Statement of Facts Our client, Matty Gustafson, is seeking information on whether or not our firm would be successful in moving for summary judgment in a case brought against her by Donna Whipple. Ms. Whipple has brought a claim under Minnesota Statutes Annotated § 347.22 (Westlaw Nov. 27, 2017), which deals with a dog attacking or injuring another party that is not an owner of the dog. The relevant are outlined below: Matty Gustafson lives on forty acres of thickly wooded land in Northern Minnesota. Besides her own home, Ms. Gustafson owns a cottage on her property that she rents out to Hank Johnston. Mr. Johnston is the son to an old college friend of Ms. Gustafson, and she rented the place out both as a favor to Mr. Johnston’s mother, and so Mr. Johnston would have an appropriate living condition for his two large, Alaskan Malamute dogs. …show more content…

The sled was pulled by Hank Johnston’s two Alaskan malamute dogs. Both women testified that nobody drives the sled, and that instead, the dogs pull it. Matty testified that anybody could have control of the dogs, and tell them to stop when necessary. Furthermore, Matty also stated that based on the dogs’ training, the dogs knew to wait until both women were on the sled to leave, and knowing to leave without either woman commanding them to. While out sledding, Matty and Donna heard a loud cracking noise, which was presumed to possibly be a tree limb cracking. Donna and Matty leaned into the noise before the sled tipped over, and both parties were flung from the sled. Neither party had a chance to tell the dogs to stop before the accident. While Matty only suffered a few minor bruises, Donna ended up hitting a tree, which led to multiple injuries and a few nights stay in the
