During seventeenth century flogging was a popular punishment for convicted people among Boston's Puritans. Fortunately, those times have passed and brutal and inhuman flogging was replaced by imprisonment. Columnist for the Boston Globe, Jeff Jacoby in his essay "Bring back flogging" asserts that flogging is superior to imprisonment and advocates flogging as an excellent means of punishment. He is convinced that flogging of offenders after their first conviction can prevent them from going into professional criminal career and has more educational value than imprisonment. He also argues that being imprisoned is more dangerous than being whipped, because the risk of being beaten, raped, or murdered in prison is terrifying high. Unfortunately, Jeff Jacoby made some faulty assumptions and his article "Bring back flogging" is filled with misconceptions.

Every civilized society makes laws that protect its values, and the society expects every single citizen to obey these laws. Whenever a citizen of a certain society breaks one of these laws, the rulers of the society dish out punishments they dim fit for the kind of crime committed. With this kind of justice system in place, criminals are either locked up in prison cells, whipped, or exiled from the society. In the essay, “Bring Back Flogging”, columnist Jeff Jacoby argues that flogging is much more superior to imprisonment and should be brought back as a method of punishing crime offenders like the Puritans did in the past. He is convinced that the shame associated with flogging would prevent offenders from going into crime professionally. Jacoby believes that whipping criminals has more educational value compared to locking them up in cells and that it saves a lot of money. Throughout the essay Jacoby attempts to build ethos even though it fell apart due to misconceptions. He relied mostly on the use of pathos by appealing to his reader’s emotions and using this as a base ground for his logos.
In Jeff Jacoby’s essay Bring Flogging Back, he discusses whether flogging is the more humane punishment compared to prison. Jacoby uses clear and compelling evidence to describe why prisons are a terrible punishment, but he lacks detail and information on why flogging is better. In the essay, he explains how crime has gotten out of hand over the past few decades, which has led to the government building more prisons to lock up more criminals. His effort to prove that current criminal punishment is not perfect or even effective is nicely done, but he struggled with discussing ways that flogging could lower the crime rates and provide a safer environment for America. As a solution, he suggests that America should bring back the old fashioned form of punishment once used by the puritans, flogging, as an alternative to imprisonment (198). Flogging can be traced back to Jesus, yet was most commonly seen in the 16th century by Puritans, navels, and slaves. Although most think corporal punishment of criminals vanished with the Puritans, this is false. Delaware did not repeal it until 1972. Jeff Jacoby is a columnist for the Boston Globe, a daily newspaper from Boston, Massachusetts, which was founded in 1872. This article Bring Back Flogging was originally published on February 20, 1997. Based on the information given in the essay I do agree that flogging would be an effective alternative to jail time for non-criminal charges.
For example, police and probation officers become involved in non-criminal justice matters at schools and in the community, often times by advising parents and students on academic matter. According to some of the boys in Rios book, probation officers served the purpose of punishing them by branding them criminal in front of the rest of the community, which prompted victimization by peers, stigmatization in the community, and rearrests for minor infractions. Eventually, the youth learned to manipulate the system and increasing recidivism. Rios also notes that some youth were being incarcerated through false accusations, police “step-ups”, entrapments, and forced testimonies that led many of the boys to declare a vow against everyone providing information to police, even when they were the victims. Also, the gang database accentuates criminalization, as it permits police to keep track of most at-risk juveniles and impose tougher policing and harsher sentencing.* In other words, police roles leak into other aspects of juvenile’s lives, which have led to an increase in criminalization. As discussed in depth, there are all types of crimes that are committed by young offenders these days and the offenders possess a number of different characteristics. There have been many theoretical crime explanations that have been formed over the years that attempt to explain the reasoning behind the question of why certain individuals, both young and old, are more prone to commit crimes. The discussion of punishment practices are also important because it displays the many approaches that have been taken to ensure that juvenile delinquents are being treated fairly, but punished and rehabilitated all simultaneously. Many methods fall under this kind of approach referred to as the restorative justice approach such as neighborhood conference committees, victim impact panels, sentencing circles, and community impact panels which all attempt to rehabilitate the offender, but also to involve members of society including the victims/survivors of crimes (Siegel, 2009). Juvenile crime in the United States is ballooning out of control along with adult crimes, and politicians and law enforcement officials don’t seem to be able to do anything about it. Despite tougher sentencing laws, longer probation terms, and all other efforts of lawmakers, the crime and recidivism rates in our country can’t be reduced. The failure of these recent measures along with new research and studies by county juvenile delinquency programs point to the only real cure to the U.S.’s crime problem: prevention programs. The rising crime rates in the United States are of much worry to most of the U.S.’s citizens, and seems to be gaining a sense of urgency. Crime ranks highest in nationwide polls as Americans’ biggest concern (Daltry 22). For good reason- twice as many people have been victims of crimes in the 1990s as in the 1970s (Betts 36). Four times as many people under the age of eighteen were arrested for homicide with a handgun in 1993 than in 1983 (Schiraldi 11A). These problems don’t have a quick fix solution, or even an answer that everyone can agree on. A study by the Campaign for an Effective Crime Policy has found no deterrent effects of the “Three Strikes and You’re Out” law recently put into effect by politicians (Feinsilber 1A). It has been agreed however that there is not much hope of rehabilitating criminals once started on a life of crime. Criminologist David Kuzmeski sums up this feeling by saying, “If society wants to protect itself from violent criminals, the best way it can do it is lock them up until they are over thirty years of age....
