Introduction In the past several decades the clothing industry has soared, especially the teen and young adult clothing sectors. One major company that we have all heard about is Abercrombie & Fitch. Abercrombie and Fitch originated in 1891 as a sporting goods store in New York City. They sold expensive and exotic items in stores that were located in large cities or resort areas (Britannica). After almost eighty-five years of selling to an exclusive group and seeing sales decline, Abercrombie & Fitch declared bankruptcy in 1976. They were then bought by The Limited Inc. who several years later expanded to become the parent to the Hollister Co. brand as well as Gilly Hicks (Britannica). This lawsuit could potentially make things much worse for Abercrombie as far as image and revenue are concerned. Samantha Elauf is suing Abercrombie & Fitch stating that she was discriminated against in an interview where she wore her black hijab, or Muslim head scarf. This is something that Elauf wears because of the religion. Carmon reported for MSNBC in February 2015 that “Elauf, represented by the federal Equal Employment Opportunity Commission (EEOC), sued under the Title VII of the Civil Rights Act, which prohibits employment discrimination of the basis of race, color, religion, sex, or national origin.” The Title VII of the Civil Rights Act clearly states that you cannot discriminate on the basis of religion. Elauf was simply wearing the head scarf because that was her religion. If the Supreme Court rules against Abercrombie & Fitch later this summer then that could have serious repercussions for the company in the midst of their efforts to turn the company around. Abercrombie & Fitch needs to perform a thorough competitive analysis to evaluate their competition since the recent changes have taken place within the company. By doing this they would better understand what they needed to do as a company to rise to the top of the retail clothing world.
