The Difference between Classical Criminology and Positivism

February 2, 2015 The criminology that we use today is a mixture between two schools, the classical and the positivist school. The classical school originated from the 18th century, while the positivist school came from the 19th century. With both following two different revolutions that made many scholars think about the way people act and why they act in such ways. The Classical School came after the Enlightenment period, where many people broke away from the Church and started questioning their knowledge. The positivist school followed the scientific revolution, where many believed that one could not explain reality without using some form of science. Richard Dugdale’s study of six generation of the Juke family led him to believe that criminal and antisocial behavior is inherited. Some early positivist approaches examined both the individual behavior and the rates of behavior in society. “Since the 1920’s, the American tradition of criminology has used the positivist technique of analyzing population data and crime rates as well as the systematic study of criminal behavior” (Williams, McShane, 2014, pg. 33). Positivism did not disprove or destroy anything that had been done by the classical theorists, rather it shifted the views from crime to the individual itself. Positivism took a different approach of thinking about criminal behavior towards using the concepts and methods of science. For decades researchers have speculated about the relationship between levels of violence, and societal conditions such as poverty, urbanism, population composition, and family disruption. National and international level research has concluded that each of these factors are related to crime rates and their trends overtime (Avison & Loring, 1986; Lafree, 1999, Lauristen & Carbone-Lopez, 2011). To examine these factors more closely we should recognize that they are the foundation of many criminological theories, both motivational and control, applied to the macro and individual level. Specifically, these include social disorganization theory (Shaw & MCkay, 1942), anomie-strain theory (Merton, 1968), violent subcultural theories (Anderson, 1999), social bond theory (Hirschi, 1969), self-control theory (Gottfredson & Hirschi, 1990), and biosocial perspectives (Gottfredson & Hirschi, 1983).
Criminology as a genre is defined as the scientific study of crime, as well as its causes, law enforcement interaction, criminal behavior, and means of prevention. In its own way criminology is the history of humanity. As long as people have been on earth there has been criminal activity. Much like most other work atmospheres, it was a male dominated field. A woman seeking to work in criminology was unheard of. Men filled the jobs as police officers, lawyers, judges, and politicians. However, in the 1860s Belva Lockwood became determined to pave the way for women in criminology. As a women’s rights activist, she became one of the most influential women in criminology.
Up until the 19th century, Classicist ideas dominated the way in which people looked at crime. However during the late 19th century a new form of “scientific criminology” emerged, called Positivism (Newburn, 2007). Positivism looked at the biological factors on why someone would commit a crime, this involved looking at the physical attributes of a person, looking at their genetic make-up and their biochemical factors.
Jock Young’s book “The Criminological Imagination” very clearly spells out the author’s feeling that orthodox criminology has lost its way and has been swallowed up into obscurification through bogus, post-modern positivism. Young postulates, the cost of this phenomena is the loss of critical thinking and objectivity in the field of criminology. Young contends criminology can be rescued from obscurity if returning to its orthodox beginnings by reducing the impact of neo-liberalism with critical imagination, and not simply succumbing to empirical data to try to explain everything. Young contends, doing so seems to simply cloud the view, thus giving rise to a host of incomplete and overly politicized theories.
During the 1970’s to the early 1990’s there had emerged two new approaches to the study of crime and deviance. The discipline of criminology had expanded further introducing right and left realism, both believe in different areas and came together in order to try and get a better understanding on crime and prevention. There were many theorists that had influenced the realism approaches such as; Jock Young (Left Wing) and James Wilson (Right Wing).
The positivist view of deviance places emphasis on individual's behavior being manipulated by outside forces (Goode, 2007, p. 23). Individual's are unable to contend with these outside forces which are beyond their control. Criminals and other deviants are created through biological defects which were responsible for their behavior, as it was something inherently organic and passed on through birth. Critical criminology, also known as radical criminology dates back to the concepts of Marxism. Despite the fact that Fredric Engels and Karl Marx were the founders of contemporary radical criminology, none of them gave explicit focus to crime. William Bonger (1876-1940), a Dutch criminologist was a more direct founder of this concept. It gained popularity during the early 1970s when it tried to explain the causes of contemporary social mayhem. He used economic explanations were used by critical criminology to analyze social behavior by arguing that social and economic inequalities were the main reason behind criminal behavior (Henry & Lainer, 1998). This view reduces the focus on individual criminals and elaborates that the existing crime is as a result of the capitalist system. Just like the conflict school of thought, it asserts that law is biased since it favors the ruling or the upper class and that the legal system that governs the state is meant to maintain the status quo of the ruling class. Critical criminologist are of the view that political, corporate and environmental crime are not only underreported but also inadequately punished by the existing criminal legal system.
Criminology is defined as the scientific study of the nature, extent, management, causes, control, results, and prevention of criminal behavior, both on individual and social levels. Criminology is the study of how people act towards each other, and has in effect been studied in one way or another for thousands of years. Both schools of thought have their own advantages and disadvantages which would impact society in a tremendous way. It is relieving to see that in the 21st century, societies around the world have adopted more of the advantageous ideas and not as many disadvantageous ideas. Nonetheless, the Classical School and the Positive School work best when fused together; it should be called the Classical Positive School of Criminology.

There are many different aspects of criminal justice policy. One in particular is the different theories of crime and how they affect the criminal justice system. The Classical School of criminology is a theory about evolving from a capital punishment type of view to more humane ways of punishing people. Positivist criminology is maintaining the control of human behavior and criminal behavior. They did this through three different categories of Biological studies, which are five methodologies of crime that were mainly focused on biological theories, Psychological theories, which contains four separate theories, and the Sociological theories, which also includes four different methods of explaining why crime exists. The last theory is about Critical criminology. Their goal was to transform society in a way that would liberate and empower subordinate groups of individuals.
The Classical School of Criminology generally refers to the work of social contract and utilitarian philosophers Cesare Beccaria and Jeremy Bentham during the enlightenment in the 18th century. The contributions of these philosophers regarding punishment still influence modern corrections today. The Classical School of Criminology advocated for better methods of punishment and the reform of criminal behaviour. The belief was that for a criminal justice system to be effective, punishment must be certain, swift and in proportion to the crime committed. It finally got people to view criminals in a scientific way as opposed to some of the other, less effective methods which had been used previously. While Cesare Lombroso was the first to apply positivism to criminology, it was made possible by the efforts of Auguste Comte, who was the first person to suggest trying to solve problems using scientific reasoning (Adler et al 2012). Also the work of Charles Darwin was able to make society more receptive to the idea of science being an acceptable way to answer questions and solve problems in society. Those three men were able to make criminology a more legitimate and respected field.
I now know that criminology prefer to highlight the correlations between crimes’ social climates and criminals’ psychological states of mind. While some argues that criminal behavior is a result of individuals’ association with criminal peers, other claims that crime is a reflection of an individual’s genetic disadvantages. I have come to learn that there are no universally agreed formulas on decoding crimes and criminal behaviors. What we have, however, is a manual full of academic opinions and subjective views that have emerged alongside of the development of criminology. At the same time, the volume of conflicting perspectives that I have stumble upon in studying criminology reminded me again that the success of our current assessment models has yet to be determined. Criminology is the scientific study of why people commit crime and why they act the way they do. The origins of criminology are usually placed in the eighteenth to the mid- nineteenth century. This was also a point of scientific discoveries and the creation of the new scholarly field of studies. One of these was criminology. Criminology was an act against the wild system of law, punishment, and justice that existed before the French revolution. (Adler, Mueller, Laufer & Grekul, 2012). There are many criminology theories that explain why an individual commit a crime. Anomie/stain theory and labelling theory are two important theories in criminology. There are two different kinds of theories, psychological theories and biological theories. Both of those theories share the assumption that such behaviour is caused by some underlying physical or mental condition that separates the criminal from the non-criminal. They seek to identify the kind of person who becomes a criminal and to find the factors that caused the person to engage in criminal behavior. (Adler et al.,).
