Their targets may vary depending on the country, but in the US, they are usually used against people whose nationality isn’t American or whose race isn’t white. Different people have different opinions about racial slurs, lie “I have freedom of speech so I can use them as much as I want,” or, “Racial slurs’ only purpose is to discriminate against innocent people of color in our communities.” What do I think? In the 1960s racial hate was a massive problem, probably the biggest issue to face the country at that time. Fast forward 50 years and ask if that problem has been solved. Obviously it hasn’t. Racial slurs are commonly used in everyday conversations and stereotypical ideas about people of different races are commonplace. Some may argue that since the time of the Civil Rights Movement in the 60s racially motivated hate issues have come so far in the direction of an equal society. The words Negro, nigger, and nigga have always been a sensitive topic, yet it is a topic that needs to be addressed in light of the more common use of its vernacular. One word is used to describe a color, while the others are used to define a people. It’s very clear to many the negative connotation these words carry, but where did these words come from? Furthermore, is there a difference between the word nigger and nigga; and why is it that African-Americans now use the word nigga to degrade each other in today’s society? These words, in spite of their spelling, still holds the same degrading power as it did during the time of slavery, and they are still spoken out of cruelty and ignorance, but who is to blame? Can one still blame the Spaniards for considering people of a darker skin tone –Black? Can we blame the Europeans for perpetuating their hatred and ignorance of superiority over a race of people to the point they felt it lawful to define and dehumanize them? Or does the blame lie with the African-American race as we use this degrading labeling on our own kind, thus becoming the victimizer. Either way nigger or nigga are words that should be eliminated from the vocabulary of every human being.
In the following essay, Charles R. Lawrence encompasses a number of reasons that racist speech should not be protected by the First Amendment. In this document, he exhibits his views on the subject and what he feels the society should confront these problems. In this well- written article, he provides strong evidence to prove his point and to allow the reader to see all aspects of the issue.
When discussing hate speech one has to address fighting words. Fighting words are words that the Supreme Court believes that even the mere utterance of them will inflict injury or incite an immediate breach of the peace. The court also believes these words are unnecessary for anyone to use, and that even if they were not used someone could still express their ideas.
When the topic of hate and bias crime legislation is brought up two justifications commonly come to mind. In her article entitled “Why Liberals Should Hate ‘Hate Crime Legislation” author Heidi M. Hurd discusses the courts and states views that those who commit hate and bias crimes ought to be more severely punished. She takes into consideration both sides of the argument to determine the validity of each but ultimately ends the article in hopes to have persuaded the reader into understanding and agreeing with her view that laws concerning the punishment of hate and bias laws should not be codified. Hate crime is described as a violent, prejudice crime that occurs when a victim is targeted because of their membership in a specific group. The types of crime can vary from physical assault, vandalism, harassment or hate speech. Throughout the article Hurd tried to defend her view and explain why there should be no difference of punishment for similar crimes no matter the reason behind it. Her reason behind her article came from the law that President Obama signed in 2009 declaring that crimes committed with hatred or prejudice should have more sever punishments. While the court has their own views to justify their reasoning behind such decisions, in the article Hurd brings up points and facts to prove the wrongfulness of creating such a law. However, though Hurd has made her views clear in the following essay I will discuss reasons why the penalties are justifiable, why they should receive the same degree of punishment, less punishment and my personal view on the topic.
In today’s world, people would like to think that racism no longer exists, at least not in the way it use to exist in the past where the people could be lynched or beaten or arrested just for the color of their skin. Racism today are stereotypes based on a person’s skin color, for instance if that person is a Hispanic or a Latino they are probably an illegal immigrant or if they are African American with dark skin they probably have a criminal record. Many racist stereotypes are usually targeted to the African Americans, Hispanics or Latinos that live in the United States. One example is explained when Wright said “Whut yuh tryin’ t’ do, nigger, git smart?” (Wright 4) This is verbal abuse because the word “nigger” is what whites would call blacks in a bad way. No one should call anyone something they don’t want to be called. “Nigger” is a word that was used towards blacks when white people would feel disrespected by black people. This was a word used to make black people feel like they are lower than white people, like slaves; even though some were. Even though “nigger” is a word that is still used today, it is not as offensive as it was back then. When black people use this word among themselves, it’s not really a problem, but if a white person calls a black person ‘nigger’ it brings some hostility. Another example explained in Wright’s “The Ethics of Living Jim Crow” is when he said “You black son-of-a-bitch! You call me Pease, then!” (Wright 6). This is verbal abuse because using profanity towards a person is verbal abuse, especially toward a child. Calling someone that word could make a person feel so low in a way. This could make a person feel low in a way where it’s double-consciousness (Dubois). Double-consciousness is when you feel some type of way about yourself and it could be different in the eyes of others. Meaning you might think you’re smart, while others think you’re dumb. Any crime motivated by a bias against a person or group based on their ethnicity, gender, sexual preference, religion or another characteristic is a hate crime. These crimes can either be committed against the people themselves or their property. When someone commits a hate crime they are targeting a group of people not just one individual. That’s why hate crimes have extra punishment. The punishment for hate crimes are very insignificant considering the deviant who committed a hate crime targeted an entire group of people. Hate crimes are very serious offensive but determining where to draw the line can be difficult. Hate crimes are very serious and can have lasting effects on victims.
Hate crimes are like messages to members of a certain group that they are unwelcome in a particular neighborhood, community, school, or workplace. Hate crimes are criminal offenses, usually involving violence, intimidation or vandalism, in which the victim is targeted because of race, sexual orientation, religion, ethnicity, sex or political affiliation. Hate crimes can occur at home, at school, at places of worship, at work, on the street - virtually anywhere. A hate crime has many victims as it not only victimizes the immediate victim, but also impacts the larger community by creating fear and insecurity among all members of the group that the victim represents. Many people perceive hate crime perpetrators as crazed hate-filled neo-Nazis or "skinheads".
Lawrence’s reasons, “Carefully drafted university regulations would bar the use of words as assault weapons…”(67). The education system holds primarily the younger generations who one day will run this country. We want to encourage a nation that sticks to the values that are expected and continue to have an integrated society. I agree with Lawrence that regulations need to be added, but why stop at just the education system? If an enforcement is going to be made on what can be said verbally through hate speech in one area, I believe that it should be present in all aspects such as the work field, public places, and media. There is not a way to make a strong government ban on the use of every form of hate speech but if larger industries start declaring it unacceptable it will set an example for society to follow. No one should feel as if they do not belong in a certain area or place due to their ethnicity or race. The most current situation could be Americans discriminating against Muslims and relating them to ISIS, this may not seem like segregation but it is discriminating and separating someone due to assumptions about them due to their background that they cannot change. In this world today, hate is becoming increasingly more abundant, especially as it concerns race. Whether it be an unarmed black man shot by a white police officer or the use of racial slurs towards someone, it seems like racism is all around us. In the book To Kill A Mockingbird, it shows a little girl named Scout using racial slurs. Racism is so culturally accepted in the town that it’s okay to use racial slurs such as the N-Word that even Atticus, a lawyer representing a black man falsely accused of rape, uses it a couple of times. Earlier this year, the Ku Klux Klan, a group of white supremacists, held a violent rally in Charlottesville, Virginia, and proved that racism isn’t a thing of the past.
The racial slurs have been pounded into your head, yet you find comfort in the few friends that you have made. Friends that accept you for who you are, not for what your skin color is. Behind you, whispers fill the air with violence and prejudice against your type. But your immunity kicks in and you solemnly walk away. The snickers and slurs you here pass by you for you have heard way too many. Ignorant and oblivious owners of the words do not know how it feels, what it does to your self-esteem, how it brings you down for they have never been in your shoes. In America it is allowed due to the First Amendment that protects political views on racism. The American National Party and various other parties come under this protection, and so does the British National Party and the National Front. We do not have a First Amendment, but these obviously racist parties still exist. Open racists promote their views through propaganda, but soon may die out as it becomes socially unacceptable. Violent racism promotes racism through violence and fear.
Racist and racism are provocative words in American society. To some, they become curse words. They are descriptive words of reality that cannot be denied. Some people believe that race is the primary determinant of human abilities and capacities and behave as if racial differences produce inherent superiorities. People of color are often injured by these judgements and actions whether they are directly or indirectly racist. Just as individuals can act in racist ways, so can institutions. Institutions can be overtly or inherently racist. Institutions can also injure people. The outcome is nonetheless racist, if not intentional (Randall).
The First Amendment is known as the most protected civil liberty that protects our right to freedom of speech. There has been much controversy regarding hate speech and laws that prohibit it. These problems have risen from generation to generation and have been protested whether freedom of speech is guaranteed. According to our text book, By the People, hate speech is defined as “hostile statements based on someone’s personal characteristics, such as race, ethnicity, religion, or sexual orientation.” Hate speech is a topic of issue for many people and their right’s, so the question is often proposed whether hate speech should be banned by government.
