After fulfilling the goal of separating from Britain, America’s next big goal involved the establishment of a stable ground in politics. This meant American would have to take various steps in the government in order to build a steady foundation. America decided its first step would be to create a constitution that would establish the government’s authority over the states. Before American’s official declaration as an independent nation, the Continental Congress decided to write the Articles of Confederation. It served as America’s first attempt at a constitution, and it eventually became ratified by the colonies in 1781, 4 years after it initially became adopted.

The delegates finally came to the decision to create a new and improved set of principles, which would become known as the United States Constitution. This refined version provided the government with a more defined and stronger rule by allowing it to finally regulate taxes, control commerce, and draft troops. Plus, unlike the Articles of Confederation, it called for the creation of an executive branch in government, which allowed for laws to be more heavily enforced. However, in order to insure that one branch did not gain more power than another, check and balances became established as well, and it essentially divided power between all three branches.
Although the United States Constitution served as an evident upgrade from the Articles of Confederation, overall, it still received a rather mixed reaction. However, despite some backlash, it still subsequently became ratified a year later.

With these different balances to control the powers throughout the new government, the problem of tyranny wasn’t as such of a problem as it was when the Articles of Confederation were in place. The states were now represented justly, the national and state levels of government fairly empowered, and the three branches within the national government were balanced. How could the government be designed to protect the unalienable individual rights? Their first attempt at solving this issue was the Articles of Confederation, which was a failure for the most part, but not completely. After the failure of the articles, the state delegates tried to revise the articles, but instead, constructed the Constitution. There were so many changes made and very little remained the same. The thirteen states formed a Confederation referred to as the “league of friendship” in order to find a solution for common problems such as foreign affairs.
The year of 1776 was a time of revolution, independence, and patriotism. American colonists had severed their umbilical cord to the Mother Country and declared themselves “Free and Independent States”.1 The chains of monarchy had been thrown off and a new government was formed. Shying away from a totalitarian government, the Second Continental Congress drafted a document called the Articles of Confederation which established a loose union of the states. It was an attempt at self-government that ended in failure. The Articles of Confederation had many defects which included a weak central government that lacked the power to tax, regulate trade, required equal representation and a unanimous vote to amend the Articles, and had only a legislative branch. As a result the United States lacked respect from foreign countries. These flaws were so severe that a new government had to be drafted and as a result the Constitution was born. This document remedied the weak points of the federal government and created one that was strong and fair, yet still governed by the people.
The Articles of Confederation was America’s first constitution. The Articles of Confederation failed to create a strong central government, however. With the demise of the states in sight, the need for a stronger and more structured central government became apparent. An invitation was sent to all thirteen states in February 1787 by the Confederation Congress to resolve the matter. The events that took place over the next several months would create the United States Constitution. Going down in history as a revolutionary form of government, the U.S. Constitution would give life to a country that is still running strong over 200 years later.
September 17, 1787, Philadelphia, Pennsylvania; during the heat of summer, in a stuffy assembly room of Independence Hall, a group of delegates gathered. After four months of closed-door quorums, a four page, hand written document was signed by thirty-nine attendees of the Constitutional Convention. This document, has come to be considered, by many, the framework to the greatest form of government every known; the Constitution of the United States. One of the first of its kind, the Constitution laid out the frame work for the government we know today. A government of the people, by the people, and for the people; constructed of three branches; each branch charged with their own responsibilities. Article one established the Congress or Legislative branch, which would be charged with legislative powers. Article two created the Executive branch, providing chief executive powers to a president, who would act in the capacity of Commander in Chief of the Country’s military forces. The President of the United States also acts as head of state to foreign nations and may establish treaties and foreign policies. Additionally, the President and the departments within the Executive branch were established as the arm of government that is responsible for implementing and enforcing the laws written by Congress. Thirdly, under Article three of the Constitution, the Judicial branch was established, and consequently afforded the duty of interpreting the laws, determining the constitutionality of the laws, and apply it to individual cases. The Articles of Confederation were approved by Congress on November 15, 1777 and ratified by the states on March 1, 1781. It was a modest attempt by a new country to unite itself and form a national government. The Articles set up a Confederation that gave most of the power to the states. Many problems arose and so a new Constitution was written in 1787 in Independence Hall. The new Constitution called for a much more unified government with a lot more power.
In comparing the Articles of Confederation with the U.S constitution that was produced by the federal convention in 1787, it is important to note that the U.S operated under both documents. During March 1, 1781, the Articles of Confederation went into effect when it was ratified by Maryland. However, the U.S constitution replaced the Articles of Confederation as soon as it was ratified on June 21, 1788 by New Hampshire. The main difference between the Articles of Confederations and the U.S Constitution is that the constitution didn’t force the laws, but established the why of the constitution. In establishing the why, it warranted the farmers to work on the government being better than the Articles of Confederations.

In addition to this, the thirteen states acted as separate nations and the national government had little control over them.
The Constitution bestowed essential powers to the nation, without which, America would crumble. Under this newly created document, three different branches of government were created: the judiciary, the legislative, and the executive. The legislative was composed of Congress, which now had the power to create a military, control interstate and international commerce, and create laws. The United States government was founded on a written set of principles known as the Constitution. There have only been 17 amendments, or changes, since ratification. While the United States has evolved with time the role and function of the government, and the way the government guarantees civil rights and liberties, has also evolved. These changes have resulted from changing or broadening of the interpretation of the constitution. Although the core of the constitution has not changed, it has expanded and its interpretation has changed to keep up with societal demands.
Before the adoption of the United States Constitution, the U.S. was governed by the Articles of Confederation. These articles stated that almost every function of the government was chartered by the legislature known as Congress. There was no distinction between legislative or executive powers. This was a major shortcoming in how the United States was governed as many leaders became dissatisfied with how the government was structured by the Articles of Confederation. They felt that the government was too weak to effectively deal with the upcoming challenges. In 1787, an agreement was made by delegates at the Constitutional Convention that a national judiciary needed to be established. This agreement became known as The Constitution of the United States, which explicitly granted certain powers to each of the three branches of the federal government, while reserving other powers exclusively to the states or to the people as individuals. The move from the Articles of Confederation to the United States Constitution caused several people to be unhappy. For 6 years the Articles weakened the United States in more ways than one. In the summer of 1787 a new form of government was created, a radical move from the Articles of Confederation.
A constitution is the system of fundamental principles according to which a nation is governed. Our founding fathers created the US Constitution to set specific standards for our country. We must ask ourselves why our founding fathers created the Constitution in the first place. America revolted against the British due to their monarchy form of government. After the American Revolution, each of the original 13 colonies operated under its own rules of government. Most states were against any form of centralized rule from the government. They feared that what happened in England would happen again. They decided to write the Articles of Confederation, which was ratified in 1781. It was not effective and it led to many problems. The central government could not regulate commerce between states, deal with foreign governments or settle disputes. The country was falling apart at its seams.
