When the Second Amendment is looked at strictly, it means that the every citizen of the United States has a right to own a gun to protect themselves. An example of this is if a person were to walk into a Walmart, they could buy a gun no matter what they have done in the past. People all have different interpretations of what the 2nd Amendment means when it is looked at loosely. But, I believe when the 2nd Amendment is looked at loosely, it means that everyone has the right to own a gun with certain credentials or requirements.

The first Amendment of the United States Constitution says; “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”[1] Our fore fathers felt that this statement was plain enough for all to understand, however quite often the United States government deems it necessary to make laws to better define those rights that are stated in the Constitution. Today the framers would be both encouraged and discouraged by our modern interpretation the First Amendment the United States Constitution.
Violence and crimes are growing in number and affecting American society. By reinforcing background checks we could reduce crimes and limit easy gun access to mentally ill people. The National Instant Criminal Background Check System (NICS) is a database where the names of people that have committed a misdemeanor, are mentally ill or drug abusers is kept to prevent them from attaining guns. Most criminals buy guns from unlicensed sellers at gun shows that don’t do properly background checks through the NICS, making it easier from criminals to purchase firearms. Another problem is missing records or information that was not reported to the background check system. Better background checks could reduce crime and gun violence in America.
On December 15, 1791, the Bill of Rights was ratified effective by Congress. These first ten amendments to the Constitution of the United States of America promised the states certain rights and freedoms which could not be infringed by the government. After all, the founding fathers knew from experience that men in their weakness were often tempted by power. They had become all too familiar with this when under the control of King George in England. Therefore, in order to protect the future people of their beautiful country, they promised certain liberties which could not be taken away. Every single one of these freedoms is important for the United States of America. However, the second amendment is especially important to our nation because it allows the people to protect their freedom and defend themselves and the common good against an overreaching government.
The Second Amendment states, “A well-regulated Militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.” This statement basically means that people should be able to own guns for their own security and that right should not be taken away. The Second Amendment was added to the Constitution because the creators of the Constitution wanted to make sure that it protected basic rights, including the right to bear arms. It was also added to the Constitution because shortly after it was ratified, James Madison wanted to give more power to the state militia and to give more power to the people to give them the ability to fight back against the Federalists and the tyrannical government they were creating. After fighting off the British, the Second Amendment was created to give citizens the opportunity to fight back against controlling government and protect themselves with their own weapons.
Anti-gun control activists interpret the Second Amendment as saying that any individual, weather he be in the military or not, should be allowed to own firearms.
One way gun control advocates have tried to reduce the number of guns being issued to citizens of the United States of America is to require background checks. Background checks are performed on some weapons but they want a full background check for felonies, mental issues, proper classes, safety precautions to name a few. As history established America’s future, the suffering the United State encountered through history illustrate America’s ability to identify mistakes and make changes to prevent the predictable. The 2nd Amendment was written by the Founding Father who had their rights to bear arms revoked when they believe rising up to their government was appropriate. Although the Second Amendment prevents the federal government from completely banning guns in America, limited restrictions are allowed on the distribution and possession of firearms. Certain groups of people such as criminals, the mentally unstable, and soldiers dishonorably discharged from the military are prohibited from possessing or interacting with firearms (Flynn). These restrictions are enforced by background checks in some states on both a state and federal level. However, gun laws vary from state to state and are often not thorough enough; the background checks are flawed due to lack of information and misinformation, and guns can easily end up in the hands of criminals and malevolent individuals. Background checks lay a big role in the ownership of guns and by applying stricter background checks it could most likely decrease the rate of gun crime. Even with stricter background checks criminals will still be able to obtain guns online or at private gun shows but if we were to say make private gun shows illegal that would prevent at risk people from obtaining firearms that are meant to do harm to others. Private gun shows now don’t have to do background checks and this causes a problem because we don’t know who they may be selling these firearms to and what the person they sell them to attends to do with them. With lack of background control within private gun shows there has been a proven increase of guns falling into the hands of criminals in and out of state. If we were to close this loophole by making private gun shows illegal or even making them have to do background checks like any other gun seller we would close the loophole and reduce the gun ownership to criminals and high risk
As violence and murder rates escalate in America so does the issue of gun control. The consequence of this tragedy births volatile political discourse about gun control and the Second Amendment. The crux of the question is what the founding fathers meant when they wrote, “A well-regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.” Since the writing of the Second Amendment the make and model of firearms has changed dramatically and so has the philosophies of the people. A rifle is no longer defined as a single shot, muzzle-loading musket used to primarily protect families or solely for food. The 2nd Amendment has been a very controversial topic over the past year with the recent open carry law introduced to the public. This has caused much confusion amongst the right to bear arms and the overlooking Federal government’s role in controlling what it seems dangerous to the public. Our first eight amendments of the Constitution are direct restrictions on the federal government, and the 2nd amendment does not specifically grant the right for people to bear arms in a sense most would have believed. It does however forbid the federal government from infringing on your unalienable rights to defend yourself, it specifically says you shall not be infringed. This targets Congress, the Judicial and Executive branches of government and means they cannot pass a law, or sign anything that infringes on your right to bear arms or defend yourself.
They believe that if background checks were required for private sales, which they describe as “firearms sold at gun shows, through classified newspaper ads, the Internet, and between individuals virtually anywhere” then the “Gun Show Loophole” would be eliminated (Coalition to Stop Gun Violence). As evidenced by the call for an increase in gun control after mass shootings, people believe that with stricter gun control, we would have less incidences of gun violence. Gun control advocates argue that if we have stricter gun control, then we will have a safer country, with fewer shootings. According to a study done by the University of Wisconsin and Bowling Green State University between 2005-2007, the number of police officers who “were convicted of firearms violations” was convicted “at a.0002% annual rate” (Fund).
Gun rights are the source of much controversy in today’s society. People have been skeptic after the multiple shootings that happened in the past few years. Recently, the NRA has been under constant threat by Congress. Background checks are not effective as planned. In order to keep the gun rights, changes need to be made in order to prevent gun control from being created.
