My area of interest is in felonies committed as a result of mental illness, and whether or not mental illness is the true reason the crime was carried out. I chose this because I have always been fascinated with crimes in general and the way mental illness is being perceived in criminals. It was always interesting for me to wonder how someone could bring themselves to commit horrendous crimes such as murder and rape. I also wanted to become a defense attorney when I become older, and I’ve noticed out of the cases I’ve read or watched, many lawyers claim mental illness as the reason for their client's crime, in order to get a lighter sentence, or, not to go to jail at all. Prior to taking this course, I generally believed that people were rightly in prison due to their actions. Now, I have become aware of the discrepancies and flaws within the Criminal Justice system. One of the biggest discrepancies aside from the imprisonment rate between black and white men, is mental illness. Something I wished we covered more in class. The conversation about mental illness is one that we are just recently beginning to have. For quite a while, mental illness was not something people talked about publicly. This conversation has a shorter history in American prisons. Throughout the semester I have read articles regarding the Criminal Justice system and mental illness in the United States. Below I will attempt to describe how the Criminal Justice system fails when they are encountered by people with mental illnesses.
The issue of executing mentally ill criminals has been widely debated among the public. They debate on whether it is right or wrong to execute a person who does not possess the capacity to think correctly. The mental illness is a disease that destroys a person’s memory, emotion, and prevent one or more function of the mind running properly. The disease affects the way a person thinks, feels, behaves and relates to others.When a person is severely mentally ill, his/ her ability to appreciate reality lack so they aspire to do stuff that is meaningless. The sickness is triggered by an amalgamation of genetic, and environmental factors not a personal imperfection. On the death penalty website, Scott Panetti who killed his mother in-law and father-in-law reports that since 1983, over 60 people with mental illness or retardation have been executed in the United States (Panetti). The American Civil Liberties Union says that it is unconstitutional to execute someone who suffered from an earnest mental illness (ACLU).Some people apply the term crazy or mad to describe a person who suffers from astringent psychological disorders because a mad person look different than a mundane human being. The time has come for us to accept the fact that executing mentally ill offenders is not beneficial to society for many reasons. Although some mentally ill criminals have violated the law, we need to sustain a federal law that mentally ill criminals should not be put to death.

The insanity plea, or the “irresistible impulse” defense, described by Martin (1998) as “a plea that defendants are not guilty because they lacked the mental capacity to realize that they committed a wrong or appreciate why it was wrong.” Remains a very controversial within the judicial system, with many believing that the defense attempts to fake a purportedly guilty man’s insanity, more often to make sure the defendant gets a less harsh conviction or the possibility of an acquittal. While the plea is truly helpful to many who suffer from mental illness, many who do not suffer from illness try to use it as a get-out of-jail-free card.

This essay intends to address the role that state agencies, both within the Criminal Justice System (CJS) and more broadly the institutions of education, employment and health, play in supporting and implementing diversionary programs for offenders with mental health problems. Mental health is clearly one of the most critical issues facing the Australian and New South Wales (NSW) CJS with research indicating that offenders with mental health problems constitute the majority of those within the prison system. The current strategies for diversion will be critically evaluated in order to determine their effectiveness with regard to the delivery and production of justice, cultural sensitivity for Indigenous Australians will also be considered. The social construction of mental illness and the associated process of stigmatisation of this particular group will be explored in conjunction to explain why society still fails to prevent the mass entry of people with mental health issues into the traditional CJS.
Literature Analysis and Research Proposal of the Correlation between Mental Illness and Violence and Crime
The stereotype that goes hand in hand with mental illness that though seems to have improved over the years is still pervasive. Teplin, Abram & McClelland (1994) state that people in general, believe that people with mental illness are more likely to commit violent crime with those without mental illness. In their study they seek to find evidence to that statement – to learn if having a mental illness increases the likeliness of violent crime and recidivism after release from prison. This author seeks to discover the same using similar data to learn if there is a connection between violent crime and mental illness.
As a correctional officer, I have seen my share of the mentally ill serving time in prison. One case in particular was that of a woman in her mid 30's. This woman suffered from autism and could not form words well. On occasion she could hold a small conversation but had the language skills of a child. Usually, when it came time for lockdown she would refuse to go in her cell because she was afraid to be alone. When forced she would become violent. I saw this woman break a microwave in half as well as the officer;s computer. Having this knowledge allows me to develop the opinion that neuroscience does have a place in the criminal justice system and should in fact be considered more when considering placement. The main cause of mental illness has been confusing because there are multiple components of causes with various correlates. In order to make clear of this confusion, the present essay explores the causes of mental illness primarily found inside the individual, outside the individual and is a combination of the two.
