You are falsely accused for an awful crime, and a trial is occurring about your sentence. A guilty man would be anxious, but, you’re innocent. Also, your lawyer just verified the unfair accusation to everyone in the town, courtroom, defendants, and to the judge with undeniable evidence! The only thing against you is that you’re a black man, but there’s so much affirmation to support your statement of not guilty. However, when things seem to be almost all blue skies, clear water, and sunshine, the people in your town can’t lower their ‘biased standards’ on their racial intolerance, so now the real culprit is running around while the other one is innocent. The purpose of this essay is to compare three very similar cases, the Scottsboro Trials, Brown v. Mississippi, and the fictional trial of Tom Robinson in Harper Lee’s To Kill a Mockingbird; and to prove why the defendant of the third trial never had a chance. Each took place in the rural South in the 1920’s and 30’s and involved the unfair conviction of young black males by all-white juries pressured by the threat of mob violence. Each lacked the evidence sufficient for conviction, most especially for the death penalty. Last, heroes emerged from each trial and made small but solid steps towards equal justice for all.
Today in Maycomb County, there was a trail against a local African American man named “Tom Robinson.” He was accused for raping and beating up a white girl named “Mayella.” His lawyer is “Atticus Finch” is facing off against “Mr. Gilmer” the district attorney. Judge Taylor, appears to be sleeping through out the trial, yet pays attention and tends to chew his cigar. The supposed crime occurred in Mayella’s home, when Tom Robinson went to fix something and then he raped her.

By using only four guilty’s, Lee is able to demonstrate that the word of two white people has a greater effect than that of an African American even though the man who was put up for his life had not harmed, nor had he ever damaged anything he came into contact with.
On March 25 1931 a group of nine boys were charged with raping two girls aboard a train traveling from Paint Rock Alabama across the state’s border. The trial of these boys had become collectively known as the Scottsboro case. Several years later Harper Lee wrote her famous novel To Kill a Mockingbird. In this story a young male Tom Robinson is charged with raping a white female. It is by understanding the parallel between Tom Robinson’s case in To Kill a Mockingbird and the Scottsboro case that can be understood that a fair trial was unlikely and that because of Tom Robinson’s race he was presumed guilty before his trial.
In the 1930’s a plethora of prejudiced persons are present amidst the prominent Scottsboro trials, a seven-year-long case consisting of false rape allegations made against nine black boys from Scottsboro. When citizens fail to acknowledge their own preconceived ideas and look past the prejudice present in society, justice cannot be served. In the Scottsboro case, the court of Alabama disregards the societal issues surrounding racial discrimination and endorses the guilty verdict and conviction of the nine African American boys. One of the major events in Harper Lee’s award-winning novel To Kill a Mockingbird is Tom Robinson’s trial. It is based on the Scottsboro Case that took place in 1931 in Alabama, in which several black men were accused of raping two white women. Both the Scottsboro Boys and Tom Robinson are unfairly judged, however, because of prejudice against colored people. The racial discrimination makes whites’ testimony more believable even when it contradicts itself. The same happens in To Kill a Mockingbird. As we delve deeper into the case and get increasingly closer to the truth, it is quite suprising to see that Mayella Ewell is the true villain rather than a victim. She shall and must bear full responsibility for her actions because she makes the decision to tempt Tom Robinson, gives false testimony in court that directly leads to Tom’s death, and has been well aware of the consequences of her behaviors.
In the courtroom that night it is revealed that the alleged crimes of Tom Robinson, a decent Negro man, most likely did not happen. As Atticus says in his closing argument, "The state has not produced one iota of medical evidence to the effect that the crime Tom Robinson is charged with ever took place. It has relied instead upon the testimony of two witnesses whose evidence has not only been called into serious question on cross-examination, but has been flatly contradicted by the defendant. The defendant is not guilty, but somebody in this courtroom is” (Lee 271). Showing the clear innocence of Tom Robinson due to lack of evidence, Scout thinks that the white jury will do the right thing only to find out that they still, unfairly, accuse him of being guilty. Scout and her brother, Jem, get very upset when they hear the verdict, however, it allows them both to learn the lesson that the county is unfair towards anyone who is not white. The county demonstrates this evil racism due to the social divisions in Maycomb between the whites and the blacks and because the whites see the blacks as unworthy of rights and freedoms. The Scottsboro Trial and the trial of Tom Robinson are almost identical in the forms of bias shown and the accusers that were persecuted. The bias is obvious and is shown throughout both cases, which took place in the same time period. Common parallels are seen through the time period that both trials have taken place in and those who were persecuted and why they were persecuted in the first place. The thought of "All blacks were liars, and all blacks are wrongdoers," was a major part of all of these trails. A white person's word was automatically the truth when it was held up to the credibility of someone whom was black. Both trials were perfect examples of how the people of Alabama were above the law and could do whatever they wanted to the black people and get away with it. In both trials lynch mobs were formed to threaten the black people who were accused. Judge Hornton tried many times to move the case to a different place so that a fair trial could take place and not be interrupted by the racist people. Finally was granted to move the case even though the lynch mobs threatened to kill everyone who was involved in the case if it were to be moved. In this essay the bias and racism in both trials are going to be clarified and compared to each other.
Growing up in a prejudiced environment can cause individuals to develop biased views in regard to both gender and class. This is true in Harper Lee’s novel, To Kill a Mockingbird, where such prejudices are prevalent in the way of life of 1930s Maycomb, Alabama. The novel is centered around the trial of a black man who is accused of raping a white woman. The narrator, a young girl named Scout, is able to get a close up view of the trial because her father is defending Tom Robinson, the defendant. The aura of the town divided by the trial reveals certain people’s prejudices to Scout, giving her a better perspective of her world.
The first “mockingbird” that is featured in the novel is a man named Atticus Finch. Not only is Atticus Finch the sole representative of Maycomb in the legislature, but also he is a brilliant lawyer. In addition, he has a good reputation in both Maycomb’s black and white communities because of his exceptional character. However, his reputation is soon shattered when he is faced with a case in court that affects him personally: he must defend an African American man in court in Maycomb’s segregated society. If Atticus chooses to try defending the man, he will lose his good status in town, since his racist American neighbors will soon disrespect him for treating the African Americans as equal to the Americans, which is highly unacceptable in the United States during the 1930s. In Harper Lee’s fictional novel To Kill A Mockingbird, an African American field hand is falsely accused of raping a white women. Set in the 1930’s in the small town of Monroeville Alabama, Addicus Finch an even handed white attorney tries to shed a light on the injustice of this innocent black man’s conviction. Atticus feels that the justice system should be color blind, and he defends Tom as an innocent man, not a man of color.
Racial prejudice is widespread in the county of Maycomb, and a prime example is the Tom Robinson case. Tom, a black man, was accused of raping Mayella, a white woman. Atticus puts forward all evidence from his witnesses that clearly proves Tom was innocent, Jem even says, ?and we?re gonna win Scout. I don?t see how we can?t? (pg 206), but Tom still received a ?Guilty? verdict. Atticus tried removing the prejudiced thoughts of the jurors by saying, ??the assumption - the evil assumption - that all Negroes lie, that all Negroes are basically immoral beings??. (pg 208). Atticus? saying insinuated the point that all of God?s children were created equal. To the jury, the only important thing was that Tom was black and the accuser was white, he never stood a chance under those conditions. These racial tensions between blacks and whites had made their way into the courtroom, a place where everyone should receive a fair trial no matter what race or colour, but an unjust verdict was reached. The prejudice that was felt towards Tom made him lose all hope of freedom, and as a result, he died upon an escape attempt. Tom was victim of racial prejudice and loss of hope.
In the book, “To Kill a Mockingbird,” a lawyer named Atticus Finch attempts to convince a jury that a Negro should be found innocent in a case of lies and prejudice. The Negro, Tom Robinson, was sent to court because a man, Robert Ewell, accused Tom of raping his daughter, when in fact, he beat his own daughter for trying to kiss Tom. Atticus strives to change the stereotypical minds of the jury by looking past race. Atticus uses ethos, connotation, and a simile to challenge the jury’s pre-existing minds about race.
Hypocrisy is as much a part of Maycomb’s society as church and community spirit. For example, Mrs. Merriweather talks about saving the poor Mruans from Africa, but she thinks black people in her community are a disgrace (p.234). The hypocrisy of this teaching is shown as soon as she mentions the word ‘persecution’. This is due to the fact that she herself is persecuting the black people of Maycomb by not raising an eyebrow at the killing of innocent black men. Furthermore, it is obvious Bob Ewell is abusive to his daughter, Mayella, and that he is the one who violated her, not Tom Robinson (p.178). Since there is such hypocrisy in Maycomb, there are excuses made for whites. The jury probably thinks that if they pronounce Tom innocent the citizens will mock them as they do to Atticus. Harper Lee uses hypocrisy to show how the people of Maycomb are so engulfed in a variety of elements that they unknowingly complete acts of unjustified discrimination.
A small city nestled in the state of Alabama, Maycomb has got its faults, just like any other place in the world, but one of its main faults or (pg.88) “Maycomb's usual disease,” as Atticus calls it in the book is prejudice. Jem and Scout learn a lot about prejudice when a black man named Tom Robinson is accused of raping a white woman named Mayella Ewell and their father, Atticus, is called on to be his lawyer. They realize the hate that people have buried deep within their heart when they see a black man accused of doing something only because of his color. On pg.241, Scout starts understanding this and thinks, “Atticus had used every tool available to free men to save Tom Robinson, but in the secret courts of men's hearts Atticus had no case. Tom was a dead man the minute Mayella Ewell opened her mouth and screamed.” As the case continues, up until the death of Tom Robinson, Jem and Scout learn more and more about prejudice and how the hate that people have towards others causes them to take wrong actions. They also see how unfair it is that a white man can get treated better and think of himself better than a black man only because he was born white.
