Drug Research Drugs have been one of the largest epidemics that has effected America as far as its criminal justice system. Drugs continue to take a toll on many individuals lives and make it difficult for the government to do their job, especially police officers and policy makers. Drugs mainly play a large role when it comes to mass incarceration, sex offenses, school-to-prison pipeline, and gun violence. Drugs effect people and their decisions within their lives which leads to drug related crimes, and teens being misled. According to recent statistical figures in the article Drugs and Sexual Assault, “a United States study that 25 % of women have been sexually assaulted during their lifetime.” Also, the American Academy of Forensic Sciences found that one third of sexual assault cases happen when alcohol is involved. Alcohol being involved in the situation can contribute to misinterpretation, and friendly signals can be seen as sexual invitations. Alcohol is not the only substance involved when it comes to sexual assault encounters. Different forms of drugs have become associated with sexual assault, and these drugs are all similar because of the effects it has on the assailant. “They cause rapid onset of action and ability to induce sedation and make it difficult for that individual to recall events after ingestion of the drug.” There are seven drugs associated with sexual assault: roofies, liquid ecstasy, special k, ecstasy, cocaine, marijuana, and brabiturates. The most common substances in association with sexual assault are alcohol, cocaine, and marijuana mainly because these are street drugs. After viewing the documentary: America's War on Drugs - The Prison Industrial Complex, it is clear that the Criminal Justice System is in desperate need of reconstruction and repair with policies such as the mandatory minimum sentencing act which has proven to be unsuccessful and unjust in its efforts to deter 'criminals from committing illegal acts' as seen with the increase of incarcerations of the American people and the devastating effect it has had on those in prison and the family members of those incarcerated.
Mandatory minimums for controlled substances were first implemented in the 1980s as a countermeasure for the hysteria that surrounded drugs in the era (“A Brief History,” 2014). The common belief was that stiff penalties discouraged people from using drugs and enhanced public safety (“A Brief History,” 2014). That theory, however, was proven false and rather than less illegal drug activity, there are simply more people incarcerated. Studies show that over half of federal prisoners currently incarcerated are there on drug charges, a 116 percent percentage rise since 1970 (Miles, 2014). One policy one could examine to see its implications on incarceration rates in the United States is the “War on Drugs.” This war has taken place since the Nixon administration in the 1970s, and aims to eliminate the possession, importation, and solicitation of illegal substances. This war has multiple fronts in which people are currently fighting, but the domestic theatre of war is a culprit for this rise of incarceration rates. Bobo and Thompson examined this phenomenon and found, “rapid increase in incarceration rates can be traced to the "War on Drugs" and associated sentencing practices” (451). The “War on Drugs” can be seen taking place in predominately urban impoverished African-American communities. As a result, more African-Americans are being arrested for drug crimes, whether they be petty possession misdemeanor crimes or more serious felony solicitation of illegal substance crimes. Elliott Currie, a professor in criminology and law, suggests that building more prisons, imposing longer sentences, and harsh punishment will not lower the incarceration rate. In his chapter on “Assessing the Prison Experiment”, he explained that the increase of crime rate is not the sole reason that mass incarceration occurs, it was also because courts and legislature did indeed get ‘tougher” on offenders (Currie 14). Under the circumstance of the war on drugs, which was launched by President Richard Nixon, the incarceration rate and sentence longevity were increased dramatically as Currie discussed in his chapter. Currie also pointed out that the war on drugs had a huge influence on the incarceration rate of African American inmates, “ between 1985 and 1995, the number of black state prison inmates sentenced for drug offences rose by more than 700 percent” (Currie 13). Some of these offenders were sentenced more than ten years without parole, which releases prisoners before the completion of their sentences. The effect of the war on drug policies returned de jure discrimination, denied African Americans justice and undermined the rule of law by altering the criminal justice system in ways that deprive African Americans civil rights and citizenship. The Judiciary Branch of the United States government is responsible for interpreting the law. Those involved with this branch determine the meaning of the laws and decide what to do with those who break them. Because of a drug movement that took place through the 1980s, the courts have severely punished those who break laws associated to drugs; Congress is now trying to step in to change the way the Judiciary Branch is forced to punish such criminals. Congress has been busy the past couple of years evaluating the proper sentencing of those convicted of drug crimes. Many men and women of Congress are joining forces in an attempt to come up with a solution to propose as an amendment. Our elected leaders believe the need for the reform of drug crimes is due because of the number of cases and number of years those convicted are spending in prisons. Because of the drug wars that took place in the United States, the minimum sentence has been set so high today. Drug reform is needed in the United States, and those convicted of drug crimes with improper sentences need to have their sentence reduced. 1
“[The war on drugs] has created a multibillion-dollar black market, enriched organized crime groups and promoted the corruption of government officials throughout the world,” noted Eric Schlosser in his essay, “A People’s Democratic Platform”, which presents a case for decriminalizing controlled substances. Government policies regarding drugs are more focused towards illegalization rather than revitalization. Schlosser identifies a few of the crippling side effects of the current drug policy put in place by the Richard Nixon administration in the 1970s to prohibit drug use and the violence and destruction that ensue from it (Schlosser 3). Ironically, not only is drug use as prevalent as ever, drug-related crime has also become a staple of our society. In fact, the policy of the criminalization of drugs has fostered a steady increase in crime over the past several decades. This research will aim to critically analyze the impact of government statutes regarding drugs on the society as a whole.
The biggest question people ask is if the “war on drugs” was successful. According to the White House Office of National Drug Control Policy (ONDCP), “The goals of the program are to reduce illicit drug use, manufacturing and trafficking, drug-related crime and violence, and drug-related health consequences.” The best way to measure the effectiveness of the “war on drugs” is to focus on these basic questions; Is drug use down? Is crime down? and Are drugs less available? Since 1988, drug use by individuals ages 12 and over has remained stable according to the National Household Survey on Drug Abuse (NHSDA). The number of individuals reporting any drug use has increased by approximately 7 million and the number of those who reported drug use in previous months or previous years has remained unchanged. The Organization Monitoring the Future studies drug use, access to drugs, and perspectives towards drugs of junior and senior high school students nationwide. Results of a study conducted in 2005 showed a minor decline in substance abuse by older teens, but drug use among eighth graders stopped remained the same. However, the changes were not statistically significant and ultimately there was no reduction in substance abuse among young students. Sexual assault has been an issue this country and almost every other has faced for decades. Since the 1700s, the term date rape has been around to distinguish between rape by a stranger and rape by an acquaintance. Alcohol and drugs are commonly used in date rapes to make the victim incapacitated and therefore an easier target. There are many drugs out there that are usedto commit date rapes. With almost half of all inmates in U.S. federal prisons serving sentences for drug offenses according to the U.S. Department of Justice (Carson, 2016), efforts taken in the War on Drugs have effectively incarcerated many drug offenders. However, this expensive endeavor has only alienated abusers and, oftentimes, made them into violent criminals as well as furthering their addictions rather than treating them. Smith (personal communication, November 4, 2017), who worked as a counselor in the prison system for many years, explains that drugs are still readily available in prison and locking abusers away does nothing to separate them from the cause of their addictions. The drug epidemics seen on the streets reach into the prisons as well.
Not only has the drug war failed to reduce violent and property crime, but, by shifting criminal justice resources (the police, courts, prisons, probation officers, etc.) away from directly fighting such crime, the drug war has put citizens’ lives and property at greater risk, Benson and Rasmussen contend. “Getting tough on drugs inevitably translates into getting soft on nondrug crime,” they write. “When a decision is made to wage a ‘war on drugs,’ other things that criminal justice resources might have to be sacrificed.” To support this conclusion, Benson and Rasmussen compare data on drug law enforcement and crime trends between states, and debunk numerous misconceptions about drug use and criminality.
