People who are convicted with HIV their character becomes crucial to safety and well being HIV continues to increase fear, discrimination, and not having the chance to successful treatment. Inmates who have HIV are a risk to all inmates because other inmates are not aware of who they are surrounded with and they do not know what objects were used with possible HIV inmates.

HIPAA requires for patients medical information to be private at all time. Later in 1999, inmates health information as not under protection in HIPAA until the Department of Health and Human Services (HHS) revised the aspect and health information is now protected under the final rule. Correctional services should include HIPAA because inmates do have the right to sue the correctional institution since it is a violation of their right. The three rules correctional institution follow are: transmission of information when reporting health care, request of health care to review in order to secure it, and payment of health care. A study from the Federal Bureau of Prisons reported 47% of homosexual activity between ages 19 to 35 years old have a greater risk of HIV when entering prison due to unavailability of condoms. In fact a major issue and conflict in correctional facilities is having condom availability. Many U.S. prison administrators do not allow the release of condoms to inmates because since sexual activity is a punishable crime in prison, the behavior will increase. A second reason why they are not allowed is because condoms can be used as a container for hiding drugs or illegal items that inmates can swallow and later retrieve. The numbering of homosexual HIV rape is difficult to estimate. Another study from the Federal Bureau of Prisons reported 9-20% of new or homosexual inmates were victims of rape. Inmates who report rape face more suffering and bad injuries. Other common incidents that occur are fights that involve biting and bleeding transmitting HIV risks.
