From 1787-1790 the development of the American Constitution was a battle between two opposing political philosophies. America’s best political minds gathered in Philadelphia and other cities in the Northeast in order to find common ground in a governmental structure. The Federalists and the Anti-Federalists had both some political thoughts that agreed as well as some political thoughts that disagreed. However, both parties would compromise and ultimately come together.
Each one came from eleven different colonies to change the Articles of Confederation because it wasn't working out. The states had too much power and the national government have little to none of the power. There was no army or taxes. They needed to change it so the nation could stay together and not fall apart. On September 28, 1787 Confederation Congress sent out the draft of the Constitution. This was the first time in history for the people to debate, discuss, and decide with a vote for how they wanted to be governed. There were two groups that debated the thought of the Constitution. They were called Federalists and anti-Federalists.
The Federalists and Anti-federalists shared the common beliefs of John Locke’s Enlightenment ideals such as all men were born equal (even though most of these men owned slaves), but their opinions about the role of government were different. Both parties had their own visions of how a new government would function and how the Constitution would support the government being proposed. Many argued that the Articles of Confederation had created a very weak government with very limited power. Specifically, the amount of power or the absence of power of a central government was the main disagreement between the Federalists and Anti-federalists. As a result, the Federalists and Anti-federalists argued about the ratification of a new constitution, which would give the central government more power.
Before the Constitution was drafted, the United States’ budding government, now independent from Great Britain, acted under a dysfunctional constitution called the Articles of Confederation. Although this constitution kept the new nation running, there were still flaws that needed to be fixed. The Articles of Confederation lacked a developed executive or judicial branch and a method for the main government to collect taxes from state governments, according to the background essay of the DBQ Packet. The year of 1776 was a time of revolution, independence, and patriotism. American colonists had severed their umbilical cord to the Mother Country and declared themselves “Free and Independent States”.1 The chains of monarchy had been thrown off and a new government was formed. Shying away from a totalitarian government, the Second Continental Congress drafted a document called the Articles of Confederation which established a loose union of the states. It was an attempt at self-government that ended in failure. The Articles of Confederation had many defects which included a weak central government that lacked the power to tax, regulate trade, required equal representation and a unanimous vote to amend the Articles, and had only a legislative branch. As a result the United States lacked respect from foreign countries. These flaws were so severe that a new government had to be drafted and as a result the Constitution was born. This document remedied the weak points of the federal government and created one that was strong and fair, yet still governed by the people.
When the United States declared itself a sovereign nation, the Articles of Confederation were drafted to serve as the nations first Constitution.Under these Articles, the states held most of the power; but due to an almost absent centralized government, colonists were ill-equipped to deal with such practices as regulating trade both between states and internationally, levying taxes, solving inter-state disputes, negotiating with foreign nations, and most importantly enforcing laws under the current notion of "Congress". Some people have always wondered whether the making of Constitution of the United States was, in fact, supposed to happen at the Constitutional Convention or if it was even supposed to be drawn up in the way it was. In this essay, I will summarize to different views on what went on at the Constitutional Convention and how the Constitution of the United States come about. I want to emphasize that none of these views or theories discussed in this essay are my own. The convention that is referred to was held in Philadelphia, Pennsylvania. It began In May of 1787.
First, the formation of the Articles of Confederation was the first constitution in the United States. The Articles of Confederation was not the best constitution out there since congress could make decisions, but had no power to enforce them. After the American Revolution, each of the original 13 colonies operated under its own rules of government. Most states were against any form of centralized rule from the government. They feared that what happened in England would happen again. They decided to write the Articles of Confederation, which was ratified in 1781. It was not effective and it led to many problems.
Eric Foner claims the definition of Federalism refers to the relationship between the national government and the states. Unlike the Constitution, the Articles of Confederation came with many weaknesses. Some provided by our powerpoint include that the Federal government had no power to make the states obey the Articles and laws that were passed by the legislature. The states also had the power to tax, and the opportunity to print their own money. Our powerpoint focuses on the $10 million Congress owed to other countries, as well as the $40 million it owed to the American veterans. The Constitution differed. Foner states that not only did the Constitution enhance national authority, but it also permitted Congress to levy taxes, conduct commerce, confirm war, deal with the foreign nations and Indians, and rent and help the “general welfare”. According to the powerpoint, Federalists focused on the weaknesses of the Articles of Confederation.
After winning the Revolutionary War and sovereign control of their home country from the British, Americans now had to deal with a new authoritative issue: who was to rule at home? In the wake of this massive authoritative usurpation, there were two primary views of how the new American government should function. Whereas part of the nation believed that a strong, central government would be the most beneficial for the preservation of the Union, others saw a Confederation of sovereign state governments as an option more supportive of the liberties American’s fought so hard for in the Revolution. Those in favor of a central government, the Federalists, thought this form of government was necessary to ensure national stability, unity and influence concerning foreign perception. Contrastingly, Anti-Federalists saw this stronger form of government as potentially oppressive and eerily similar to the authority’s tendencies of the British government they had just fought to remove. However, through the final ratification of the Constitution, new laws favoring state’s rights and the election at the turn of the century, one can say that the Anti-Federalist view of America prevails despite making some concessions in an effort to preserve the Union.
