Censorship is a Personal Decision
"One man's vulgarity is another's lyric."
Justice John M. Harlan, Cohen v. California (1971)
It is probably no accident that freedom of speech is the first freedom mentioned in the First Amendment: "Congress shall make no law...abridging the freedom of speech, or of the press, or of the people peaceably to assemble, and to petition the Government for a redress of grievances." The Constitution's framers believed that freedom of inquiry and liberty of expression were the hallmarks of a democratic society.
Freedom of speech, of the press, of association, of assembly and petition -- this set of guarantees, protected by the First Amendment, comprises what we refer to as freedom of expression. The Supreme Court has written that this freedom is "the matrix, the indispensable condition of nearly every other form of freedom." Without it, other fundamental rights, like the right to vote, would wither and die.
But in spite of its "preferred position" in our constitutional hierarchy, the nation's commitment to freedom of expression has been tested over and over again. Especially during times of national stress, like war abroad or social upheaval at home, people exercising their First Amendment rights have been censored, fined, even jailed. Those with unpopular political ideas have always borne the brunt of government repression. It was during WWI -- hardly ancient history -- that a person could be jailed just for giving out anti-war leaflets. Out of those early cases, modern First Amendment law evolved. Many struggles and many cases later, ours is the most speech-protective country in the world. (Glasser, Visions of Liberty, 1991.)

...only if it will clearly cause direct and imminent harm to an important societal interest. The classic example is falsely shouting "fire!" in a crowded theater and causing a stampede. Even then, the speech may be silenced or punished only if there is no other way to avert the harm.
The inevitable answer to our censorship predicament is simple, and timeless: a free society is based on the principle that each and every individual has the right to decide what art or entertainment he or she wants -- or does not want -- to receive or create. Once you allow the government to censor someone else, you surrender to it the power to censor you, or something you like. Censorship is like poison gas: a powerful weapon that can harm you when the wind shifts. Freedom of expression for ourselves requires freedom of expression for others. It is at the very heart of our democracy.
Freedom of speech has been a controversial issue throughout the world. Our ability to say whatever we want is very important to us as individuals and communities. Although freedom of speech and expression may sometimes be offensive to other people, it is still everyone’s right to express his/her opinion under the American constitution which states that “congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or the press”. Although this amendment gave people the right express thier opinions, it still rests in one’s own hands as how far they will go to exercise that right of freedom of speech.
One key to the first amendment of the United states constitution is the right to free speech. Freedom of speech is what separates America than other countries around the world that forbid freedom of speech rights. Freedom of speech has been in our constitution since the year 1791. When James Madison “the father of the constitution” wrote the bill of rights he saw potential and that it would make the country more freedom filled than other countries. The land of the free is what the United States is nicknamed and it 's because of our rights to express ourselves as freely as we desire.
Freedom of speech and expression is a right given to all Americans in the First
The first amendment is the cornerstone of our American society founded years ago by our forefathers. Without the first amendment many ideas, beliefs, and groups could not exist today. The first amendment guaranteed the people of the United States the freedom of speech, freedom of the press, and freedom of religion, freedom of assembly, and freedom of petition. Although the first amendment guarantees us, Americans the freedom of speech, we cannot use it to cause others harm. This amendment has helped shaped Americans into what we are today, because of our right to assemble, speak freely, and worship as we please.
The Amendment I of the Bill of Rights is often called “the freedom of speech.” It provides a multitude of freedoms: of religion, of speech, of the press, to peacefully assemble, to petition the government. Religious freedom is vitally important to this day because it eliminates the problem of religious conflicts. Historically, many people died for their beliefs because their government only allowed and permitted one religion. T...
Since this country was founded, we have had a set of unalienable rights that our constitution guarantees us to as Americans. One of the most important rights that is mentioned in our constitution is the right to free speech. “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the
According to “Freedom of Speech” by Gerald Leinwand, Abraham Lincoln once asked, “Must a government, of necessity, be too strong for the liberties of its people, or too weak to maintain its own existence (7)?” This question is particularly appropriate when considering what is perhaps the most sacred of all our Constitutionally guaranteed rights, freedom of expression. Lincoln knew well the potential dangers of expression, having steered the Union through the bitterly divisive Civil War, but he held the Constitution dear enough to protect its promises whenever possible (8).
In the late 1900’s the clear and present danger clause was added to the constitution which added small print to the first amendment. The clause was added to stop people from opposing the draft and United States war efforts when entering world war one. The clause states that if speech or writing poses a clear and present danger to others than it is not permitted under the first amendment. Under the same principal, you can’t scream “fire” in a crowded theater without consequences.
Based on the First Amendment, the government may not exercise any activities that interference freedom of speech of an individual. For Americans, freedom of speech is clearly become the most basic freedom. Everyone has always thinks freedom of speech is a basic right that everyone automatically has when they were born; on the other hand, freedom of speech is experiencing serious growing pains.
The subject of censorship is a very controversial one, especially the banning of books. Many people believe they must protect themselves and others from the "evils" of many classic books and works of art because they can be deemed "indecent" in one way or another. Many believe that this is absurd and censorship in its current form is a violation of our First Amendment right to free speech. Personally, I align myself with the latter, however I do feel there are occasions where censorship is justifiable.
Freedom of speech cannot be considered an absolute freedom, and even society and the legal system recognize the boundaries or general situations where the speech should not be protected. Along with rights comes civil responsib...
Tackling censorship is much more important than it appears to be at the surface; taking down censorship would help preserve the expression of thought. It would help preserve the right to listen to the unaltered forms of everything. Most importantly, it would help preserve the rapidly weakening basic right of speech. Censorship has always altered the lives of many people, whether they know it or not. People are constantly exposed to the censored version of entertainment.
Since the foundation of the United States after a harsh split from Britain, almost 200 years later, an issue that could claim the founding grounds for the country is now being challenged by educators, high-ranking officials, and other countries. Though it is being challenged, many libertarians, democrats, and free-speech thinkers hold the claim that censorship violates our so-called unalienable rights, as it has been proven throughout many court cases. Censorship in the United States is detrimental because it has drastically and negatively altered many significant events. Censorship allows governments more control of society than they already have, slowly progressing governments utilizing censorship to a dictatorship. Often times, this censorship can lead to immense rebellions.
Hence, censorship is essential in society to eliminate discrimination on basis of race and gender, protect children, maintain stability and restore what censor sees as lost moral values. Censorship occurs when expressive materials like books, magazines, movies, videos, music or works of art are restricted to particular audiences based on their age or other characteristics. http://www.ala.org/oif/intellectualfreedeomandcensorship.html) Censorship is not a recent development. It wasn’t imposed properly or there weren’t strict regulations before.
Censorship affects our society in many different ways, it affects the music we listen to, the movies we watch, the books we read, and many other aspects of our everyday lives. Even though many might argue that censorship doesn't really have a place in a society that emphases freedom of speech and the freedom to express oneself, but censorship is an essential and needed part of our growing society, it's needed in the television industry, the Internet, and the music industry. Censorship helps to make our world a better place because it creates a better environment for us to live in.
