“The death penalty is a necessary tool that reaffirms the sanctity of life while assuring that convicted killers will never again prey upon others” (Williams, 88). Murder rates had begun to decline in the years following 1935, but the Supreme Court began overturning death penalty cases on routine basis. The homicide rate quickly increased after this pattern became evident (Espejo, 9). The death penalty plays a significant role in our legal system, and the amount of murders committed. It is a topic that has been debated for many years, and continues to be. Many factors support the belief that the death penalty can serve as a just form of punishment.
The trials for capital offenses are extensively in depth compared to a regular trial. Before a trial begins the prosecutor must file an intent to punish by death (Sylvester, 2). More time is taken to prepare for death penalty cases, to ensure every hypothesis is explored. There are twice as many attorneys given to the defense and prosecution, and a larger amount of experts gathered to study the case. A duke university study shows that capital murder trials take three to five times longer than a simple murder case. Death penalty cases conduct two trials. In the first trial, the jury determines if the defendant is innocent or guilty. In the second trial, the jury decides if death is the fitting punishment for the crime (Dieter, 1). To avoid a mistrial, a unanimous verdict must be found (Sylvester, 1). Evidence plays a key role in the process of each part of a capital trial. “The DNA tests main effect will be to increase society’s confidence that the man or woman being strapped to the death gurney really did commit the crime” (Williams, 167). He was able to escape a road work gang and stab a storekeeper for only four dollars (Espejo, 49). These real examples show how life imprisonment does not guarantee a full proof penalty or protect the safety of the public as capital punishment can.
“Abolition of the death penalty would promise perspective murderers that we will never do to them what they will do to their victims” (Espejo, 29). Every criminal must have a punishment that balances out their crime. Through research the death penalty has been proven to be fit. The justice system is not in place to seek revenge, but to achieve restitution. Murderers need to be aware of the damage thy cause to innocent people and research supports that capital punishment can assist as a valid way to show them.
