to deter and prevent people from committing a crime using the ideas of incarceration by taking away freedom and liberty from those individuals committed of crimes. Prisons in America are run either by the federal, states or even private contractors. There are many challenges and issues that our correctional system is facing today due to the nature of prisons being the place to house various types of criminals. In this paper, I will address and identify three major issues that I believe our correctional system is facing today using my own ideas along with the researches from three reputable outside academic sources.
