Occasionally it is seen that substantial fragments of a song are used in other songwriters’ original work. If the section that is used is significant enough, there would be another type of license required from the copyright owner of the song and master recording which would yet again generate money. Publishers started the work of publishing in the music industry with printing sheet music and scores. Publishing is still practiced in the form of physical prints and online sheet musics or lead sheets, and songbooks. When a song is recorded and fixed into — typically — a compact disk, there is money paid to the copyright owner. For every single copy of it, regardless of it being sold or not, the copyright owner will get an amount of money. The money generated through this method gets the term: “Mechanical Royalty”. Mechanical royalties can be split between the publisher and the songwriter or composer according to the deal that is made in the contract. Some damages can barely be recovered as it could be about more than just cash loss for the copyright owner and involve other areas of its interest such as reputation and credibility in the music industry and market. Copyright protection bodies will take part in protecting the rights of the publishers and songwriters if the material is from one of the members, as it has taken place before by Warner Music against YouTube for instance. Such cases could be brought to court and the owners of copyright could claim losses and damages; however, it is tremendously money and time consuming considering publishers and songwriters are in the music industry to serve their audience with their music and not to take part in legal quarrels. As a remedy to the countless copyright infringement cases, the only action that I believe will come with positive outcome more than side-effects would be to raise awareness through legal and communal campaigns about different aspects of such actions. The music industry should focus more on methods and ways to explain the true value of the work of a songwriter, publisher or a recording company to the general public.
