Many high schools across the country have brought much attention to the idea of giving random drug tests to students in high school. The newfound interest in student drug testing may be as a result of recent polls, which have shown an increase in drug use among high school students. Many teachers, parents, and members of school comities are for the drug testing, while most students and some parents feel that this would be a violation of students rights as Americans, which is true.
A basic argument for the anti drug testing is the simple fact that random drug testing in schools would be an invasion of privacy. The fourth amendment to our constitution which states “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.” was put in place to protect citizens of this country against policies like the random drug tests. Without probable cause there is no need to do random drug tests, what happens to those children who have tried a drug such as “pot” and not liked it. According to Aristotle, Oedipus in Sophocles's play, Oedipus the King, would be considered a tragic hero. Oedipus is considered a tragic hero not only because he made the mistake of killing Laius, because he ends up exiling himself from his own city. At the end of Sophocles’s play Oedipus eventually reaches an all time low. This downfall is caused by him discovering what negative things he has done to his family and to his city. In the fall of 1991, respondent James Acton, then a seventh-grader, signed up to play football at one of the District's grade schools. He was denied participation because he and his parents refused to sign the testing consent forms. The Actons filled suit on the grounds that it violated the Fourth Amendment right to be free from unreasonable searches and seizures. The federal district court ruled in the school district's favor, but the Ninth Circuit Court of Appeals reversed the decision, stating that although the district had laid the foundation for a drug policy, the interest was not so compelling as to justify a random testing program. The time between the 1980's and 1990's America saw a dramatic increase in drug use which spread through nearly every community in the nation. Drugs had not previously been a major problem in Vernonia schools. In the mid-to-late 1980's, however, teachers and administrators observed an increase in drug use. Students began to speak out about their attraction to the drug culture, and boasted that there was nothing the school could do about it.
Instead of using the aunt as a way to warn her daughter of the consequences of having sex they may have warned her of men and the situations that girls may be in if they do not know some men’s intentions. The mother tells Kingston “Now that you have started to menstruate, what happened to her could happen to you. Don’t humiliate us” (Kingston 794). This statement leads us to believe that since the daughter is now considered a woman she has the possibility to shame her family, instead of a warning to protect her virtue it’s a warning to not disgrace the family. The man in the story may very likely have raped her and left her to deal with the consequences. Throughout the play, there are many examples that support the argument that Oedipus is a tragic hero. By definition, a tragic hero is “a great or virtuous character in a dramatic tragedy who is destined for downfall, suffering, or defeat”. Oedipus is a concerned and loving king whose people trust him explicitly. However, throughout the play, he makes choices that put him in bad situations. The play tells the story of Oedipus' journey to try and uncover the mystery of Laius' murder, as told by the oracle. Throughout his journey, he commits horrible crimes, and destroys both himself and his life. Oedipus also drags innocent people down with him. Oedipus is a tragic hero because of his fatal flaws, he was born of noble birth, he showed excessive pride and he became more self aware.
While employment screening in the healthcare sector is decidedly standard, the law does often not require drug and alcohol testing. Substance abuse is one of the leading causes of disciplinary action against a nursing license in the U.S. Random drug screenings are used to detect the use of unapproved or illegal drugs for the purpose of upholding patient safety (National Council of State Boards of Nursing, 2006). The American Nurses Association (ANA) estimates that six to eight percent of nurses use alcohol or drugs to a degree that would impair professional judgment (National Council of State Boards of Nursing, 2011). Approximately one-third of the one percent of actively licensed nurses are disciplined each year for their substance misconduct (Kenward, 2008). Protecting patients from unsafe practices and personnel is the primary responsibility of each supervisory board of nursing. However, the fear of punishment from the board or termination keeps many nurses unwilling to come forward (Maher-Brisen 2007). The purpose of this paper is to discuss the viability of mandating random drug testing for nurses and other health professionals. The objective of this would be to address the rooted issues of substance abuse and decrease the risk of harm to patients under the healthcare provider’s care.
In an effort to make drug testing for employees of the federal government more accurate, to deter false positives and false negatives it has been suggested to use alternative methods of testing. Legal Challenges. When discussing the use of drug testing at the work place for pre-employment screening or on the job testing, we must consider the legal and ethical implications. Those who are in favor of drug testing claim that the testing itself acts as a deterrent in the use of illegal drugs and will also detect the use of illegal drugs which could impair employees resulting in injuries, accidents, lost productivity and ultimately liability concerns. Those in favor also refer to federal laws such as the Controlled Substances Act and take a zero tolerance approach to their employment policy. On the other hand those who argue against drug testing claim ethical violations of privacy and in some cases seek protection under state and federal laws such as the Americans with Disabilities Act, not always successfully. In the case of Raytheon v. Hernandez, the employee sought protection under the Americans with Disabilities Act which “prohibits discrimination against individuals with a drug addiction, although it permits an employer to act against an employer because of current drug abuse” (Witlin 2004). There is also a trend in the United States for the decriminalization of marijuana for personal and/or medical use which creates conflicts for employers. Employers have the responsibility to interpret both federal and state laws when determining their stance and policies when it comes to drug testing at the work place.
Two of the minor tragic flaws that lead to Oedipus downfall were his arrogance and short temper. Trough out the book we are able to see how Oedipus humiliates and gets into arguments with the people that telling him the truth about his real parents and that are trying to help him to find the “unknown”
It is clear to see that Oedipus is an impulsive and passionate man, which causes Oedipus to fulfill the prophecy that haunts him. He flees the kingdom of Corinthian in order to avoid his fate. Along his journey he comes to a crossroad that is blocked by a chariot, and “in a fit of anger” Oedipus kills the father he never knew (Meyer 1422). Oedipus’ anger causes him to kill the father he never knew and all the men in the entourage. Oedipus’ cannot control his temper and this personality flaw leads him to his fate.
Oedipus demonstrates that he is not a purely evil character by fleeing his home town for safety of others, taking care of his city and accepting responsibility for his actions. Once Oedipus has grown to be a young man he is told that he is to kill his father and sleep with his mother because it is his fate. As a result “I [Oedipus] herd and fled” to Thebes so he can prevent those actions from occurring (822). Oedipus runs away from his fate to help himself out as well as his family. He does not want to kill his father; therefore, he runs away from his fate for the safety of his father. This shows that he is not a purely evil character because he is saving a life and looking after others besides himself. However, running from what he believes is his fate causes him to run into his real fate which leads to his downfall as a leader. The tragic hero is a person of greatness, and noble stature who usually contributes to their own downfall. Oedipus has greatness and noble stature; he’s sublime, in the way that he cares for his people. What leads to his own downfall is his own pride, which came out when he solved the riddle of the Sphinx and was praised by marrying the queen of Thebes, making him feel untouchable, “Here I am myself- you all know me, the world knows my fame: I am Oedipus. (7-9)” His almightiness caused him to feel obligation into saving his city, causing his rejection of reality, thus causing mistakes throughout the play. The prestige he has causes him to find the killer himself, because no other man other than himself can fix this problem causing a quarrel with Creon and Tiresias. Instead of helping, he ruins himself by cursing the killer, which is his own self saying,” I’ll rid us of this corruption. Whoever killed the king may decide to kill me too,” (157-158). Also he denies what Tiresias is telling him, which is the truth, but Oedipus insults him by calling his prophecies “riddles, murk and darkness. (500)” “Here I am myself- you all know me, the world knows my fame: I am Oedipus. The ethics of drug testing has become an increased concern for many companies in the recent years. More companies are beginning to use it and more people are starting more to have problems with it. The tests are now more than ever seen as a way to stop the problems of drug abuse in the workplace. This brings up a very large question. Is drug testing an ethical way to decide employee drug use? It is also very hard to decide if the test is an invasion of employee privacy. “The ethical status of workplace drug testing can be expressed as a question of competing interests, between the employer’s right to use testing to reduce drug related harms and maximize profits, over against the employee’s right to privacy, particularly with regard to drug use which occurs outside the workplace.” (Cranford 2) The rights of the employee have to be considered. The Supreme Court case, Griswold vs. Connecticut outlines the idea that every person is entitled to a privacy zone. However this definition covers privacy and protection from government. To work productively especially when the work may be physical it is nearly impossible to keep one’s privacy. The relationship between employer and employee is based on a contract. The employee provides work for the employer and in return he is paid. If the employee cannot provide services because of problems such as drug abuse, then he is violating the contract. Employers have the right to know many things about their employees.
While his intentions were well meaning in the beginning, Oedipus finds himself weighed down by his own flaws. Tragically his flaws cause him to lose focus of his true objectives and damn himself to a life of misery. The tale of Oedipus depicts his rapid descent from Oedipus, savior and king of Thebes to Oedipus Tyrannus the man who slew his father and married his mother. Since Oedipus has so many tragic flaws there is a plethora to choose from. However, if Oedipus’s tragic traits could be described with two words it would be arrogant and imperceptive. First, Oedipus is arrogant. Additionally, Oedipus is imperceptive.
High school students are leaders to younger kids and many others in their community. As a leader these student must show others what good character is like, but instead they are destroying their lives by doing drugs. In the past decade the drug use among high school students is on the rise once again. With the internet, their exposure to drugs is much greater. High school students are convinced that they are able to get away with using drugs. These drug addicts soon influence other students into doing the drugs because there isn’t a rule preventing drug use. In order to protect these student’s future, drug tests must be enforced among all students ensuring a safe environment for students to learn successfully. Allowing random drug testing in high schools will shy away students from trying these harmful drugs. The stop of drug use among high school students is crucial because drugs prevents student from learning leading them to dropping out of high school. Students that become overwhelmed by these harmful drugs will ruin their lives forever, but if steered in the right direction they can be saved.
Mandatory and Random drug testing in schools are being more used today in our society. Mandatory drug testing is a test to show the school and the government about the well being of us teenagers.
