In this article, a young American boy, Michael Fay, who lived in Singapore, was convicted of vandalism and was sentenced to a flogging. The author of this article, Mike Royko, was American, and was on Fay’s side, he thinks that a flogging is wrong.
Royko defines what Fay did as “mischief”. Giving someone a rubber pencil when they ask to borrow a real pencil is mischief, spray painting, egging, switching license plates and tearing down street signs is vandalism, which is more serious than mischief. I think that Royko was trying to downplay what Fay did, to prove his point that flogging is much too harsh for vandals. Every civilized society makes laws that protect its values, and the society expects every single citizen to obey these laws. Whenever a citizen of a certain society breaks one of these laws, the rulers of the society dish out punishments they dim fit for the kind of crime committed. With this kind of justice system in place, criminals are either locked up in prison cells, whipped, or exiled from the society. In the essay, “Bring Back Flogging”, columnist Jeff Jacoby argues that flogging is much more superior to imprisonment and should be brought back as a method of punishing crime offenders like the Puritans did in the past. He is convinced that the shame associated with flogging would prevent offenders from going into crime professionally. Jacoby believes that whipping criminals has more educational value compared to locking them up in cells and that it saves a lot of money. Throughout the essay Jacoby attempts to build ethos even though it fell apart due to misconceptions. He relied mostly on the use of pathos by appealing to his reader’s emotions and using this as a base ground for his logos.
Many people were hanged, even though they were innocent. Many years later during the WWII era, there was a lot of speculation about communists and their impact in America. This era was known as the McCarthyism era, because, Sen. McCarthy was the leading America into an anti-communist state. In one case in particular was of a U.S. Air Force Lieutenant, Milo Radulovich, who was released from the Air Force due to the fact that his father, read a newspaper which was from Serbia, because he has a Serbian background, the Air Force believed his was pro-communism, since the newspaper favored communism. The Air Force also believed Milo was pro-communist because, his sister peacefully protested outside a hotel which didn’t allow a communist member to stay at.

In “Bring Back Flogging”, Jeff Jacoby argues why the current criminal justice system in America is not effective or successful. As a solution, he suggests that America should bring back the old fashioned form of punishment once used by the puritans, flogging, as an alternative to imprisonment (198). This article originally appeared in the op-ed section of the Boston Globe newspaper. Therefore, the primary audience of this article is people who want to read arguments about controversial topics and have probably read some of his other articles. His argument that the current criminal justice system is not working is extremely convincing. He appeals to pathos and uses statistics to prove that thesis and to persuade the audience.
During seventeenth century flogging was a popular punishment for convicted people among Boston's Puritans. Fortunately, those times have passed and brutal and inhuman flogging was replaced by imprisonment. Columnist for the Boston Globe, Jeff Jacoby in his essay "Bring back flogging" asserts that flogging is superior to imprisonment and advocates flogging as an excellent means of punishment. He is convinced that flogging of offenders after their first conviction can prevent them from going into professional criminal career and has more educational value than imprisonment. He also argues that being imprisoned is more dangerous than being whipped, because the risk of being beaten, raped, or murdered in prison is terrifying high. Unfortunately, Jeff Jacoby made some faulty assumptions and his article "Bring back flogging" is filled with misconceptions.

Throughout America’s history, capital punishment, or the death penalty, has been used to punish criminals for murder and other capital crimes. In the early 20th century, numerous people would gather for public executions. The media described these events gruesome and barbaric (“Infobase Learning”). People began to wonder if the capital punishment was really constitutional.
Until there is a credible way to determine whether or not torture is in fact effective, I pass judgment that the practice should be discontinued. The question as to if the torture policy is a human rights violation or if it holds crucial necessity, is not answered in the essay. Applebaum explores the reality that torture possesses negative implications on the inflictor. After presented with the compelling stance and evidence, Applebaum raises the interesting question as to why so much of society believes that torture is successful. I agree that the torture policy is wrong, a point emphasized by Applebaum, contrary to the popular attitude surrounding the topic.

It is quite imperative to note that capitalism has been the dominant in this nation, which enables it to not only strengthen, but also capture great regional as well as global influence. Even though China has been rediscovering its ancient tradition elements whilst repackaging them to be in line with modernity, it is evident that the visions embraced are very different from the ones in the West. The Celebrated Cases of Judge Dee is a perfect publication that sheds light to the reader on the various social, political and moral issues that existed in China decades ago and the ways of resolving them. Comparing the legal issues in China decades ago, a thin line can be drawn. This is inherently because nothing much has changed in terms social, political and moral perspectives. The celebrated cases of Judge Dee borrow a lot from the Chinese culture, which defines the standard morals and values for its people. Consequently, the legal system in this nation appears to rely wholly on the defined moral standards in reprimanding wrongdoers.

When a person violates a criminal law, society’s traditions generally demand that society should take some action against the person: an arrest should be made. In order for a police officer to make a lawful arrest he must have probable cause to justify the detention of a suspect. An arrest generally involves a person being taken into custody, where the person is not allowed to leave freely. Afterward, the accuser is taken to a local jail facility where the person is booked (Aberle, 2014).

The death penalty has been an inalienable part of human society and its legal system for centuries, regarded as a necessary deterrent to dangerous crimes and a way to liberate the community from dangerous criminals. However, later on this type of punishment came to be regarded as a crime against humanistic ideals by many, and its validity in the legal system has been questioned. Until now, the debate rages on. This resulted in a wide discrepancy of laws on this issue. Some nations, including China, the US, Iran, Belarus, and others preserve the death penalty as an option, while others like Canada, Australia, New Zealand, and almost all European nations have abolished capital punishment. Still others keep the norm in their legislation.
Punishing the unlawful, undesirable and deviant members of society is an aspect of criminal justice that has experienced a variety of transformations throughout history. Although the concept of retribution has remained a constant (the idea that the law breaker must somehow pay his/her debt to society), the methods used to enforce and achieve that retribution has changed a great deal. The growth and development of society along with an underlying, perpetual fear of crime are heavily linked to the use of vastly different forms of punishment that have ranged from public executions, forced labor, penal welfarism and popular punitivism over the course of only a few hundred years.
