The premise of this research paper is to compare the similarities and differences in the criminal justice systems of the two nations Saudi Arabia and Japan. How they deal with the criminal offenses of murder, the distribution of illegal drugs and family violence. The next area Of concern will be the similarities of their criminal-justice systems, and their methods of enforcement, besides incarceration. The first country to be examined will be Saudi Arabia. The new Saudi Arabia dates back to 1926. However, the country is still governed by Shari’s law (the Islamic legal system). There is no formal constitution. The head of the family, husband/father has the obligation to discipline his family in whatever manner they choose. A female in Saudi is relegated to a less prominent position in their society. Men in Saudi while growing up is taught that abusing any woman is protected by law. Therefore, hitting an unruly woman was a solution to her disobedience. She cannot do anything but tolerate the abuse until she escapes this situation or be killed. This is an old tribal attitude that is ingrained in the man from birth. This draconian attitude still exists today, in the twenty-first century. In 2004, a woman’s husband cut off both of her arms at the elbows because after giving birth to three daughters, he felt like she was disrespecting him by not giving him a son (Deeb, 2011). When a woman marries, she becomes a personal possession of her husband and his family. Legal scholars and the Japanese courts approve of this concept. This particular type of attitude permeates family abuse and a patriarchal system. Domestic violence is widely accepted because it is viewed as “internal problems “and should be kept a secret between the parties involved.
