In this essay, I argue that pornography is a symptom of a larger issue in our society and that it should be censored and regulated by the state by acting against those who depict degrading and violence of women in pornography because it contributes to the larger problem of women's inequality by portraying women in a dehumanized way that damages their liberty and their fight for equality. I will begin this essay by first describing what negative and positive liberties are and how pornography is in conflict with both concepts. I will also evaluate these points and solidify my position. Catherine MacKinnon likens pornographers to those who have participated in Nazi March in Skokie, where a group of people abused their right to free speech and paraded around town, essentially preaching hate (p.959). Women like victims of that march are basically told to respect and tolerate freedom of expression of the pornographers while their own freedom and liberty and are being destroyed. The positions of the victims are disregarded in the name of free speech as they are told to look away if they don't like what they see (p.956). A review of the contemporary research on the negative effects of pornography is replete of scholarly and anecdotal evidence and opinion about the damages associated with viewing it. But the evidence is limited when it comes to criticism of mainstream media’s damages to certain groups, particularly young women with their romantic comedies.
Pornography is considered by many to be an unwelcome and distasteful part of our society. However, I argue that it is necessary to voice the unpopular viewpoints, under the Constitution. This paper is a defense of pornography as a constitutional right of free expression, under the First Amendment of the Bill of Rights. In illustrating this argument, I will first define pornography as a concept, and then address central arguments in favor of pornography remaining legal and relatively unregulated – such as the development of the pornography debate throughout modern US law, and how activist groups address the censorship of adult entertainment.
In her essay “Let’s Put Pornography Back in the Closet,” Susan Brownmiller, a prominent feminist activist, argues that pornography should not be protected under the First Amendment (59). Her position is based on the belief that pornography is degrading and abusive towards women (Brownmiller 59). She introduces the reader to the U.S. Constitution’s First Amendment, and explains how it relates to her beliefs on censoring pornographic material (Brownmiller 58). In addition, she provides examples of First Amendment controversies such as Miller v. California and James Joyce’s Ulysses to explain how the law created a system to define pornographic material (Brownmiller 58). She described the system that used a three-part test as confusing (Brownmiller 58). Regardless of whether or not the First Amendment was intended to protect obscenities, she and many others believe that the legislatures should have the final say in the decision of creating and publishing pornography (Brownmiller 60).
Again, there are different ideas of what is considered pornographic from artwork, movies, and books. While one may look at a painting that depicts nude forms or read a book that includes sexual acts may not see this as a form of pornography while others would find it morally offensive. Feminist would argue that the morality of porn is it is degrading and humiliating to those involved, not of its sexual nature. Their concern is that it promotes sexism and violence against women or children. “What is objectionable about pornography…is its abusive and degrading portrayal of females and female sexuality, not its content or explicitness” (Rodgerson & Wilson, 1994) However, others may feel that it is sexually liberating and in no way degrading to those involved. Those women feel in control of their sexuality and choose to participate in acts as a way of expressing themselves while feeling it has no barring on their moral character. From the forms of archive come the social implications of pornography. This will be examined through the 1986 Meese Commission in the United States of America into the pornographic industry. Langton points out that pornographic words and images, like utterances in general, are a form of social action. The literal content (locutionary force) of a pornographic work may be the depiction of a particular sexual act, and this may have the effect (perlocutionary force) of arousing particular viewers and shaping their attitudes toward women. The combination of liberal and radical feminism is not one that often comes to the mind, but it can be useful to consult various viewpoints when tackling complex issues. Despite drastic differences between them, these two views of feminism do hold some similarities with each other by virtue of their common goal (when that goal is simplified to simply equality of the genders). In this paper I will be outlining some of the basic similarities and differences between these two ideologies of feminism and I may not cover all of the connections and gaps between the two for the sake of length.
